The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-3B-13 and UDC 11-313-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (MFP-11-001, FP -07-020, PP -06-022 and DA #108080951). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 7. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed drive-through establishment as set forth in UDC 11-4-3-11. Conditions Document 2 Rosauers CZC, DES & ALT ANALYSIS OF UDC REQUIREMENTS RELATED TO THE ALTERNATIVE COMPLANCE The applicant has submitted a request for alternative compliance pertaining to the parking lot landscaping, as follows: 1. The applicant requests approval of alternative compliance to UDC 11-313-8C.2 which requires each interior planter that serves a double row of parking spaces provide two trees and shrubs, lawn, or other vegetative groundcover. The subject area is located near the southern boundary of the site. The applicant has informed staff that the Irrigation District (NMID) will not allow three (3) required trees to be planted within the Milks Lateral easement which runs through three (3) of the proposed landscape planters located near the southern property boundary. The applicant proposes to landscape the each planter with a mixture of shrubs and ornamental grasses to compensate for the lack of the three (3) trees. Additionally, one tree will still be provided in each of the planter islands. Staff has reviewed the applicant's request and because NMID's requirements conflict with the City's in this instance, staff approves the request in accord with UDC I I-5B-5B.2d. ALTERNATIVE COMPLIANCE FINDINGS: In order to grant approval for alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR Strict adherence is not feasible due to the NMID desire to remove some of the required trees within the Milks Lateral easement. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds the applicant's proposal to provide a mixture of shrubs and ornamental grasses in lieu of the trees provides an equal means for meeting the planter island landscape requirements in the UDC. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. Staff finds that the proposed alternative will not be detrimental to the public welfare or impair the use/character of the surrounding properties since the planter islands meet the dimensional requirements of the ordinance and will be planted with one tree each and a mix of shrubs and ornamental grasses. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be fled in writing with the Planning Department on or before 07/20/2011, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. Conditions Document 3 Rosauers CZC, DES & ALT EXPIRATION Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The administrative design review shall be exercised with the approval period of the underlying permit (CZC) or the approval shall expire. Architectural Character: The proposed Rosauers store has been designed to include architectural elements and features that address the principles and objectives of the Design Manual, including the referenced section of the UDC. Refer to the colored elevation rendering and building plans included with the Design Review application for a visual representation of the items noted below. a. Facades: The main building fagade, which faces west toward Eagle Road, incorporates modulations in both plan and elevations. Portions of the wall are pulled forward and there are projected elements and recesses of varying heights to break up the overall mass of the building that will be visible from the public street. The east facade is also modulated with projected and recessed portions of the plan and varied roof lines. The north and south facades are designed to be compatible with planned attached adjacent buildings. b. Primary Public Entrance: The primary public entrance has a gabled canopy with an architectural wood truss and large stone columns to clearly define the entry as the building is viewed upon entering the project site. There is a lower wood trellis structure floating between the stone columns to add a human scale to the entry as pedestrians approach the store. c. Roof Lines: The design includes varying parapet heights and cornices with both flat and gabled roof planes for the primary roof. Secondary roof forms include projecting awnings over areas with fenestration and a wood trellis at the entry. d. Pattern Variations: In addition to the %9ade articulation noted above, architectural elements such as fenestration, awnings, varying textures and colors of both stucco finish and stone veneer, stained wood beams and trellis structures, and colored metal trim and roofing are used to mitigate the length of the walls and highlight portions of the building that parallel the public street e. Fenestration: There are windows incorporated into the different architectural elements on the west side of the building. The varying sizes and mullion patterns provide visual interest while maintaining a consistent theme across the west fagade. Rooftop equipment is screened from public view by locating the equipment away from the edges of the roof and behind the entry roof structure, increasing the height of the wall parapets and cornices, including rooftop walls in areas with concentrations of equipment. 2. Color and Materials: The color and materials proposed for this building have been shown on the colored elevation rendering included as part of the application. The colors are generally natural, neutral tones. Deeper colors are used to accent portions of the fagade and specific awning and trim areas. Clear stain is proposed for the wood beams to highlight the natural wood tones and complement the overall color scheme. Materials with intense, bright colors or highly reflective qualities — either metals or glazing — are not being used. 3. Site Plan and Buildino Layout: a. Building Location: The building is sited on an interior portion of the overall subdivision with the primary building fagade and main customer entry oriented toward Eagle Road. b. Parkina Areas: Parking is provided as part of the overall subdivision and is located in front of the project. Existing and planned buildings along Eagle and Ustick roads limit the exposure of the parking area to the road. Layout of the parking area is coordinated with the pedestrian circulation pathways through the site to the adjacent streets. c. ss: Access to this project is provided by existing primary site entrances and roadways off of both Eagle Road to the West, and Ustick Road to the North. There is an access off of Ustick Road serving a delivery roadway along the east side of the project. d. Street Layout and/or Internal Circulation: Refer to response above. The parking area has multiple internal circulation routes. e. Pedestrian Walkways and Facilities: There are existing walkways along both Eagle Road and Ustick Road. The three proposed landscape islands that are located over the existing tiled portion of the Milk lateral that crosses this development cannot meet the requirement of two trees in each island. The Milk lateral is owned and maintained by the Nampa and Meridian Irrigation District and the District does not allow their tiled laterals to be within the drip line of a mature tree. Only one (1) tree could be placed within these islands. The proposed alternative compliance is to place one (1) tree in each of the three islands with the remainder of the islands covered with low shrubs and other vegetative ground cover.
