Comments:
Conditions of Approval: Project is subject to all current City of Meridian ordinances and conditions
of approval for the Stow -It project. The issuance of this permit does not release the applicant from
any previous requirements of AZ -04-013, CUP -04-017 and RP -04-002 (or any other permits issued
for this site). The hours of operation of the storage facility shall be contained between 6:00 a.m. and
10:00 p.m. on all days. All building construction within this phase shall substantially comply with the
elevations prepared by Moore Design Associates on 5-5-04 "and the elevations submitted with this
CZC application.
Site Plan:. The site plan prepared by Bailey Engineering, Inc., labeled C-2, dated 4-25-05, and
stamped 6-9-05 "approved" by the Meridian Planning & Zoning Department, is approved with no
changes. The site plan is not to be altered without prior written approval of the Planning & Zoning
Department. NOTE: The "areas' shown for future development and not a part of project on the
submitted site plan shall be maintained free of combustible vegetation (weeds). The five internal
storage buildings, and the retail/office buildings along Overland and Stoddard are not approved for
construction with this CZC.
Landscayin—%z: The submitted landscape plan prepared by Moore Design Associates, labeled Sheet L-
1, dated 7-30-04 and stamped "approved" on 6-9-05 by the Meridian Planning & Zoning Department
is approved with the following change: 1) The City Council approved lawn not hydroseed for the
landscape areas. All grass areas shall be improved with sod and not hydroseed. Other than the above-
mentioned change, the approved landscape plan is not to be altered without prior written approval of
the Planning & Zoning Department. No field changes to the landscape plan permitted; prior written
approval of all material changes is required. NOTE 1: Landscaping materials on the west side of
the site shall be coordinated with the adjacent property owner. No trees within this area shall
have a mature height greater than 25 -feet. NOTE 2: MCC 12-13-7-4 requires at least 5
different types of tree species to be used on this site; trees shall lie planted accordingly.

Irri ation: An underground, pressurized irrigation system must be installed to all landscape areas per a a
the approved specifications and in accordance with MCC 12-13-8 and MCC 9-1-28,
Curbing: Per MCC 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other
vehicle use areas, must be protected by curbing, wheel stops,. or other approved protective
devices. Curbing may be cut to allow for storm water runoff.
Parking_ The project engineer/architect shall certify that the number and size of handicap -accessible
spaces conforms to the Americans with Disabilities Act (ADA). The applicant shall be responsible for
meeting the.requirements of ACHD as they pertain to this development.
Sidewalks: All sidewalks shall be constructed as submitted and in accordance with MCC 12-5-2.K.
Sidewalks shall be constructed prior to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully
vegetated, and shall be designed in compliance with the MCC.
Li tin : Lighting shall not cause glare or impact the traveling public or neighboring development.
Down -shield all lighting so it does not spill.onto adjacent properties.
Signage: Except for directional signs, no signs are approved with this CZC. All business signs require
a separate sign permit in compliance with the sign ordinance.
Trash Enclosure: The applicant is not proposing any dumpsters on this site. Any future dumpster(s)
must be screened in accordance with MCC 11-12-1.0 and built in the location approved by SSC.
Handicap -Accessibility: The structures, site improvements and parking must be in compliance with
all federal handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If
any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan
shall be submitted to the City of Meridian Planning & Zoning staff for approval prior to the issuance
of a building permit.
Certificate of Occupancy: Prior to occupancy, all improvements required by CUP -04-017,
including but not limited to: landscaping adjacent to Overland Road and Stoddard Road,
right-of-way dedication and sidewalk construction along Overland Road and Stoddard Road,
fire hydrant and water main installation (as required by the Public Works Department and/or
the Meridian Fire Department), tiling irrigation ditches/laterals, pressurized irrigation
installation, and all other applicable public improvements required by MCC 12-5-2 shall be
completed. Prior to occupancy the applicant shall either post a surety with the City or
construct the fountain/amenity approved with CUP -04-017. A Temporary Certificate of
Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash
in the amount of 110% of the cost of the remaining improvements. A bid must accompany any
request for Temporary Occupancy.
Plan Modifications: The approved Site and Landscape Plans, stamped "approved" on 6-9-05 are not
to be altered without prior written approval of the Planning & Zonin Department. No significant
field changes to the site or landscape plans are peed; prior ' e approval of all changes is
required.

THIS AGREEMENT made at.Boise. Idaho this 10th day of August 2005, by an between VENGA VENTURES LLC
hereinafter referred.to as the Owner, and AQUATICS SPRINKLER AND LANDSCAPE ah -independent Contractor
in fact, hereinafter referred to as the Subcontractor. We bind ourselves, our heirs, executors, administrators,
successors, and assign jointly and severally firmly by these presents.
WITNESSETH: That for and in consideration of the covenants -herein contained, the Owner and the Subcontractor
agree as follows:
I. SCOPE OF WORK l
That THE WORK TO BE PERFORMED BY THE Subcontractor under the terms of this agreement 0.
consists of the following: ;
Provide "all labor, material, equipment, supervision and incidentals necessary to install and warrant
for One (1) year irrigation and landscaping as specified in the Moore Design Associates Drawing L-1 dated +
07/30/04.
The subcontractor agrees to be bound by the terms of the construction regulations,general and
s special conditions, plans and specifications, and all other contract documents, if any there be, insofar as
applicable to this contract agreement and to that portion of the work herein described to be performed by "
the Subcontractor.
2. INSURANCE k
Prior to commencement of work, the Subcontractor "shall provide the Owner with certificates of
insurance with limits of $2,000,000 aggregate, $1,000,000 per. occurrence, automobile insurance with limits
of $1,000,000 combined property damage and bodily injury, and worker's•compensation insurance
approved by all states in which the work is to be performed. (See additional insurance requirements in
article 7, attachment "A" and Exhibit "B''.)`

3. Payments r
The owner agreesto pay the Subcontractor in accordance with contractor bid proposal dated -July s
27, 2005 (attached as Exhibit "D"), for the satisfactory completion of the herein described work the sum of
',**Forty One Thousand Nine Hundred Three Dollars and 50/100 ($41,903.50)` in monthly payments of k
95% of the work performed in any preceding month, in accordance with estimates prepared by the
Subcontractor and as approved by the Owner or Owner's Representative. Approval and payment of
Subcontractor's Monthly estimate is specifically agreed to not'constitute or imply acceptance by the Owner t
of any portion of the Subcontractor's work.
Final payment shall be due when the work described in this contract is fully completed and
performed in accordance.w.ith the contract documents and is satisfactory to any applicable City County or
_State agencies and Owner or Owner's Representative
Before issuance of the final payment the Subcontractor, if required, shall submit evidence
satisfactory to the`Owner that all payrolls, bills for material and equipment, and all known indebtness
connected with the subcontractor's work has been satisfied.
This article 3. PAYMENTS is continue_ d on attachment "A" and hereby -made a part of this contract.

All landscape areas regulated by the City Landscape Ordinance (12-13) shall be served with an
automatic underground irrigation system. Additional requirements affecting pressurized
irrigation systems can be found in City Ordinance 9-1-28.
Irrigation Water Sdiirce A
Use of non-potable irrigation water is required when determined to be available by the City
Public Works Department as regulated by City Ordinance 9-1-28. If city potable water is used, a
separate water meter is recommended so the owner can avoid paying'sewer fees for irrigation
water. Potable water shall not be used as a primary irrigation water source on non-residential
lots with more than '/2 acre of landscaping. Year. round water availability is also required by
connecting to city potable water or an on-site well as a secondary source.
