Targhee Lodge`~~ '~L CERTIFICATE OF ZONING COMPLIANCE REPORT DATE: September 8, 2011 TO: Meadow Lake Village Retirement Resort, LLC FROM: Bill Parsons, Associate City Planner SUBJECT: Targhee Lodge -CZC-11-039 and DES-11-021 OWNER: Meadow Lake Village Retirement Resort, LLC DESCRIPTION OF APPLICANT'S REQUEST E IDIAN~- loaNo The applicant, Meadow Lake Village Retirement Resort, LLC, requests certificate of zoning compliance (CZC) and design review (DES) approval to construct a new 103,300 square foot retirement apartment building consisting of 68 units located at 4115 N. Clocktower Lane. The site consists of 13 acres and is zoned L-O. The use and site design was approved through a planned development (CUP-04-014) DECISION The applicant's request for CZC and DES is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verb if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide two sets of the final, stamped "approved" Planning Department plans. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The site plan prepared by LRS Architects dated 09/02/11, labeled Permit Set is approved (stamped "approved" on 09/08/11 by the City of Meridian Planning Department) with no changes. 5. The landscape plan prepared by LRS Architects., dated 08/24/11, labeled L1.0 is approved (stamped "approved" on 09/08/11 by the City of Meridian Planning Department) with no changes. 6. The building elevations prepared by LRS Architects, dated 09/02/11, labeled A4.00 and A4.Olis approved (stamped "approved" on 09/08/11 by the City of Meridian Planning Department) with no changes. Conditions Document Targhee Lodge CZC & DES 7. The approved site plan, landscape plan and building elevations shall not be altered without prior written approval of the City of Meridian Planning Department. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CPA-99-004, AZ-99-021, DA #101048096, CUP-99-039, CUP-03-005 and CUP-04-014). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before 09/23/2011, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The administrative design review shall be exercised with the approval period of the underlying permit (CZC) or the approval shall expire. Urban /Suburban Design Guidelines 1.1 COHERENT PLAN Master Plan has been developed for this large-scale, phased project and demonstrates the establishment of appropriate context and cohesiveness of individual project components. 3 buildings have been built with plans for 3 more. The Targhee Lodge Homes and Memory Care buildings are to be completed by end of 2012. Elkhorn Lodge will be last remaining phase to be built. 1.2 ACCESS and CONNECTIVITY The site and building layout has addressed vehicle access, pedestrian connectivity, building orientations, parking and public spaces with majority of buildings oriented in the north south direction with a circular 'ring' road enclosing the site with all buildings within the `ring' road. Pedestrian sidewalks provide connections between all buildings, present and future. Main complex entry is on the north side of property with public parking and adjacent green spaces. Outside the ring road, to the north, is the complex's small golf course with associated water feature and club house. 1.3 ORIENTATION and LAYOUT Site ingress/egress is from the north off Franklin Blvd. The ring road creates an internal circulation pattern. Roof Lines Appropriate roof forms are used throughout with the use of primary and secondary roof elements that modulate/articulate both in/out and up/down. Consistent roof overhangs are used with architectural detailing at these overhangs at consistent intervals. The larger roof masses are supported by large column mass that is carried to grade. Various roof forms are used between hips, gables and sheds. d. Pattern Variations No large mass blank walls are present. Pattern variation in building forms and building material is used throughout..Exterior building materials used are stone at the base and either lap, board or shingle siding above the base. This pattern is consistent throughout the community buildings. e. Fenestration Consistent pattern of exterior windows and doors are used. Each unit type stacks on top of each other so window patterns are consistent horizontally and vertically. Exterior patio doors are in the same location at each unit type and again stack vertically. f. Mechanical Equipment All mechanical equipment that will be located at grade will be screened utilizing landscape material and or fencing material or combination of both. 2.5 Color and Materials. Consistent use of materials and colors on each facade are used on all buildings that contribute to a cohesive and appealing design. Wood, concrete, stone and metal materials are used in consistent repeating patterns from building to building. -2- DESIGN WITH INTEGRITY 3.0 Site Plan and Building Layout LRS ARCHITECTS a. Building Location Buildings are oriented in the north south direction with a circular ring road enclosing the site with all buildings within the `ring' road (Grand Lodge Loop). b. Parking areas Main public parking is located north end of site at Grand Lodge. The Meadows, assisted living, to the south has large public parking located on south side of building. All parking is within the ring road and or along both sides of the ring road (parallel parking only) c. Access Access is from the north off Franklin Road to S. Touchmark Way d. Street Layout and internal circulation Layout is based upon the `ring' road (Grand Lodge Loop) The ring road creates an internal circulation pattern with loop roads around the other buildings within the ring road. e. Pedestrian walkways and facilities Pedestrian connectivity is created by interconnected pathways/sidewalks between all buildings and all internal parking areas. This area will need to be marked and signed as a NO PARKING FIRE LANE. This will still allow the department to have a reasonable access to all points of the building. Griffith Drive, Beaverton, Oregon 97005, (Licensee), is made with reference to the following facts: The District and Licensee entered into a certain License Agreement dated l'une 4, 2002, recorded as Instrument No. 102067186, Records of Ada County, Idaho. The purpose of the License Agreement is to permit Licensee to pipe and relocate a portion of the Barker Lateral and .pipe and relocate a portion of the Chaffin Drain, all within Licensee's property, Meadowlake V illage, located southeast of the intersection of Franklin Road and Eagle Road in Meridian, Ada County, Idaho. The construction described in this Addendum shall be in accordance with those portions of certain plans attached hereto as Ex}i.~bit D-I and by this reference made a part hereof. 2. Licensee shall not excavate, place an~° structures, plant any trees, shrubs, or landscaping or perform any other construction or activity within or at~ecting the District's easement for the Chaffin Drain except as referred to in this agreement or exhibits hereto without the prior written consent of the District. Request for Appeal of Staff Decision Appeal of Staff Decision:N The Commission shall hear and decide appeals by an applicant of the final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or enforcement of the ACHD Policy Manual. a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged the applicant for the processing of appeals, to cover administrative costs. b. .Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary of Highway Systems, which must be filed within ten (10) working days from the date of the decision that is the subject of the appeal. The notice of appeal shall refer to the decision being appealed, identify the appellant by name, address and telephone number and state the grounds for the appeal. The grounds shall include a written summary of the provisions of the policy relevant to the appeal and/or the facts and law relied upon and shall include a written argument in support of the appeal. The Commission shall not consider a notice of appeal that does not comply with the provisions of this subsection. c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of the filing of the notice of appeal to reply to the notice of the appeal, and may during such time meet with the appellant to discuss the matter, and may also consider and/or modify the decision that is being appealed. A copy of the reply and any modifications to the decision being appealed will be provided to the appellant prior to the Commission hearing on the appeal. d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal will be noticed and scheduled on the Commission agenda at a regular meeting to be held within thirty (30) days following the delivery to the appellant of the ROWDS Manager's reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal and the reply shall be delivered to the Commission at least one (1) week prior to the hearing. e. Action by Commission: Following the hearing, the Commission shall either affirm or reverse, in whole or part, or otherwise modify, amend or supplement the decision being appealed, as such action is adequately supported by the law and evidence presented at the hearing. Develo ment Process Checklist ®Submit a development application to a City or to the County ®The City or the County will transmit the development application to ACRD ®The ACRD Planning Review Division will receive the development application to review ®The Planning Review Division will do one of the following: ^Send a "No Review" letter to the applicant stating that there are no site specific requirements at this time. ®Send a "Comply With" letter to the applicant stating that if the development is within a platted subdivision or part of a previous development application and that the site specific requirements from the previous development also apply to this development application. ^Write a Staff Level report analyzing the impacts of the development on the transportation system and evaluating the proposal for its conformance to District Policy. ^Write a Commission Level report analyzing the impacts of the development on the transportation system and evaluating the proposal for its conformance to District Policy. ®The Planning Review Division will hold a Technical Review meeting for all Staff and Commission Level reports. ^For ALL development applications, including those receiving a "No Review" or "Comply With" letter: • The applicant should submit a set of engineered plans directly to ACHD for review by the Development Review Division for plan review and assessment of impact fees. (Note: if there are no site improvements required by ACHD, then architectural plans may be submitted for purposes of impact fee calculation.) • The applicant is required to get a permit from Construction Services (ACHD) for ANY work in the right-of--way, including, but not limited to, driveway approaches, street improvements and utility cuts. ^Pay Impact Fees prior to issuance of building permit. Impact fees cannot be paid prior to plan review approval. D1D YOU REMEMBER: Construction (Zone) ^ Driveway or Property Approach(s) • Submit a "Driveway Approach Request" form to Ada County Highway District (ACHD) Construction (for approval by Development Services & Traffic Services). There is a one week turnaround for this approval. ^ Working in the ACRD Right-of-Way • Four business days prior to starting work have a bonded contractor submit a "Temporary Highway Use Permit Application" to ACHD Construction -Permits along with: a) Traffic Control Plan b) An Erosion & Sediment Control Narrative & Plat, done by a Certified Plan Designer, if trench is >50' or you are placing >600 sf of concrete or asphalt. Construction (Subdivisions) ^ Sediment 8~ Erosion Submittal • " At least one week prior to setting up a Pre-Con an Erosion & Sediment Control Narrative & Plat, done by a Certified Plan Designer, must be turned into ACHD Construction -Subdivision to be reviewed and approved by the ACHD Drainage Division. ^ Idaho Power Company • Vic Steelman at Idaho Power must have his IPCO approved set of subdivision utility plans prior to Pre-Con being scheduled. ^ Final Approval from Development Services ACHD Construction -Subdivision must have received approval from Development Services prior to scheduling aPre-Con.
