The Applicant, Brighton Investments, LLC, has submitted an application requesting approval to
vacate a portion of the residential lots platted with Jayker Subdivision No. 1 and the associated the
public utility, irrigation, drainage easements and the common driveway easements/public utility
easements (CDE). New easements are to be established with the re-platting of the property. A new
final plat is scheduled in conjunction with the proposed vacation application.
II. STAFF RECOMMENDATION
Staff recommends approval of the subject application.

IV. APPLICATION AND PROPERTY FACTS
A. Site Address/Location:
The site is located on the north side of Chinden Boulevard; east of N. Tree Farm Way in the
southeast '/a of Section 2, Township 4 North, Range 1 West.

V. PROCESS FACTS
A. The subject application is a request to vacate platted lots and associated easements. Per Meridian
City Code, a public hearing is required before the City Council on this matter. The UDC does not
require the site be posted with a public hearing notice sign.

VL LAND USE
A. Existing Land Use(s): The subject property is currently vacant residential property and is zoned
R-15.
B. Character of Surrounding Area and Adjacent Land Use and Zoning: A vast majority of the
surrounding properties are either platted residential lots or used for agricultural purposes, zoned
R-8, R-15, L-O, C-N and RUT in Ada County.
C. History of Previous Actions:
• In 2006, the subject property was annexed as the Tree Farm (AZ-06-004 and AZ-06-050) and
was granted approval with R-2, R-8, R-15, C-N and C-C zoning districts.
• The Jayker Subdivision preliminary plat (PP-06-058) was approved by Council on March 13,
2007. The preliminary plat consists of 277 residential lots, 1 commercial lot and 27 common
lots on 142.97 acres.
• The City Council approved the final plat (FP-07-026) for the first phase on October 26, 2007
for 140 residential lots and 21 common lots on 89.70 acres.
• On December 18, 2009, an 1$-month administrative time extension (TE-09-022) was granted
to obtain City Engineer's signature on a final plat for phase two of the plat. As a condition of
the time extension, the current DA is to be amended to include building elevations.
• In 2010, a development agreement modification (MDA-10-004) was approved that approved
building elevations and a new concept plan that included a tennis facility as an amenity
within a common lot contingent on the platting of the property.
• In 2010, City Council approved the Spurwing Greens preliminary plat (PF-10-001). The plat
consists 214 residential lots and 16 common lots on 86.66 acres.
D. Utilities:
1. Public Works:
a. Location of sewer: Currently installed to each lot.
b. Issues or concerns: With the vacation of any easement, the applicant will be required to
remove any service that is currently installed and that will not be utilized with this
project. This cost will be the responsibility of the applicant. The applicant shall
coordinate with the Public Works Department for details regarding abandonment
procedures.
VII. AGENCY COMMENTS MEETING
No comments were received by the Planning Department from other City departments for the
subject application. Please see the public record for the VAC file for any written comments that
may have been submitted by other agencies.
VIII. ANALYSIS
Analysis Leading to Staff Recommendation:
The applicant is requesting approval to vacate thirty-nine (39) platted residential lots and two (2)
common lots recorded with Jayker Subdivision No.l. In addition, the associated public utility,
irrigation, drainage easements and common driveway easements/public utility easements (CDE)
are proposed for vacation, as shown in Exhibit A.2. The affected lots include Lots 1 and 8-15,

Block 15; Lots 1-32, Block 16 and Lot 1, Block 17.
The applicant has redesigned the subject portion of the Jayker Subdivision. In order to move
forward with the new final plat, the applicant must vacate this portion of the recorded plat and the
associated easements. The new final plat is conditioned to provide the new easements where
necessary. The applicant has provided the necessary documentation from the applicable utility
providers for relinquishment of said utility easements.
The new plat design has also facilitated the relocation of some of the existing sewer lines. The
applicant has been coordinated with the Public Works Department for the relocation of these
services and has provided an Exhibit (see Exhibit A.3) depicting the proposed changes. The final
plat has been conditioned to comply with the submitted sewer service plan. The applicant should
coordinate with Public Works Department regarding the utility relocations.
Since new easements will be established with the new plat, sewer lines are to be re-routed and
service providers have no objections to the vacation, Staff recommends vacating the lots and
easements as proposed in Exhibit A.2.
