Rezone and Modified Development Agreement Applications
Dear Planning Staff,
On behalf of the owner, BHH Kingsbridge LLC, we are pleased to submit the attached
application for a Rezone of Phase 2 and Phase 3 of the Kingsbridge Subdivision from R-2 to
R-4 Zoning. In addition, a modified Development Agreement is requested to incorporate the
proposed R-4 zoning and establish increased dimensional standards to allow minor
reductions in setbacks only. As such, all other, dimensional standards of the approved
preliminary plat for Kingsbridge Phase 2 and Phase 3 (PP-10-007) and the approved Final
Plat for Phase 2 (FP-11-004) will be maintained in terms of rear yard setbacks, density,
minimum lot size, and minimum lot frontage of the previous R-2 zone. In addition, the
minimum home square footage will be incorporated into the Modified Development
Agreement for 2,000 SF single story homes and 2,400 SF two-story homes. These
minimum home sizes far exceed the 1,500 SF minimum allowed in the R-2 zoning and the
1,400 SF minimum allowed in the R-4 zoning. Please see the attached Zone Dimensional
Standard Comparison showing the standards allowed for each of the zones and the proposed
"modified" R-4 zoning standards.
The sole purpose of the Rezone request is to allow architectural flexibility to provide wider,
aesthetically pleasing, and high quality homes in this upscale subdivision as shown in the
current Development Agreement (MDA-11-004). As approved, two-story homes will be
constrained to 55-feet wide on 85-foot-wide lots (15' side yard for 2-story). The range of
architectural product types is very limited at this 55-foot width and is prohibitive to side-
entry garage product types and optional RV bays. In addition, some upscale single-story
product types are over 70-feet wide and will not fit on 85-foot-wide lots (7.5' side yard for
1-story). While these minimum side-yard setbacks will not be utilized on every lot and in
many cases will exceed the minimums, the flexibility to fully utilize the generous lot widths
in conformance to the side yard, side corner yard, and front yard setbacks (from living area)
of the R-4 zone is desirable to maximize the architectural variety of these high-end homes.
To insure that all other dimensional standards from the previous approvals are locked in
place within Kingsbridge Phase 2 (361ots under construction) and Phase 3 (36 Future lots),
we are proposing a Modified Development Agreement with the proposed terms:

In addition, the West Property Line setbacks for Lot 4, Block 11; Lot 26, Block 1; and Lot
35, Block 1 will be established in the Development Agreement at 15-feet-wide. Currently,
the R-2 zoning could allow 7.5-feet (single story) and 15-feet (two story) setbacks at these
locations.
All other dimensional standards of the R-4 Zoning shall apply which include rear setbacks
identical to the current R-2 zoning. In addition, all other terms of the previous Development
Agreement Modification (MDA-11-004) shall apply with the aforementioned additions.
The public health, welfare, and safety will not be jeopardized by allowing the flexibility to
build upscale homes to the R-4 side, side corner, and front setbacks of the R-4 zone in the
same manner of several thousand homes constructed in Meridian in the last several years
within dozens ofhigh-quality and safe neighborhoods.
We look forward to the public hearing to discuss the Rezone and Modified Development
Agreement application and request Planning Commission and City Council approval.

required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
