Annexation/Zoning Applications
Project Narrative
On behalf of our clients, Janicek Properties, LLC; Fedrizzi Ten Mile, LLC; and SJJV, LLC, we
hereby apply for annexation and zoning to C -G (General Retail and Service Commercial District).
The properties are located north of Interstate 84 and west of S. Ten Mile Road. The subject parcels
are included in the 2007 Ten Mile Interchange Specific Area Plan (TMISAP). The Land Use Map
has four different designations for the Janicek property. The four include: Mixed Use Residential
(MUR — 40.70 +/- acres), Mixed Use Commercial (MUC — 30.17 +/- acres), Medium -High Density
Residential (MHDR — 2.22 +/- acres) and Park (Park — 6.80 +/- acres). The Land Use Map has
three designations on the Fedrizzi property. The three designations include: High Density
Employment (HDE — 2.14 +/- acres), Mixed Use Commercial (MUC —1.04 +/- acres) and Park
(Park —1.77 +/- acres). The Land Use Map has two designations on the SJJV property. The
designations include: High Density Employment (HDE — 28 +/- acres) and Mixed Use Commercial
(MUC — 5 +/- acres).
During the pre -application conferences with the staff concerning the proposed zoning designations,
the applicants and the staff could not come to a mutual agreement. The applicants consulted with
commercial real estate brokers and commercial developers prior to determining their zoning
designation. The commercial real estate professional's analysis, "The new Ten Mile Interchange
represents an area of intense future real estate activity. The most recently opened I-84 interchange
at Karcher Road in Nampa (2006) was a catalyst for commercial activity. Numerous shopping
centers were constructed including Treasure Valley Marketplace, Treasure Valley Crossing,
Karcher Village, Nampa Crossroads Expansion, and others. The market in this instance determined
retail commercial was the highest and best use of the land." The retail development potential at the
interchange is significant. If development is so severely restricted by arbitrary boundaries on the
TMISAP Land Use Map, the land may set idle for years. It is rare that properties are so segregated
by differing land use designations. For example, the Fedrizzi property is approximately 5 acres and
has three different land use designations. One must consider the fact that the TMISAP is a
component of the Meridian Comprehensive Plan and the documents should be considered as a
guideline.
The Ten Mile Specific Area Plan identifies a conceptual collector network on the Transportation
System Map. A primary mid -mile collector, originating on the Janicek parcel, is proposed in the
plan. The primary collector will be signalized at Ten Mile Road and will feed the interior of the
section. Other collectors are shown bisecting the Janicek property from north to south, with another
collector exiting the west boundary. Along the collectors, the transportation map delineates
intermittent rotaries. The proposed network of collector streets does not currently exist. The
interconnectivity of the collectors and the reliance on adjoining unrelated parcels to develop and
provide access to the interior of the section creates a problem. The TMISAP recognizes the
limitations and challenges to coordinating the streets. Therefore, when the opportunity arose to
coordinate the collector network, the stake holders stepped forward.
The three property owners have been working with Ada County Highway District, Idaho
Transportation Department and the City of Meridian to solve the problems associated with the
roadway network and the dependency on one property to provide access to another.
Through the condemnation process, ITD has revised their plan to include right-of-way for the east -
west collector on the Janicek parcel. Initially, ITD was going to provide substandard roadway
improvements which would not meet ACHD collector standards or the road standards as outlined in
the TMISAP. With the substandard roadway, the properties would lack a public street access and
the public monies spent for the limited improvements would not benefit the parcels. Through
meetings with ACHD, ITD, City of Meridian, Meridian 118, RWK Investments LLC/Rama Group
LLC (Baraya Subdivision), and the applicant's representatives, a cooperative plan was devised to
provide for the future development of the properties. The plan includes the following:
• Property owners will provide right-of-way easements for some of the future collectors,
thereby allowing the different properties to develop independently of others.
• ITD will transfer the condemned east -west collector right-of-way to ACHD and deposit an
estimated $280,000 in a trust fund for the construction of the primary collector. Any
property which develops first can exercise the right-of-way easements, utilize the trust fund
money for the primary collector, and build the other roadways as needed.
• A conceptual roadway network plan was developed consistent with the TMISAP
Transportation Plan delineating possible access points for the adjoining properties.
• A group annexation/rezone request would be submitted to the City of Meridian for the
properties impacted by the Ten Mile Interchange and its associated roadway improvements.
The City generously agreed to waive the annexation fees and allow submittal without a
detailed site plan. The parcels would be subject to individual development agreements
requiring submittal of detailed site plans prior to development of the individual properties.
The properties are currently zoned RUT (Rural Urban Transition) in Ada County and are in
agricultural production. The RUT zoning designation requires a minimum lot size of five acres.
All essential public services are available to the subject properties. Sewer service is available from
the existing Meridian 36 -inch trunk line located along the south boundary of the Purdam Drain.
Water service is available from a City of Meridian 12 -inch main line in S. Ten Mile Road. Ten Mile
Road has been improved to major arterial standards and the interchange is open.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
