To whom it may concern:
Idaho Power has reviewed the packet of information for the above-referenced item as provided by
Brighton Corporation, and submits this letter of comment in response.
Idaho Power Company does not object to the proposed vacation of the portion of Greenspire Drive as
described in the attached exhibit prepared by James R. Washburn, PLS.
Please consider this comment letter a written request for a copy of the recorded resolution of the Board of
Commissioners' determination on this matter, and any other instrument that would pertain to a
conveyance of the subject property, should Ada County Highway District approve the requested vacation.

VACATION DESCRIPTION
A parcel of land located in the NE 1/4 of the SW 114 of Section 22, T. 4 N., R. 1 W.,
B.M., Meridian, Ada County, Idaho, more particularly described as follows:
Commencing at the southwest corner of Lot 1, Block 5 of Jayker Subdivision -Phase 1,
as same is shown on the Plat thereof recorded in Book 101 of Plats at Page 13341 of Ada County
Records, said point being on the northerly right-of--way line of West Greenspire Drive, as shown
on the Plat of said Subdivision;
Thence South 89°26'24" West, 28.75 feet on the northerly right-of--way line of said West
Greenspire Drive and the northerly boundary line of said Jayker Subdivision -Phase 1 to a point
of curve;
Thence 70.12 feet on the arc of a curve to the left, said curve having a radius of 423.50
feet, a central angle of 09°29'11" and a chord distance of 70.04 feet which bears
South 84°41'49" West on said northerly right-of-way line and said northerly subdivision
boundary line to a paint of curve, said point being the REAL POINT OF BEGINNING;
Thence 77.36 feet on the arc of a curve to the left, said curve having a radius of 423.50
feet, a central angle of 10°28'00" and a chord distance of 77.26 feet which bears
South 74°43'08" West to a point of curve on the northerlyright-of--way line of said
West Greenspire Drive and said northerly subdivision boundary tine;
Thence 22.19 feet on the arc of a curve to the left, said curve having a radius of 15.00
feet, a central angle of 84°46'24" and a chord distance of 20.22 feet which bears
North 27°05'58" East on said northerly right-of--way line and said northerly subdivision boundary
line;
Thence North 74°43' 19" East, 50.00 feet on said northerlyright-of--way line and said
northerly subdivision boundary line to a point of curve;
Thence 22.19 feet on the arc of a curve to the left, said curve having a radius of 15.00
feet, a central angle of 84°45'59" and a chord distance of 20.22 feet which bears
South 57°39'48" East on said northerly right-of-way line and said northerly subdivision boundary
line to the real point of beginning. Said e 1 square feet more or less.

surface waters.
^7. This project shall be reviewed by the Idaho Department of Water Resources concerning well construction and
water availability.
^8. After written approval from appropriate entities are submitted, we can approve this proposal for:
^ central sewage ^ community sewage system ^ community water well
^ interim sewage ^ central water
^ individual sewage ^ individual water
^9. The following plan(s) must be submitted to and approved by the Idaho Department of Environmental Quality:

^10. Run-off is not to create a mosquito breeding problem.
^ 11. This Department would recommend deferral until high seasonal ground water can be determined if other
considerations indicate approval.
^12. If restroom facilities are to be installed, then a sewage system MUST be installed to meet Idaho State
Sewage Regulations.
^13. We will require plans be submitted for a plan review for any:
^ food establishment ^ swimming pools or spas ^ child care center
^ beverage establishment ^ grocery store

Nampa & Meridian Irrigation District has no comment on the above-referenced application as
it lies outside of our district boundaries. Please contact Nathan Draper with Settlers Irrigation
at 344-2471 or at PO Box 7571, Boise, ID 83707.
All laterals and waste ways must be protected. All municipal surface drainage must be
retained on-site. If any surface drainage leaves the site, Nampa & Meridian Irrigation District
must review drainage plans. The Developer must comply with Idaho Code 31-3805.
It is recommended that irrigation water be made available to all developments within the
Nampa & Meridian Irrigation District.
