Meridian VisionO er k - CERTIFICATE OF ZONING COMPLIANCE REPORT DATE: July 27, 2011 E IDIAN - TO: Andy Erstad i Q FROM: Sonya Watters, Associate City Planner SUBJECT: Meridian Vision — CZC-11-028; DES -11-017 OWNER: Kevin McElroy DESCRIPTION OF APPLICANT'S REQUEST The applicant, Andy Erstad, requests Certificate of Zoning Compliance (CZC) approval of a 2,700 square foot optometrist office (classified in the UDC as a healthcare and social service) in a C -C zoning district. Administrative design review is also requested for the design of the site and building elevations. The site is located at 50 E. Carmel Drive on the northeast corner of N. Meridian Road and E. Carmel Drive. DECISION The applicant's request for CZC is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide two sets of the final, stamped "approved" Planning Department plans. You must provide these plans in PDFformat and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B. 2. Prior to issuance of Certificate of Occupancy, the applicant shall close the existing access to the arterial roadway (N. Meridian Road) as set forth in UDC 11 -3A -3A. 3. Prior to issuance of Certificate of Occupancy, the applicant shall remove or relocate any existing structures that do not conform to setbacks and/or use in the zone. 4. The hours of operation for future businesses on the site shall be limited to the hours between 6:00 am and 10:00 pm to reduce possible adverse impacts on the residences adjacent to the site. 5. A portion of this site lies within the Meridian Floodplain Overlay District. The applicant will be required to submit a Floodplain Development Permit and secure approval before any construction can begin. Permit approval may require development of Base Flood Elevations, mapping of the floodplain and/or floodway boundaries, and analysis of the effect of the development on the floodplain. Applicant should reference City Flood Damage Prevention Code and coordinate with the Floodplain Administrator to verify requirements. Conditions Document 1 Meridian Vision CZC-11-028; DES -11-017 Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A. 4. The site plan & civil site plan prepared by Erstad Architects on July 22, 2011, labeled Sheets Al. 11 & C1.0, are approved (stamped "approved" on July 26, 2011 by the City of Meridian Planning Department) with no changes. 5. The landscape plan prepared by The Land Group on July 26, 2011, labeled Sheet L1.00, is approved (stamped "approved" on July 26, 2011 by the City of Meridian Planning Department) with no changes. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 7. The elevations prepared by Erstad Architects on July 22, 2011, labeled Sheets A3.11 & A3.12, are approved (stamped "approved" on July 26, 2011 by the City of Meridian Planning Department) with no changes. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 11. Prior to Certificate of Occupancy, the applicant shall record a public access easement for the portion of the multi -use pathway along N. Meridian Road that lies on the subject property and submit copy of said easement to the Planning Department. 12. At such time that the multi -use pathway along N. Meridian Road connects from one major street to another and is greater than one-half mile long, the applicant may petition the City to assume maintenance responsibilities. 13. Prior to Certificate of Occupancy, the applicant shall provide a cross-access/ingress- egress easement to Carmel Drive to the property to the north (Parcel No. S1106336012) and submit recorded copy of said easement to the Planning Department in accord with the provisions of UDC 11 -3A -3A2. Conditions Document 2 Meridian Vision CZC-11-028; DES -11-017 Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ -06-062; MDA -11-003). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant shall have an ongoing obligation to maintain all pathways. 6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before August 11, 2011, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 1I - 5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Cherry Lane). All four facades of the building are articulated differently in relation to both the interior uses and the exterior influences. The North fagade contains the largest amount of glazing due to the soft northern light available and to take full advantage of the views to and from the future plaza area. There will be a detailed metal trellis providing relief, detail and a nice transition to the future public plaza, and there will be a door for easy access to the outdoors. The simple gable roof steps back at the north fagade to reflect the stepping north fagade. The East fagade faces the public parking area and includes a raised gable element at the main entrance. The entry is accentuated by the largest expanse of plate height stone on the building, and is the only location where only the building corners are covered. The South fagade faces Carmel Drive, and includes a screen wall to shield the electrical panels and the small trash carts. This fagade also includes a secondary entrance door for the employees and large windows with metal sun shades. The West fagade faces busy Meridian Road, and as such is articulated differently. Windows are used sparingly and in a horizontal clerestory manner to react to the faster vehicular traffic. The West fagade also contains the only glazing that extends clear to the floor. The storefront windows project a more commercial aesthetic and allows views deep into the space from the sidewalk. The primary public entrance is located off the parking lot and facing Five Mile Creek and the nearby residential community. The roof is a simple gable which is similar in scale and size to many of the nearby homes, providing a gentle transition from the busy street. A variety of exterior materials, including stucco, stone, metal and glass, are assembled to strengthen the corners of the building and are detailed to break up the various planes into smaller sections. Numerous windows are provided on all four facades, providing natural light where allowed, and providing views to and from the nearby public spaces. The exterior colors are comprised of earth tones in stone, metal and stucco. The mechanical equipment will be small units located on the ground and screened by decorative metal screens to match the building trellis and metal flashing. Please see the attached drawings and Exterior Finish Exhibit for additional descriptions. The Site is located on the corner of the entrance to an existing community development. As such, there are large existing trees located all along the south property line that will be retained except to remove one tree from the vision triangle and to allow a new curb cut onto the subject property. All removed trees will be mitigated per Meridian standards. The site is also part of a future development of commercial buildings fronting Meridian Road. As such, there will be cross access through all of the parking lots. The parking areas will be broken into smaller parking areas addressing each small building. Primary access for vehicles is off of Carmel, and will eventually lead through the site to the north. Pedestrian access is primarily off of the enlarged 10 foot wide sidewalk along Meridian Road, as well as from the residential areas to the east. New sidewalks connect the project to the existing sidewalks along the streets. The large existing trees on the south will provide a very nice sense of maturity to the project, and will screen the project from Carmel Drive substantially. When the economy recovers, a future building is envisioned to the north and at that time the plaza between the buildings will likely be recreated. ADA COUNTY RECORDER J.
