The site consists of 1.61 acres and is currently zoned C -G. The site plan prepared by LS Construction Co., labeled Sheet Al, is approved (stamped "approved" on 5/20/2011 by the City of Meridian Planning Department) with no changes. 6. The landscape plan prepared by LS Construction Co. on 5/17/2011 labeled Sheet L1, is approved (stamped "approved" on 5/20/2011 by the City of Meridian Planning Department) with no changes. 7. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 8. The elevations prepared by LS Construction Co., labeled Sheet A3, are approved (stamped "approved" on 5/20/2011 by the City of Meridian Planning Department) with no changes. 9. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 10. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 11. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 12. Prior to Certificate of Occupancy, the applicant shall record a cross-access/ingress- egress easement to the adjoining properties to the west and submit a copy of said easement to the Planning Department in accord with the provisions of UDC 11 -3A - 3A2. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-3B-13 and UDC 11-313-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ -05-061, Development Agreement Inst. #106137048; PP -08-007; PS -08-006; FP -09-002; TE -10-032; PBA -11-005). 4. The issuance of this CZC does not release the applicant from any previous requirements of the. other permits issued for the site. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. 8. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-37. ANALYSIS OF UDC REQUIREMENTS RELATED TO SITE SPECIFIC CONDITIONS: The applicant also requests approval of alternative compliance to UDC 11-3A-19A.3.b, which requires a maximum of a single drive aisle with parking on one or both sides to be located between building facades and abutting streets; all other off-street parking areas shall not be located between the building facades and abutting streets. As an alternative means of meeting the intent of the UDC, the applicant. proposes to install two (2) additional trees and additional screening bushes within the Allys Avenue street buffer north of the driveway entrance. Staff is of the opinion installing additional trees and bushes within the street buffer adjacent to the parking area provides screening and reduces the visual impact of the parking area from Allys Avenue. Therefore, staff approves the applicant's request for alternative compliance. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before [date], within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Our Main Street operation is one of the most successful in the company and our expectations are that our new property on the corner of E. Ustick Road and N. Allys Avenue will be as well accepted. The purpose of this letter is to provide a narrative description of the decisions we have made relating to this new property as well as a discussion of how the building is expected to work, all in keeping with the intention of maximizing opportunities for the young people who work there. Please consider this letter with attachments our formal request for design review, Certificate of Zoning Compliance and Alternative Compliance for parking. We refer you to Exhibit A, attached, in order to follow our comments. Property: Lot 1, Una Mas Subdivision, comprised of 70,346 sqft of land, located in the southwest corner of the intersection of E. Ustick Road and N. Allys Avenue, Meridian, Idaho. The plat for the Una Mas Subdivision has been recorded and ownership is now processing a Boundary Line Adjustment re -aligning Tecate Lane on the south of Lot 1 and other effected lots. Tecate Lane will be a private road and be built as part of the construction of the Les Schwab Tire Center. The lot size is deceiving as the northern part of Tecate Lane, on our southern frontage, is part of our site. Additionally, the lot is made an irregular shape where Allys comes off of Ustick which has an impact on our site planning. Previous City of Meridian approvals for the Property include: AZ -05-061, PP -08- 007, PP -08-006 and a Development Agreement, instrument number 106137048. Building: 12,494 sqft, eight -bay Les Schwab Tire Center, providing sales and service of tires, wheels, brakes, batteries, shock absorbers and front end alignment and related equipment. Primarily 64 feet wide by 184 feet long, the building is made THE WEST'S LARGEST INDEPENDENT TIRE DEALER WITH OVER 420 LOCATIONS IN OREGON, WASHINGTON, IDAHO, MONTANA, CALIFORNIA, NEVADA, UTAH, AND ALASKA up of three elements: the sales and showroom, area of 4,138 sqft, the service area of 4,720 sqft and the warehouse area of 3,750 sqft. The entry area, in the north end of the east wall, is a pop -out approximately 12.6 feet by 49 feet, and the upper portion of its wall, continues around the front of the building as an architectural treatment. Similar to the entry, three false entries that pop—out from the building 8" are found on the east and west walls, providing articulation and the breaking of long untreated wall and roof line space, as well as concealment for roof -mounted equipment. The building height is 24 feet, except at the pop - outs where it is 26 feet high. Construction materials are primarily split -faced CMU with a band of scored, smooth -faced CMU; the walls at the entry and the false walls will be of a stucco finish, and awnings will be metal. The building will be painted in the Les Schwab style with the four foot high band at the bottom painted rust and the balance painted cream. All stucco finishes will be cream and the metal awnings will be rust colored. A concrete slab, 69 feet by 46 feet, will be built just south of the building and will be used for our shipping and receiving, as well as for service work on vehicles that do not fit into the service bays. The company intends that this not be a full-service facility, as we would describe the current Meridian, or the Cole Road, or the Fairview facilities where service work on large vehicles and trucks occurs. We intend, rather, that this facility concentrate on the smaller vehicles, directing the larger vehicles to the other tire centers, although we realize there will be times when service on larger vehicles will occur at this location and the site has been analyzed and designed to accommodate all sizes of vehicles. Pedestrian access is to be provided from the entry area, including a pedestrian bench, to the public sidewalk along Ustick. Two bicycle parking stalls will be placed in this area as well. Site: Lot 1, Una Mas Subdivision, is a 70,346 sqft site, including the northern one-half of Tecate Lane abutting its southern boundary. It is further bound by E. Ustick Road on the north and N. Allys Avenue on its east. "Site B" on the exhibit is the northwestern corner of the subdivision. As mentioned, our proposed building is 12,494 sqft. There are 43 parking stalls proposed, including 2 ADA stalls, which, in our experience, is ideal for our stores. As relates to UDC 11-3A-19, head -in parking in front on the service bays is not possible and the service bays nearest the sales and showroom are those most often used, thus creating the highest potential liability as a result of cars backing into other vehicles. The other bays are used for brake, shock and alignment service and create a lessened work pace, allowing parking outside the bays, albeit 30 feet distant. This does create a short scenario of three rows of parking which we propose to comply with City of Meridian standards by planting additional trees in the landscape bulge north of the Allys entry to the site. This entry has been tentatively approved by ACHD, who will review and approve that portion of our plans. The Allys entry is designed to be a right -in only access to our site and provides an ideal entry for emergency vehicles as well as for deliveries and, of course, our customers. Two other driveway approaches will be built accessing the site via Tecate Lane. Traffic circulation on our site is designed for ease of movement and safety, particularly in the area of the service bays. Our plan proposes 17,469 sqft of landscaping, (24.83% of the site). Our trash enclosure and bull pen will be constructed of the CMU block painted as the building is, with additional trees in the landscape areas to screen these facilities. -2- We make this submittal recognizing you and your staff may have questions or comments which we will look forward to assisting with.
