Therefore, we respectfully request a temporary variance to allow the project a temporary, right-in-right-out access to Eagle Road. The access will be removed when permanent access is available to E. River Valley Road. If granted, this variance request will relieve an undue hardship that is caused by the characteristics of the site. The ultimate access will be via E. River Valley Road, adjacent to the project's south boundary. Due to the characteristics of the site and the existing alignment of River Valley Road at the west side of Eagle Road, the required right-of-way is entirely on the adjacent property south of the subject parcel. As such, the land is not available to construct the roadway. The owner has attempted to negotiate with the adjacent owner (CenterCal), but it appears the right-of-way will not be available in a reasonable time frame. Bach Builders desires to commence with their construction in August, 2011. Right-in-right-out approaches are standard practice for private approaches to Eagle Road.
