The request for alternative compliance was granted per the applicants request and the director's conditions of approval dated 5/27/05. The approved plan is not to be altered without prior written approval of the Planning & Zoning Department. No field changes to site plan permitted; prior written approval of all material changes is required. Parkin : 23 parking spaces with 2 handicapped spaces are proposed, MCC11-13-5 requires 1 space `per 200 square feet of retail (1:200 (1700/200 = 9), 2 spaces per bay sq ft of automobile servicing (8) for a total of 17 parking stalls required. The parking area shall be paved and striped in accordance with MCC 11-13-4. Off-street parking is approved as shown on the approved site plan. In accordance with MCC 11-13-5, all standard parking stalls must be constructed 9 feet by 19 feet minimum and drive aisles must be at least 25-feet wide. The project engineer/architect shall certify that the number and size ofhandicap-accessible spaces i • ~; conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have. signage in accordance per ADA. Irrigation: An underground, pressurized irrigation system must~be installed to all landscape areas per the specifications provided. Protection of Existing_Trees: Any existing trees on site must be protected in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per Ordinance 12-13-13-4, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection measures prior to construction. Any severely damaged tree must be replaced in compliance with Ordinance 12-13-13-6. Curbing: Per Ordinance 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Lighting: Lighting shall not cause glare or impact the traveling public or neighboring development. Sianage: No signs are approved with this CZC. All signs will require a separate sign permit in compliance with the sign ordinance. Sidewalks: All sidewalks shall be constructed as shown on the approved Site Plan and in accordance with the Meridian City Code requirements (MCC 12-5-2.K). Sidewalks shall be constructed prior to occupancy of the permanent building. Trash Enclosure: All dumpsters and/or carts must be screened from view and not be visible by the public or from adjacent properties. Trash enclosures must be in the location and size as approved by SSC. ACHD Acceptance: Applicant shall be responsible for meeting the requirements of ACHD as they pertain to this development. All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. No occupancy will be granted until the final plat for the property is recorded. Findings. for Consideration 1. Right-of-Way , Fairview Avenue ~ I District policy requires 120-feet of right-of-way. on principal arterial roadways (Figure 72-F3). This ~ ~ right-of-way allows for the construction of a 7-lane roadway with curb, gutter, 5-foot concrete detached sidewalks and bike lanes. a • There is approximately 60 to 62-feet of right-of-way existing abutting the site. No additional right=of-way is required to be dedicated with this application. ~ 2. Driveways Location District policy 72-F5, requires driveways located on collector or arterial roadways with a speed limit of ~ ! 35 to align or offset a minimum of 150-feet from any existing or proposed driveway. • ( The existing driveway is located on the southwest property line, approximately 70-feef, from ~~ - the east property line. The existing driveway aligns with the driveway to the south, at Landin's, ~ ' ,` Auto Sales. This driveway location meets District policy and should be approved with this application. '; 9 Width District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles to a maximum width of 36-feet. Curb return type driveways with minimum 15-foot radii will be required ~ for driveways accessing collector and arterial roadways. l • The proposed driveway is approximately a 30-foot curb-return type driveway. The property falls within the City of Meridian C-G, general retail and service commercial zoning district. The ordinance calls fora 25' landscape buffer on the East, West and South sides of the building in order to change the use of this existing site. However, at this time, we are asking you to consider allowing us to eliminate the landscape buffer on the West Side of the building. We are proposing a landscaped area along the South and East Side of the property. The ordinance requires a strip of landscape area on the West portion of the property. On a 35-year-old building, this portion of the property was already asphalted when purchased by Mr. Pahner. The asphalt would have to be dug up and hauled away and a portion of the existing asphalt would need to be dug up in order to pipe the irrigation to that area, which would then need to be re-asphalted, compacted and re-sealed. If required to remove the "asphalt along the West Side of the building we would eliminate the much-needed space required to fulfill our parking requirements. Additionally, the West Side of the property is next to a large bin of tires stored by Big O Tires. Despite the presence of any landscaping this area is an "eye sore" which would be difficult, at best, to camouflage and hardly seems worth the landscaping expense in light of the view that exists. As you may or may not already be aware, no landscaping exists on the Big O Tire property. This is also the case of the building across from the property, Rocky Mountain Collision located at 225 E. Fairview and at Jiffy Lube located at 360 E. Fairview. As it relates to your proposal, I am specifically concerned-that: 1. The layout includes one parking stall that would not safely accommodate people turning off of Fairview Avenue; 2. The minimum standards for landscaping require a five foot perimeter buffer around commercial projects; 3. The location and number of parking stalls along the western boundary would hinder pedestrian access to the front yard with rear parking being proposed; and 4. Parking along the northern property line would interfere with the 24-foot required drive aisle. Generally when we receive a request for alternative compliance we also receive some indication of what the applicant proposes as an alternative to the standard requirements. Your proposal includes no such considerations for additional landscaping or screening. The intent of the alternative compliance section is to encourage creative solutions to land use problems. The City recognizes that the specific requirements .of the landscape ordinance cannot and do not anticipate all possible landscape situations. In addition the City recognizes that there may be landscape proposals which conform to the purpose, intent, and objectives of the landscape regulations but were not anticipated in the specific regulations. However, we believe the subject property can be redeveloped in a manner consistent with current standards. City Staff finds the following conditions exist on the subject property: 1. The applicant shall be required to remove any obstructions within 10' of the fire hydrant outlets. 3. We have reviewed the conditions that you have outlined for approval of the alternative compliance and agree to the following: 1. We will provide the 5-foot perimeter landscaping along the northwestern property boundary. 2. We will reduce the front parking by one stall, per your request and will provide 16 feet of landscaping and curbing as a street buffer to Fairview. The following is a list of changes that we would like you to consider: 1. The 21-foot swing gate is flush with the existing gate when opened. We have purchased a special lock as required by the fire department, which would allow access in the case of a fire. We ask that you allow us to keep the swing gate attached for the security purpose of the mechanic. We agree to leave the gate open during business hours to allow for access to the reaz parking. 2. We ask that the trailer facility remain intact to be used as an office space for my husband's retail painting business. 3. The mechanic will occupy three service bays which requires a total of 6 parking spaces. For retail purposes, we will provide 9 stalls. We will provide 2 additional pazking stalls for the painting business for a total of 17 regular pazking stalls. The 4`~ "service" bay parking garage will be used as parking for myself.
