This CZC approval is for the Southern portion of the site on one of two legal lots and will be for two attaching additions to the existing buildings. A 30x40 addition to the west of the existing south building and an attaching 28x36 addition between the existing north and south buildings. All buildings will have the same facade. Conditions of Approval: Project is subject to all current City Ordinances and conditions of approval for all applicable development permits. Site Plan: The Site Plan is approved per the plans prepared by James Gibson, Gibson Architects dated June 21, 2005 and stamped "approved" on 7-6-OS by the Meridian Planning & Zoning Department with no changes. The approved site plan is not to be altered without prior written approval of the Planning & Zoning Department. NOTE: Openings (doors, windows, etc.) and their protection shall be located and constructed to meet current building code. Landscaping A detailed Landscape Plan has not been submitted to the Meridian Planning & Zoning Department. The landscape plan is required by the Planning & Zoning Department and must be submitted for full approval with the adjoining lot or perimeter landscaping must be provided. All landscaping must comply with MCC 12-13 or alternative compliance must be requested. The applicant shall have 90 days within which to submit the full site landscape plan or bond for perimeter landscaping as required. Parking: 13 parking spaces with no designated handicapped spaces are shown, MCC 11-13-5 requires 1 space per 300 square feet of mixed retail (1:300)/warehouse/office (5072/300 = 16.9), for a total of 17 parking stalls required, the required parking shall be shown on the entire site plan • • in compliance with MCC 11-13. In accordance with MCC 11-13-5, all standard parking stalls must be constructed 9 feet by 19 feet minimum and drive aisles must be at least 25-feet wide. The project engineer/architect shall certify that the number and size of handicap- accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA. The applicant shall have 90 days within which to submit the full parking plan or bond for parking improvements as required. Irri ag tion: An underground, pressurized irrigation system must be installed to all landscape areas per the specifications provided. Protection of Existing Trees: Any existing trees on site must be protected in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per Ordinance 12-13-13-4, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection measures prior to construction. Any severely damaged tree must be replaced in compliance with Ordinance 12-13-13-6. Curbing: Per Ordinance 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Sidewalks: All sidewalks shall be constructed in accordance with the Meridian City Code requirements (MCC 12-5-2.K). Sidewalks shall be constructed prior to occupancy of the permanent building. Trash Enclosure: All dumpsters and/or carts must be screened from view and not be visible by the public or from adjacent properties. Trash enclosures must be in the location and size as approved by SSC. ACHD Acceptance: Applicant shall be responsible for meeting the requirements of ACRD as they pertain to this development. All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. No occupancy will be granted until the final plat for the property is recorded. Plan Modifications: The Site Plan and Landscape Plan, stamped 7/7/05, are not to be altered without prior written approval of the Planning & Zoning Department. This approval shall also be included with the future approval for the entire site, the submittal must be made within 90 days and comply with all landscaping and parking requirements. J p R. The application is for a zoning compliance for a furniture store on .47-acre. Existing Access The site currently has two driveway accesses on North Meridian Road. Applicant's Request The applicant has submitted the above referenced application to the City of Meridian requesting a certificate of zoning compliance to add on to the existing structures, and modify the site design to include only one access off of North Meridian Road. District Policy Driveway Location District policy 72-F4 (1) requires driveways located on arterial roadways near a signalized intersection to be located a minimum of 440-feet from the signalized intersection for afull-access driveway and a minimum of 220-feet from the signalized intersection for aright-in/right-out only driveway; however, Meridian Road is a minor arterial, and distance for a minor arterial roadway may be reduced to 315- feet. • Fairview and Meridian Roads are at a signalized intersection; as such, the applicant should be required to construct the driveway a minimum of 315-feet from the signalized intersection. The applicant is proposing a full access driveway approximately 373-feet south • Right-of--Way & Development Department Planning Review Division Page 1 of 4 • of Fairview. As proposed, the driveway should be constructed approximately 32-feet south of the north property line. Driveway Width District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles to a maximum width of 35-feet. Curb return type driveways with 15-foot radii will be required for driveways accessing collector and arterial roadways. • The applicant is proposing to construct the driveway 36-feet wide. The applicant should be required to construct a 35-foot curb return driveway with 15-foot radii and vertical curb, gutter and sidewalk consistent with adjacent improvements. Site Specific ReQuirements • Construct a 35-foot wide curb return type driveway with vertical curb, gutter and sidewalk that intersects Meridian Road approximately 373-feet south of Fairview, as proposed. Pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of the roadway and install pavement tapers with 15-foot radii abutting the existing roadway edge. The new building will be located adjacent to Cherry's Consignment Furniture (1524 Meridian Road), currently in the process of being remodeled. Both buildings will share common parking on all three lots. We would like to apply for a variance to Meridian City Code 11-13-SB; specifically 52 parking spaces are required for 15,596 square feet of building space. The lots are not large enough to accommodate the required parking spaces; we would like to reduce the required number of total spaces by 7. Based on our projections, the 45 proposed spaces will be adequate for the type of retail and office spaces we will be leasing. Furniture store 5,124 square feet @ 1 /400 = 12.85 spaces Proposed retail 5,227 square feet @ 1 /200 = 26.14 spaces Proposed office 5,227 square feet @ 1/400 = 13.07 spaces TOTAL 52 Spaces In addition to the above variance we are requesting a waiver from Meridian City Code 12-13-10- 4; specifically the 25 feet parking set back requirement from arterials. We would like to request a 6 feet set back apply to the 100 feet section of frontage bordering Meridian Road. By granting us this waiver, we will be able to relocate parking originally drawn along the Southern edge of the 1524 Meridian Road property line, there by saving two old growth trees. We would like to propose the addition of 1928 square feet of landscaping in exchange for being able to park closer to Meridian Road. See the attached drawing depicting the variance in red, and the additional landscaping in green. The green outlined area on the South edge of the property shows the location of the two old growth trees we are trying to preserve. Granting these variances will not confer on the applicant any special privilege denied to other lands, structures or buildings in the same district. Case No: VAR-OS-014 For the City Council Hearing Date of: September 6, 2005 A. Findings of Fact Hearing Facts a. A notice of a public hearing was published for two (2) consecutive weeks prior to the City Council public hearing, the first publication appearing and written notice mailed to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the property. The notice of public hearing before the City Council was posted upon the property under consideration more than one week before said hearing. All other noticing was done consistent with Idaho Code §67- 6509. The matter was duly considered by the City Council at the August 23, 2005, public hearing(s). The applicant, affected property owners, and government subdivisions providing services within the planning jurisdiction of the City of Meridian were given full opportunity to express comments and submit evidence. b. That the City has granted an order of approval in accordance with this Decision, which shall be signed by the Mayor and City Clerk and then a copy served by the Clerk upon the applicant, the Planning and Zoning Department, the Public Works Department and any affected party requesting notice. 7. That this approval is subject to the Site Plan in Exhibit A. C. Decision and Order Pursuant to the City Council's authority as provided in Meridian City Code § 12-3-5 and based upon the above and foregoing Findings of Fact which are herein adopted, it is hereby ordered that: 1. Specifically, the Ordinance lists the following Findings (MCCll-18-3), all of which must be determined before granting a variance: A. That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Title would clearly be impracticable or unreasonable; Staff finds that the subject property, as depicted, is large enough to accommodate the required open spaces and landscaping required by the ordinance, but not parking. Variances for a reduction in parking requirements have recently (in the past two years) been approved for many properties in the downtown area, including Farmers and Merchants State Bank, Aromatic Sensations, Buich Office Building and Holy Trinity Charismatic Episcopal Church. The proposed mixed use building consists of 15596 square feet of ground floor retail, 10545 of new construction and incorporation of existing buildings. Ordinance requires one (1) off-street parking space per 200 s.f. of gross floor area for retail, one (1) off-street parking space per 400 s.f. of gross floor area for office, and two (2) parking spaces for each residential unit, for a total of 52 required spaces. The proposed site plan shows 45 off-street parking stalls, 1 of which is a compact space. B. That strict compliance with the requirements of this Title would result in extraordinary hardship to the owner, subdivider or developer because of unusual topography, the nature or condition of adjacent development, other physical conditions or other conditions that make strict compliance with this Title unreasonable under the circumstances, or that the conditions and requirements of this Title will result in inhibiting the achievements or the objectives of this Title; The City has adopted goals, objectives, and policies that support mixed uses within the Old Town district. If off-street parking be strictly required for all properties in Old Town, staff believes that a majority of the properties would be restricted to a residential-only use and would not redevelop. Staff generally supports the redevelopment of the smaller, older lots in the original Meridian Township, as these conversions allow for more vibrant commercial areas. Staff Palmer.VAR Exhibit B finds that strict compliance with the City's parking requirements on this site would result in an extraordinary hardship to the developer due to the circumstances surrounding this property mentioned in the previous finding. Further, staff finds that enforcing the conditions and requirements of the off- street parking ordinance and required landscape buffer will inhibit the objectives of allowing Old Town to be a mixed use area. C. That the granting of the specified variance will not be detrimental to the public's welfare or injurious to other property in the area in which the property is situated; Staff anticipates that the variance will not be detrimental to the public's welfare or injurious to other properties in the area. Further, the Council has granted parking variances to properties with similar situations within Old Town, and staff is unaware of any harmful impacts from these parking variances. Staff recommends that the Council reference any written or oral testimony provided at the public hearing, as well as staff s analysis, when determining whether or not the surrounding properties may be negatively affected by granting a variance. D. That such variance will not have the effect of altering the interest and purpose of this Title and the Meridian Comprehensive Plan."
