The issuance of this permit does not release the applicant from any requirements of Meridian City Code. Si a e: No signs are approved with this CZC. All signs will require a separate sign permit in compliance with the sign ordinance. Site Plan: The Site Plan is approved per Sheet A 1.1 (dated 3/7/05, by ZGA Architects), stamped "approved" on 5/6/05, and per the 8 '/2 x 11" plan. The site plan is not to be altered without prior written approval of the Planning and Zoning Department. No field changes to the site plan are. perntted; prior written approval of all'change§ is required. Landscape Plan: The Landscape Plan is approved per Sheet LS-1 (dated 3/7/05,- by Harvest Design, Inc.), stamped "approved" on 5/6/05, and per the 8 'h x 11" plan, with-the following changes: l~.) The `Sunburst' Honeylocust trees along Eagle Road are not an approved tree species for street buffer plantings. MCC 12-13-7-2 states: "Prohibited Plant Material: The plants listed under "Trees not permitted for Right-of--Way Property Planting" [page 49 of Tree Selection Guide by Boise Parks and Rec.] are prohibited from being planted along any street or within any parkmg lot regulated by this ordinance...." The applicant shall substitute an appropriate tree species and notify the Planning and Zoning Department prior to planting. 2.) MCC 12-13-10-6 requires that "All-required landscape street buffers shall be planted with trees and shrubs, lawn, or other vegetative gloundcover, with a minimum density of one (1) tree per thirty-five (35) linear feet. The applicant shall provide two (2) additional trees within the required street buffer in order to meet this requirement. 3.) The pathway on the southern portion of the project is located over a City of Meridian water line. The Meridian Public Works Department does not allow large landscape plantings (trees) within ten feet (10') of centerline of a water main. The applicant shall not plant the three (3) Chanticleer Pear trees shown on the Landscape Plan on the western most portion of the path. Please coordinate with the Meridian Public Works Department on appropriate plantings for the landscape areas adjacent to ~' f ~' i -- • • • the walkway and to identify any other trees which a`re too close to the water line. The landscape plan is not to be altered, except for required changes noted above, without prior written approval of the Planning and Zoning Department. No field changes to the landscape plan permitted; prior written approval of all material changes is required. Parking_ The pazking area shall be paved and striped in accordance with MCC 11-13-4.Projectengineer/architect shall certify that the number and size of handicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA. Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the specifications provided. Drainage: Storm water drainage swales shall not have a slope steeper than 3: I, shall be fully vegetated, and shall be designed in compliance with the MCC. Protection of Existing Trees: Any existing trees on site must be protected in accordance with the Tree Preservation section of the Ciry's Landscape Ordinance. Per Ordinance 12-13-13-4, coordinate with the Parks Department Arborist (Ekoy Huff, 888-3579) for approval of,protection measures prior to construction. Any severely damaged tree must be replaced in compliance with Ordinance 12-13-13-6. Curbing: Per Ordinance 12-13-7-9, all landscape areas adjacent to driveways, pazking lots, or other vehicle use azeas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Handic~-Accessibility: The structure, site improvements and pazking must be in compliance with all federal handicap-accessibility requirements. Li tin :Lighting shall not cause glare or impact the traveling public or neighboring developmenrt. Down-shield all lighting so it does not spill onto adjacent properties. Sidewalks: All sidewalks shall be constructed as shown on the approved Site Plan and in accordance with the Meridian City Code requirements (MCC 12-5-2.K). Sidewalks shall be constructed prior to occupancy of the permanent building. , Trash Enclosure: All dumpsters and/or carts must be screened from view and not be visible by the public or from adjacent properties. Trash enclosures must be in the location and size as approved by SSC. ACHD Acceptance: Applicant shall be responsible for meeting the requirements of ACRD as they pertain to this development. All impact fees, if ar~y, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACRD requirements; a new site plan shall be submitted to the City of Meridian Planning and Zoning staff for approval prior to the issuance of a building permit. Certificate of Occu~aney: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. No occupancy will be granted until the fmal plat for the property is recorded. Plan Modifications: The approved Site Plan and Landscape Plan, stamped 5/6/05, are not to be altered without prior written approval of the Planning & Zoning Department.
