Cherry Lane: In summary, I will grant your request for alternative compliance. As a condition of approval for the Kinetico Quality Systems rezone application (RZ-04-018), you requested a width reduction of the required land use buffer (M.C.C. 12-13-12) which separate's your proposed retail development from the less intense residential use to the north. More specifically, you propose a 6-foot landscape buffer along the north property line which incorporates an existing 6-foot tall stained cedar fence and miscellaneous plantings. The intent of the alternative compliance section is to encourage creative solutions to land use problems. The City recognizes that the specif c requirements of the landscape ordinance cannot and do not anticipate all possible landscape situations. In addition, the City recognizes that there may be landscape proposals which conform to the purpose, intent, and objectives, of the landscape ordinance, but were not anticipated in the specific regulations. City Staff finds that the following conditions exist on the subject property: 1) the site involves space limitations or an unusually shaped lot. The location of the existing building to be converted to required land-use buffer to the north impossible. The site on Cherry Ln. currently has a brick residential building on it containing approximately 3,200 sq. ft. of living area with a 437 sq. ft. attached garage. The ground level is slightly Larger than the basement with an approximate split of 1,700 sq. ft. 9 upstairs. and a 1,500 sq. ft. downstairs. Our plan is to utilize the gazage to store our primary Kinetico equipment and use not more than two of the down stairs bedrooms for -- small parts storage, approximately 400 to 450 sq. ft. The upstairs will be office and display area and the remainder of the downstairs will be used for office supply storage, and the large existing family room downstairs will be used for staff meeting. Our daily traffic from customers is far less than the average dentist office with no more than 10 to 15 vehicle visits in a day. Most of our employees are office or outside sales that come into the office for their detail paper work and phone work; this includes five of our current eight employees. Only three are not in the office and they are typically off site from early in the morning until late in the afternoon.
