Idaho Avenue. DECISION The applicant's request for CZC is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit andlor inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide two sets of the final, stamped "approved" Planning Department plans. You must provide these plans in PDFformat and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. The aerial photo (site/landscape plan) submitted, is approved (stamped "approved" on August 29, 2011 by the City of Meridian Planning Department) with no changes. 4. The approved site/ landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 5. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 6. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. Conditions Document 1 Entrepreneur Think-Tank Co-Op CZC-11-036 7. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site. 2. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 3. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 4. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. The applicant andlor property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before September 13, 2011, within fifteen days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code b7-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. NOW THEREFORE, FOR GOOD AND VALUABLE CONSIDERATION in the net sum of $39,500.00 to be paid as hereinafter provided, Sellers agree to sell and convey unto the Buyer, and Buyer agrees to purchase from the Sellers, the above described property upon the following terms and conditions towits a.! $19,750.00 net cash upon the ex cution of this ~ agzeement, the receipt for which is he eby acknowldged; b. The balance or the sum of 519,750.00 together with interest thereon at the rate of 7! per annum, annual percentage rate, from the date of this agseement ' first above written, which amount, principal and ~ accrued interest, shall be due and payable on January f 2, 1987 and which sum shall be evidenced by a promissory note as stated herein. c.~ FURTHER, IN CONSIDERATION, the Buyer agrees to pay all I closing costs and any taxes due for the year 1986 but not prior to January 1, 1986. rr~BPOSE, TZGER~LD 'a00K5TON ilornrry~anA :oun~Nen All; payments due Sellers hereunder of. the deferred balance of the purchase price, and any interest thereon, shall be paid directly to the Sellers at the following addrf~ss: Sellers shall pay all taxes and ass~ssmr~nts that. have been or may be levied against said property up to and including the year 1985; taxes and assessments for 1986 and thereafter shall b~ paid by ,the Buyer and they hereby agree to pay the same. Should Buyer fail to pay same as herein provided, such failure shall constitute grounds for default as hereinafter pr~OVided; it being understood, however, that from the date of this I transaction the Buyer should not be required to pay taxes in that it is a tax exempt gntity. Se,lers agree to furnish Buyers a Purchasers Title InsurancF. Policy ~in the sum of $40,000.00, covering said property, insuring such title as good and marketable, free and clear of all liens add encumbrances, save and except taxes levied and assessed or to be levied and assessed in the year 1986, subject to the standar~ exceptions in the title insurance policies insured covering real property in Ada County. Buyer covenants to commit no waste on said premises. and to permit no waste by others on said premises and to permit no mechanic's' or other liens to encumber said property, except non-delipquent taxes and assessments. Any improvements placed on said property by Buyer shall become a part of the realty and shall at all times remain on said property. It ~s hereby agreed that title to said above described property shall be transferred to and vested in Buyer, as of .the date of the agreement first above written and Se].ller shall, and they do Hereby covenant to execute a Warranty De~d transferring title to~euyer on the date of closing of this tranlsaction. Buyer 1 shall, and they. do hereby covenant to do so, issue and deliver to the Sellers a Promissory Note in the sum of 519,750.00 at 78 interest which shall be due in full on January 2, 1987. It is agreed that Buyers shall have the right to possession i of the property herein sold on or before the date ,first above written Band so long thereafter as they comply with the terms of this agreement. Buyers shall have the right to remove the buildings located on the premises at any time after the above down payment of S19,750.00 is made and this agreement is executed. Buyers, during the duration. of this contract, shall keep the premises insured for fire and liability. Time is agreed to be of the essence of this agreement, and 'O 80.147 .~rO~In, IOMq, 6.1M4 i in the event the Buyers shall fail or refuse to make any of the payment s, of any kind or nature which they have hereinbefore contractj~d to make, at the time and in the manner herein provided, or to pay before delinquency taxes and; assessments, or I commit waste, or permit any waste by others on s~id premises, or fail to comply with the covenants in this agreem~nt containd, or permit any mechanic's or other liens to attach to said property, • except ion-delinquent taxes and assessments, then Seller shall have the option to declare this contract at an end or declare the .entire b~lance or principal and interest immediately due and payable, and if it so elects to declare this contract at an end or the balance due and payable it shall first give Buyer thirty (30) days written notice of the matters in regard to which th?y are in default, and during the said thirty l30) days they shall have the right to remedy such default. Such notice shall be given in writing, prepared by Seller or its agents and delivered to Buyer. Such service shall be by personal service or by mailing to said Buy r or their assigns, by Certified Mail addressed to their last kno n address, and if the Buyer fails to remedy said default within s~id period of thirty (30) days from ~-he date of mailing said notice, then they shall forfeit all right It hey may have to said premises and Sellers may institute foreclosure proceedings on this agreement as if it were a mortgage or• the Sellers may institute collection proceedings on the promissory note.
