Broadway Avenue Meridian, Idaho 83642 RE: Cavanaugh Subdivision, Application for Time Extension Dear Ms. Sonya Watters: I have been authorized by the DBSI Real Estate Liquidating Trustee ('Trustee") who is responsible for the Cavanaugh property, to submit an application for a two (2) year time extension request. As you know, the Cavanaugh Subdivision property has been idled due to the bankruptcy of DBSI, Inc., the parent company of the land ownership entity. The City of Meridian previously granted an extension of the Preliminary Plat for Cavanaugh Phase 1, and there is now a deadline of August 22, 2011 to obtain the City Engineer's signature on the Phase 1 Final Plat. It is evident that economic and real estate market conditions have impacted the development timetable for Cavanaugh, as it has for thousands of similar projects regionally and nationally. Also, there were liens placed upon this property and it has taken time to work -through and resolve those liens. Consequently, it has not been possible to apply for the City Engineer's signature on the Phase 1 Final Plat prior to the August 22, 2011 deadline. The Trustee has received inquiries from several viable companies regarding the Cavanaugh property so we do believe the best way to expedite the development of this project is to have it acquired by a developer who is prepared to build out the project as it was originally intended. If the previous city approvals are extended by the Meridian City Council, then the Trustee will seek to sell this property to such a party. This will re-energize Cavanaugh and finish what was started in this neighborhood.
