Locust Grove Road. Alternative Compliance (ALT) is also proposed in regard to parking lot landscaping requirements contained in UDC 11-3B-8C. The site consists of 1.48 acres and is zoned C-G. Per UDC Table 11-2B-2, flex space is a principally permitted use in the C-G zoning district. The previous use approved for the site was an indoor recreation facility. Due to the high impact fees accessed with the previous use, the applicant has elected to modify the CZC and change the use to flex space in order to reduce the impact fees and obtain a building permit. The Director has agreed to reclassify the use of the building to flex space so the applicant has time to coordinate with ACRD on lowering the impact fees for the indoor recreation facility. If the indoor recreation facility is to operate from the site in the future, the applicant shall be responsible for submitting a certificate of zoning compliance verification application for the change of use in accord with UDC 11-5B-1. The issuance of the certificate of occupancy permit for the indoor recreation facility use is predicated on the applicant receiving Planning Department approval for the change of use and any applicable Building Services requirements. DECISION The applicant's request for CZC, DES and ALT are approved with the conditions listed in this report. Note: This is not a building permit. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide two sets of the final, stamped "approved" Planning Department plans. Process Conditions of Approval If the indoor recreation facility is to operate from the site in the future, the applicant shall be responsible for submitting a certificate of zoning compliance verification application for the change of use in accord with UDC 11-SB-1. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3 C. 5. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 6. The site plan prepared by Houston and Bugatsch, dated 06/16/11, labeled Sheet A1.0, is approved (stamped "approved" on 6/27/11 by the City of Meridian Planning Department) with no changes. 7. The landscape plan prepared by Ray Klinehuch, dated 6/20/11, labeled Sheet L2.0, is approved (stamped "approved" on 6/27/11 by the City of Meridian Planning Department) with no changes. 8. The elevations prepared by Houston and Bugatsch, dated 06/23/2011, labeled A3.0, are approved (stamped "approved" on 6/27/2011 by the City of Meridian Planning Department) with no changes. 9. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 10. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 11. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 12. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 13. Prior to Certificate of Occupancy, the applicant shall record across-access/ingress-egress easement to the adjoining property to the south (parcel #5901170070) and submit copy of said easement to the Planning Department in accord with the provisions of UDC 11-3A- 3A2. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (PBA-11-007). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. Conditions Document 2 Danik Flex Space Building CZC, DES & ALT REVISED 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 7. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-18. ANALYSIS OF UDC REQUIREMENTS RELATED TO THE ALTERNATIVE COMPLANCE The applicant has submitted a request for alternative compliance pertaining to the parking lot landscaping, as follows: 1. The applicant requests approval of alternative compliance to UDC 11-3B-8C.1 which requires a 5-foot wide minimum landscape buffer to be provided adjacent to parking planted with one tree per 35 linear feet and shrubs, lawn, or other vegetative groundcover. The subject area is located along the southern boundary of the site. The applicant has provided a letter from the Irrigation District (NMID) that states the required trees should not be planted within the easement. In order to comply with the parking standards of the UDC, the applicant cannot shift the layout of the site to accommodate a wider buffer to .include the trees. The applicant proposes to landscape the buffer with bushes and relocate the required trees elsewhere on the site. Staff has reviewed the applicant's request and because NMID's requirements conflict with the City's in this instance, staff approves the request in accord with UDC 11-SB-SB.2d. ALTERNATIVE COMPLIANCE FINDINGS: In order to grant approval for alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR Strict adherence is not feasible due to the NMID desire for no trees within their easement. Further, to comply with the parking standards of the UDC, the applicant cannot shift the layout of the site to accommodate a wider buffer to include the trees. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds the applicant's proposal to provide the woody shrubs and plant the trees elsewhere on the site provides an equal means for meeting the perimeter landscape requirements in the UDC. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. Staff finds that the proposed alternative will not be detrimental to the public welfare or impair the use/character of the surrounding properties since a 5-foot wide landscape buffer and required trees are still being provided on the site. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before November 16, Conditions Document 3 Danik Flex Space Building CZC, DES & ALT REVISED 2011, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The time between the two. virtual phases would allow the owner the opportunity to engage in a traffic study with the intended goal of illustrating a lower traffic count than the ACHD model would suggest, and thereby reduce the overall impact fee being assessed. It is anticipated that the final construction outcome of the project will remain the same as was originally submitted to the City's planning and building departments. The building is a total of 21,750 square feet which includes a 20,000 square foot gymnastics training facility, and 1,750 square feet of administrative, dance, and meeting space. There was a building permit application submitted and approved for this project in 2008, but several circumstances halted the project. It is now ready for re-submittal, and construction pending approval. The building itself is apre-engineered steel building structure enclosed by stucco-finish insulated wall panels (Surrey Beige). The design includes wall relief at the column lines with patter variations, hanging canopies at each entrance, metal roof (Colonial Red), and a 44" masonry wainscot around the perimeter of the building. The earth-tone colors of the building will fit in well with the proposed landscaping which includes new grass, walk paths, trees, shrubbery, and a designated spot for bicycle parking. Danik Gymnastics is working closely with the neighborhood association to ensure that the proposed building is an asset to its surroundings.
