Big Al's Bowling & Sports Bar'C`~R - ' J CERTIFICATE OF ZONING COMPLIANCE REPORT T DATE: July 26,2011 E I~1,~N/~ TO: Kirkwood and Kirkwood 1 ' A O FROM: Sonya Wafters SUBJECT: Big Al's Bowling & Sports Bar -CZC-11-027; DES-11-016 OWNER: CenterCal Properties, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Kirkwood and Kirkwood, requests Certificate of Zoning Compliance (CZC) approval fora 65,661 square foot (s.f.) indoor entertainment/recreation facility and restaurant on approximately 5.7 acres in a C-G zoning district within the Meridian Town Center development. The proposed use will consist of a bowling alley with 42 bowling lanes (30 traditional style family lanes & 12 lounge-style lanes), an arcade, restaurant and sports bar. The restaurant/sports bar area will consist of a 5,000 s.f. seating area for 275 people with a 3,000 s.f. kitchen service area. There will also be 1,550 s.f. of private party rooms; a 7,000 s.f. arcade; a 3,300 s.f. lounge/arcade area; and a 1,700 s.f. office area. An outdoor plaza is also proposed that features an outdoor seating area, bocce ball court, fire pits, shade trees and planter pots. Design review is also requested for approval of the proposed site design and structure. The site is generally located on the north east corner of N. Eagle Road and E. Fairview Avenue at 1900 N. Eagle Road. DECISION The applicant's request for CZC is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide two sets of the final, stamped "approved" Planning Department plans. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11-3A-6B. 2. The applicant shall the all irrigation facilities as set forth in UDC 11-3A-6A. 3. All ground level mechanical equipment shall be screened to the height of the unit as viewed from the property boundary line. All rooftop mechanical equipment shall be screened as viewed from the farthest edge of the adjoining right of way (UDC 11-3A-19A.1.e} 4. .The applicant is required to comply with all ACRD and ITD conditions. The City will not sign off on any occupancy cards without first receiving AC1=ID's signature and sign-off, per requirement of the development agreement. Per requirement of the development agreement, owner/developer shall dedicate right-of--way and improve the extension of Records Road and E. River Valley Street in accord with ACHD requirements at such time as owner/developer develops the portion of the project adjacent to each road, except that owner/developer shall not be responsible for improving the extension of these roads or the utilities therein if such improvements are accomplished by or through agreement with an adjacent land owner. No certificate. of occupancy shall be issued until the road improvements are substantially completed and functional for that phase. 6. Prior to installation of any outdoor lighting on the site consisting of 1,800 lumens or more, a photometric test report shall be submitted to the Planning Department for review and approval. 7. Prior to issuance of the first Certificate of Occupancy on the overall Meridian Town Center site, CenterCal shall record a public access easement for the multi-use pathways along N. Eagle Road and submit a copy of said easement to the Planning Department. 8. Prior to issuance of the first Certificate of Occupancy on the overall Meridian Town Center site, a revised concept plan for the CenterCal development based on the design of the Big Al's site shall be submitted. The revised plan needs to include one or more north/south connections from Fairview to the north property boundary [these can be public or private roads & should provide a safe pedestrian route (i. e. a 5' wide sidewalk)]. The road should safely move traj~c throughout the site & discourage speeding through the parking areas; and, safe pedestrian routes should be shown at regular intervals within the site & extend east/west as well as north/south, per requirement of the Development Agreement. 9. Prior to issuance of the first Certificate of Occupancy on the overall Meridian Town Center site, a phasing plan for the overall site shall be submitted that establishes the timing for installation of the street buffer landscaping. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. Prior to issuance of Certificate of Occupancy, the applicant shall close the existing access to the state highway as set forth in UDC 11-3H-4. 4. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 5. The site plan prepared by The Land Group on 7/11/2011, labeled Sheet C1.01, is approved (stamped "approved" on 7!14/2011 by the City of Meridian Planning Department) with no changes. 6. The landscape plan prepared by The Land Group on 7/11/2011, labeled Sheet L1.01 & L1.50, is approved (stamped "approved" on 7/26/2011 by the City of Meridian Planning Department) with no changes. 7. The elevations prepared by Scott Edwards Architecture on 6/17/2011, labeled Sheets A5.01, A5.02, & A8.03, are approved (stamped "approved" on 7/14/2011 by the City of Meridian Planning Department) with no changes. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 9. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 10. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 11. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 12. Prior to Certificate of Occupancy, CenterCal Properties, LLC shall record a public access easement for the multi-use pathways along N. Eagle Road and submit copy of said easement to the Planning Department, per requirement of CZC-11-021. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The subject property adjoins a state highway (SH 55/Eagle Rd.); access to the state facility is restricted as set forth in UDC 11-3H-4B. 3. The subject property adjoins a state highway (SH SSBagle Rd.); the only approved access to the state highway was approved by VAR-07-017 as shown on the site plan approved with the Certificate of Zoning Compliance for the overall site (CZC-11-021). 4. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ-07-012; VAR-07-017; CZC-11-021). 5. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 6. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 9. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-2 for Arts, Entertainment or Recreation Facility, Indoors and Outdoors. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before August 10, 2011, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11- SA-6B. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIltATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The enclosed CZC application requests City review and approval specific to this area within the overall site as it has been previously approved. The Big AI's application included details specific to the building pad location, parking areas, traffic circulation, landscapes and similar elements associated with this building. The Big AI's project comprises a single structure of approximately 65,661-sf within approximately 5.7-acres of the overall Meridian Town Center site. The project is consistent with the requirements of the approved Development Agreement (MDA-11-002). The application has been prepared in response to your comments and direction during pre-application meetings, and we expect you will find it to be complete and generally as discussed. Exceptions from the normal CZC application checklist are: 1. The subject property has not been platted so no copies of recorded plats are being provided. The property is shown by Record of Survey No. 8394, which is enclosed. 2. At this time, Fire Marshall and SSC approval of the site plan has not been obtained. However, the configuration of the Big AI's site is generally consistent with the site plan as previously approved by the Fire Marshall and SSC as a part of the overall Meridian Town Center CZC. If re-approval by these agencies is required, please advise. 3. Photometrics for site lighting are not provided at this time, but will be supplied once the project electrical designer has been selected and can complete this study. Facades: Building facades visible from a public street or public space shall incorporate modulations in the facade, including, but not limited to, projections, recesses, and step backs that articulate wall planes and break up building mass. Facades shall be modulated and articulated in accord with the "City Of Meridian Design Manua/". Applicant response: Variation and modulation occur extensively along the entry facades of the Big AI's project. Although the other 2 facades are relatively plain, the use of lighting, material changes, patterns, landscaping and trellises provide the required articulation meeting the requirements of the City of Meridian Design Manual". b. Primary Entrance(s): The primary building entrance(s) shall be clearly defined by the architectural design of the building. Applicant response: Dramatic high volume entries and large roof overhangs provide strong definition to the primary entries to the Big AI's project. c. Rooflines: Roof design shall provide variations in profile through modulation andlor articulation in accord with the "City Of Meridian Design Manual'; including, but not limited to, the following: 1) overhanging eaves; 2) sloped roofs; 3) two (2) or more roof planes; 4) varying parapet heights; and 5) cornices. Applicant response: Big AI's incorporates dramatic overhanging eaves, sloped roots, multiple roof planes and varying parapet heights to provide extensive variation in roofline / parapet profile. d. Pattern Variations: Architectural building design shall not create blank wall segments along public streets andlor adjacent public spaces. Architectural elements, including, but not limited to, windows, awnings and arcades, shall have color, texture and/or materials to mitigate blank walls. Applicant response: Big AI's is a large scale bowling, entertainment, sports bar, restaurant facility which due to its bowling /sports bar function attempts Co restrict the amount of exterior lighting entering these functional areas. With this said, at major entries, extensive glazing elements are used providing drama and interest to the building. In addition, with variation in material finishes, modulation if elevation surfaces, combined with the use of spandrel glazing and lighting / trellis features minimize the amount of blank-wall segments providing l aesthetically pleasing variation when viewed from adjacent public streets or adjacent public spaces. e. Mechanical Equipment• All ground level mechanical equipment shall be screened to the height of the unit as viewed from the property line. All rooftop mechanical equipment shall be screened as viewed from the farthest edge of the adjoining right of way. Applicant response: Big AI's does not propose any ground level mechanical equipment with the exception of our transformer and generator which are located on the back side of the building (eastj. These need to be easily accessible for utility service, although we have planned dense landscaping in the area surrounding them. Please see the landlords landscape drawings for additional landscape information. All rooftop mechanical equipment is screened by roof parapet and/or roof mounted screenwalis. See roof plan and exterior elevations for additional mechanical screening information. 2 Materials a. Exterior building designs shall demonstrate the appearance and use of high quality materials, including, but not limited to, stone, brick, wood or other natural materials, tinted or textured masonry block, textured or architecturally detailed concrete panels, or stucco or stucco-like synthetic materials. Applicant Response: The majority of the Big AI's exterior fa4ade is comprised of various shades of split faced CMU with ground face accent bands and natural stone. In addition each entry has distinct expansive glass feature with dramatic overhangs. Spandrel panel window elements flank the main entry with an elaborate steel and wood canopy running the length of the building. b. Smooth faced concrete block, prefabricated steel panels, and/or vinyl are prohibited as finish materials but may be approved as accent materials in accord with the "City Of Meridian Design Manual". Applicant Response: As mentioned above, the exterior materials are primarily colored split faced CMU, natural stone, glass, storefront and wood. We have a few accents of architectural concrete and the sports bar entry plinths. We also utilize a combination of composite steel panels and corrugated steel panels as a cladding on the 2n° floor walls which are stepped back from the main facade. See the exterior elevations and color boards for additional information. c. Untextured concrete panels are prohibited as finish and/or accent materials. (Ord. 09-1394, 3-3-2009, eff. retroactive to 2-4-2009) Applicant Response: Untextured concrete panels are not proposed with this project. 3 Parking Lots a. For properties greater than two (2) acres in size, no more than fifty percent (50%) of the total off street parking area for the site shall be located between building facades and abutting streets. z Applicant Response: Big AI's is part of a larger "Meridian Town Center" development where the developer has worked with the city to plan a site which meets requirements as a whole, including parking, setbacks, lot coverage and configuration of parking in relation to the buildings and adjacent streets. We believe as a whole this project meets the requirements. b. For properties two (2) acres or less in size, a maximum of a sing/e drive aisle with parking on one or both sides shall be allowed between the building facades and abutting streets. Alt other off street parking areas shall not be located between the building facades and abutting streets. (Ord. 10-1439, 1-12-2010, eff. 1-18-2010) Applicant Response: The overall "Meridian Town Center' development is greater than (2) acres, therefore this does not apply. 4 Pedestrian Walkways a. A continuous internal pedestrian walkway that is a minimum of five feet (5) in width shall be provided from the perimeter sidewalk to the main building entrance(s) for nonresidential uses. The walkway width shall be maintained clear of any obstructions, such as vehicles, outdoor sale displays, vending machines, or temporary structures. Applicant Response: Need response from the landlords design team b. The internal pedestrian walkway sha/I be distinguished from the vehicular driving surfaces through the use of pavers, colored or scored concrete, or bricks. Applicant Response: Need response from the landlords design team c. Unobstructed walkways at least five feet (5) in width shall be provided for any aisle length that is greater than one hundred fifty (150) parking spaces or two hundred feet (200J away from the primary building entrance(s). Applicant Response: An unobstructed walkway of a 12' width is proposed thru the primary parking field in front (West) of the Big AI's primary entrance. This provides a safe and clear path for customers and pedestrians thru the main parking field. d. The walkways sha// have weather protection (including, but not limited to, an awning or arcade) within twenty feet (20) of all customer entrances. Applicant Response: The primary walkway in front (West) of Big AI's is covered with a pedestrian canopy running the entire length of the building. (Please verify no trees are within sewer/water easements) A tree has been ~/ added as requested. Other minor adjustements to tree placements were made as necessary to account for sewer/water easements. • Include details (i.e. species, planting/mature size, etc.) for the landscaping along the north 8 east sides of the building. Because of the lack of modulation in the building facades on these sides, V some screening s/b provided. Tree species and sizes are shown on the plan. • If possible, relocate the bicycle rack closer to the main building entrance, per UDC 11-3C-5C.1. As cussed, the bicycle rack has not been relocated. The proposed location is the optimum in terms of access for visitors and employees, while maintaining the architectural character and aesthetic of the building front elevation. We are working on coordinating a meeting with all parties (Park Trust, CenterCal, ACHD, City) to make sure we are all on the same page regarding Records Road construction. In the end, we will need to make sure that the full width is constructed for the full length. With the current direction of allowing CenterCal to build the ultimate road section (instead of just the interim section) on CenterCal's schedule of April 2012 (instead of this fall), we should be able to get the plans coordinated for CenterCal to build the full road width, including curb and gutter on the park side-as long as the Park Trust is covering their portion of those costs (which would be between CenterCal and the Park Trust). Note: Detached sidewalk is already being constructed along Records on the park property. Per my discussion with Pete, it is my understanding that the City will still require CenterCal to build Records per the DA. In the meeting with CenterCal that Gary Inselman attended last week at the Planning Dept., CenterCal described their desires to build the full road rather than have the Park Trust build an interim road that they would have to immediately modify and put back under construction. In the end, that seems to make the most sense right now. All parties at the table for this issue have been very cooperative and I'm confident that we can reach a solution that works for everyone. I believe that you stated that Center Cal is going to construct the full road section (sidewalk to sidewalk) for Records Road, from Fairview to River Valley. The plans that were submitted to ACHD do not include curb, gutter or sidewalk on the east side of the road. ACHD can only require half of the road improvements, similar to what was required of the Park, and if they are proposing more, that is okay. You also mentioned, per the City's comments with Kleiner Park, that the City will require Center Cal to construct Records. In reviewing the CZC report from the City I do not see any requirement related to Records and how much of the road they will be required to construct. I just wanted to make sure that you are fully aware of what has/has not been required of Center Cal. The info from the Park staff report and Records is below. Christy Records Avenue Construction At the request of the City of Meridian, staff is recommending a modification to ACHD policy by waiving the requirement that Records Avenue be partially constructed with the development of the Park Project. The City opposed the language in the original draft Staff Report that required the City to guarantee the construction of Records Avenue adjacent to the Park site in the future (Attachment #4). Specifically, the City objected to the expenditure of any taxpayer dollars for the development of Records Avenue. Originally staff recommended the following: Prior to acceptance of the Park development plans, the City of Meridian should enter into a written agreement with ACHD regarding the future construction of Records Avenue north of the Park entrance. In lieu of providing a financial surety, the City should ensure that the segment of Records Avenue north of the proposed Park Lane, will be built by others; or, that the City should construct the road at such time that Allys Avenue is extended from its current terminus to the north property line of the Park, or River Valley Drive is extended to the site from SH-55 (Eagle Road), whichever comes first. The City of Meridian opposed that condition and has proposed the following: "The City of Meridian shall require completion of Records Avenue north of the park entrance, built to ACHD standards (with the understanding that it is not at taxpayer expense) as per the existing Development Agreement on the CenterCal property." The Kleiner Park Trust shall provide the financial surety or construct the road per ACHD policy in lieu of the City commitment required above. OR 2. The City of Meridian shall amend the Development Agreement with CenterCal to require: (1) CenterCal to develop the full road section, curb, gutter on both sides, and the sidewalk on the west side only, of Records Avenue north of the park entrance; (2) the consent of ACHD before the Development Agreement could be modified to alter or eliminate the above term until such construction is complete; (3) a memorandum of the amendment or the amendment to be recorded in accordance with Section 10 of the Agreement; and (4) that the timing or phasing of the development of Records Avenue occur in accordance with ACHD Policy (that is, CenterCal shall be required to build the north section of Records Avenue when the parcel adjacent to Records Avenue is developed or, when it is warranted based on traffic generated by the phase of development being proposed). Here is a brief summary of our discussion. Because CenterCal is moving forward with the development of the Power Center on the NW quadrant of their parcels, as well as the Town Center on the southern portion, the Kleiner Memorial Park (KMP) Trust has decided to wait for CenterCal to construct Records Avenue, per the original Purchase and Sale Agreement between the parties, and will not be pursuing final design of Records Ave (park entrance to Fairview) at this time. KMP Trust will not be signing the roundabout agreement as presented by the Kleiner Family Trusts, and the KMP Trust will no longer be pursuing the interim Records Ave ROW from the Kleiner Family Trusts. It is our understanding that CenterCal is pursuing all needed ROW from the Kleiner Family Trusts. KMP Trust will not pursue a winter opening of the park, but intends to open the park in spring 2012, upon completion of the access roads which will now be constructed by CenterCal (Records Ave, from Fairview-River Valley). KMP understands that CenterCal will be constructing the entire length of Records Ave, as well as the River Valley extension and the new % mile roadway. KMP understands that CenterCal is currently going through the CZC and approval process, and no final commitments have been made at this time. The only roadways needed to open and access the park itself are Records Ave to the Park entrance, and Park Lane. KMP Trust will not seek final plan approval on Park Lane until after ACHD final approval of Records Ave design, as submitted by CenterCal. KMP Trust will pursue installation of utilities within the Park Lane ROW ahead of final plan approval, and with ACHD inspection as per ACHD requirements. Construction of these utilities is not anticipated to occur for several months. ACHD has determined to record the ROW for all the public roadways now. All dots have previously been submitted, and will now be recorded. Susan Graham will obtain the signed and notarized Inspection 7/8/2011 ~ Page 2 of 2 Agreement from the KMP Trustees. ACHD will not remove the financial surety requirement on North Records Avenue from the park's conditions of approval. However, the KMP Trust will not need to submit the surety if CenterCal constructs the roadway. Third party agreements (purchase and sale agreement) regarding cost sharing will be pursued, but ACHD is not a party to these agreements.
