Thank you for your email. I realize that you directed your concerns to Councilman Bird, however, I have
received a briefing from Anna Canning and thought I would share what I have learned.
Ms. Canning told me that you have accurately portrayed the situation. She shared that the gravel pit use
is noisy, and there was a statement at the hearing that they would be using strobe back up alarms. The
latter statement was made in the context of nighttime hours of operation, but the way it was said led many
to believe that the equipment being used on the site would not have back up alarms. Our Planning
Department called in the applicant to discuss the back up alarms and told them they needed to use the
non-audible alarms. Ms. Canning commented that they learned much about OSHA requirements and
back up alarms at that meeting and found that it boils down to the fact that they must use back up alarms
for safety reasons. The applicant filed a Director level modification to their conditional use permit to clarify
the back up alarm issue. Our Director denied the modification request last week. They have until
Thursday to file the City Council review (appeal). If they file for the review, the Council most likely would
hear the item on June 7tn
I understand that many of the neighbors came to the Planning Commission hearing regarding this
application. After the action by the Commission, there was an opportunity for the neighbors to seek City
Council review of that decision but nothing was received. If the applicant files for City Council review of
the Director's denial, the Council would have the opportunity to hear from the neighbors at that time. The
question in front of the Council would not be whether or not the gravel pit should operate; it would be
specific to the denied modification request.
I hope this information helps. I appreciate the information you have shared and understand your
concerns. I will make sure your letter is part of the public record. Ms. Canning will let you know if we
receive a request from the applicant for a Council review.

Keith we have some serious concerns with the special use permit to allow a gravel mine in a residential
area. The first concern is the amount of noise that this operation creates. The use of rock crushers„
bulldozers loaders and trucks all using backup alarms have is causing an almost unbearable amount of
noise. This noise is effecting a lot of homes just south of this project. I know Meridian does not have a
noise ordinance during the day but the noise is so loud that sometimes you have to shout to have a
conversation in your own yard. This goes on 8 to 9 hours a day. In their application for this permit
Idaho Sand and Gravel stated they would not be using backup alarms. Your planning and zoning staff
have made them aware of this failure to comply. They can have spotter on site to replace the backup
alarms. The second area of concern is the large mountain of sand that will cause pollution from dust ,
fugitive dust and other pollutant caused by this operation. I know that DEQ has some concerns about
this and find it hard to believe that project of this nature was approved so close to a active residential
area. I t has been a wet spring so we have not felt the full effect of the blowing dust and pollutants.
However as it warm up this will become a bigger problem. The prevailing wind is from the MW which
will blow these pollutant right over and into our homes. This will not make for a very enjoyable
summer outdoors not to mention the effect on people with breathing problems. The third area of
concern is a safety factor for the children and the pets in our area. There are no fences around this
mining operation to keep children and pets out of the pit and away from all this equipment. The
original development plan called for a six foot high fence between Aspen cove and the project.
However they are not required to put up this fence until the first building permit is issued. I have been
told that will probably not happen until they finish the mining project. They more than likely think they
cannot sell homes with this ugly sand mountain and all the negative issues. This bring s me to the final
concern of property values. With this huge mountain of sand and pollution it will have a very negative
effect on our property values. We had one home owner that sold their home and this was a serious
concern to the buyer, And the project was just starting at that time. If the rock crusher had been
working and that ugly pile of sand pollution had been there it may have stopped the sale.As you can
see we have some serious concerns and not everyone that is effected was notified because their
property was not within 300 ft. of the project. I think the prudent thing to do is to have the city council
and the mayor visit this site to see the results of the previous decision. After the visit I would hope the
council would see fit to have another meeting and get more input from a lot of unhappy home owner. I
would like for you to know that your planning and zoning staff has been very helpful in this matter.
Everyone is concerned about the safety on the project and rightfully so,but I would like to see the same
concern or more for the 35 to 40 homes and families that live next to MINING OPERATION. Keith I

Thank you for your response. I also appreciate your comments about our Planning Department and your
experience with them; I will pass those comments along. It might be easier for us to call you to explain
than exchange emails; however, I will try and address your question. Council did not take action on this
particular item as our code allows the Planning and Zoning Commission to make the decision on
Conditional Use Permits. The P&Z Commission approved this application. Neighbors do have an
opportunity within 15 days after the written decision is issued to ask for City Council review, but did not do
so. So at this point the only option for the Council to hear this issue is if the applicant asks for Council
review of the Director's denial on the noise issue as I explained in my response.
In answer to your example regarding the Precious Metals Ordinance as a `revisited' decision is very
different. Council had not taken final action on the ordinance and was still in the public comment
process. Therefore, when they delayed action on this ordinance it was on the basis of needing more
feedback. As the southridge gravel issue was decided by the Planning and Zoning Commission, the City
Council would have only heard the issue if there was a request for City Council review within the time
frame allowed. If you would like, I can certainly have someone follow up with you to better explain this
process.

Thank you for your response as I stated earlier we have worked with the planning dept. and they were
very helpful. How do we get the council to re visit this issue? I know recently you revisited an issue
with people selling gold after it had passed council decision. I only ask that the council come out to the
site to see the product of your decision and then consider re visiting this issue. I am sure that nothing is
cast in stone and if the decision is causing problems with the health and welfare of a lot of people I

I am writing to express my concerns about the ongoing gravel crushing and excavation
project off of Overland and Ten Mile roads. My husband and I live in the Aspen Cove
subdivision and are being greatly impacted by the project.
After reviewing the minutes of the last Planning Commission meeting at which the permits
were issued allowing work to commence, I noticed numerous discrepancies between what was
said, and what is actually being done.
First, Commissioner O'Brien asked Mr. Demsmer if he had conducted any neighborhood
meetings to address concerns. While Mr. Demsmer answered that he had held such meetings,
no such gathering was ever conducted or even proposed for the Aspen Cove neighborhood; an
area which is being directly impacted on a daily basis by the operation. Had we had the
opportunity to offer comments, I'm sure the residents in the neighborhood would have had
lenty to say.
econd, Commissioner Rohm specifically asked about back-up beepers used on the trucks. In
response, company officials repeated said that Idaho Sand and Gravel does not use back-up
beepers, and instead depend on rear-view cameras in their trucks. Neighbors had been
assured that they would not be plagued by the incessant noise from the beepers, but that
has not been the case. Since the project started, the beepers have been in use.

Finally, it has been said that the new Ten Mile interchange is the gateway to Meridian,
but what are we really saying by greeting visitors with a massive, unsightly mountain of
industrial rock and dirt? This monstrosity has greatly impacted the lives of all the
residents living in the area due to not only noise, but constant traffic. We feel we were
~ot taken into consideration when the project was approved.
~Ihile I know that the first phase of the gravel project has already been approved for an
18-month term, I would strongly request that the commission not allow any work to exceed
that time frame, and that any request to extend the use period be denied.
While I will not be able to attend the Tuesday, June 7 commission meeting to testify in
person, I would like to give my three-minutes of time to my neighbor, and head of the
Aspen Cove Homeowners' Association, Keith Ebeling.

Ryan Reynolds, Idaho Sand & Gravel, 941-1831 cell or 465-4028. I've been in contact with him this week about
that very issue...:o} We are meeting with him tomorrow morning to try to come to some resolution to the beeper
issue. He did send me an email a little bit ago saying they were turning down the volume level on the beepers in
hopes it would help; let me know if it does or doesn't help or if it's just as disturbing.
When I spoke with him on Monday (after a complaint from a neighbor} I suggested they have aperson on-site to
signs! when it is safe to backup (as allowed by Osha 1926,601(b)(4}rather than using the beepers which they
stated at the hearing #heir trucks didn't even have. He didn't feel that option provided enough safety.,.

It is no big deal forme, I'm at work, It's mare of an issue for the kids sleeping in and neighbors at home
during the day.
I understood they can use lights instead of beepers -why would they say no beepers in the hearing if
that is not what was intended! {That's rhetorical so you don't need to reply ~ ~

Ryan Reynolds, Idaho Sand & Gravel, 941-1831 cell or 465-4028. I've been in contact with him this week
,•~ about that very issue...:o} We are meeting with him tomorrow morning to try to come to some resolution
to the beeper issue. He did send me an email a little bit ago saying they were turning down the volume
level on the beepers in hopes it would help; let me know if it does or doesn't help or if it's just as
disturbing.

When I spoke with him on Monday (after a complaint from a neighbor) I suggested they have aperson on-site to
signal when it is safe to backup (as allowed by Osha 192fi,fi01(b}(4} rather than using the beepers which they
r'~`'` stated at the hearing their trucks didn't even have. He didn't feel that option provided enough safety,.,
