LAl~sr tAl~p L[C@iSBD IN T6NNBSS~ RE: City Council Review of Director's Decision: Letter of Intent Dear Mayor and City Council Members: I would like to submit this narrative letter of intent on behalf of my client Idaho Sand and Gravel Company regarding its application for a modification to Conditional Use Permit CUP-10-015 ("CUP"). We respectfully request City Council review of Director Canning's initial denial of our requested modification of the conditional use permit issued in the case. This is a focused and limited application for a modification of the CUP. The application for modification relates solely to back up alarms and specifically requests that the City add further language or a condition noting that audible back up alarms may be used during regular business hours as approved in the CUP and that lighted back up alarms may be used for operations conducted during approved regulaz or extended hours of operation which occur while it is dark in accordance with applicable OSHA and MSHA regulations. The language we request to be added reads as follows: `"The Applicant's equipment may utilize audible back up alarms during regular hours of operation in accordance with applicable OSHA and/or MSHA requirements. The Applicant may utilize visual backup alarms during approved extended or night time hours of operation in accordance with applicable OSHA and/or MSHA requirements." Our references to visual back up alarms in the previous application and corresponding submittals before the planning and zoning hearing applied to Idaho Sand and Gravel's request for extended hours of operation. Regulaz daylight operations utilize a loader equipped with a standazd audible back up alarm. All of our equipment has audible back up alarms; however, typical day to day operations will only require a single City of Meridian ~ • 5/12/11 Page-2 loader to supply the gravel trucks removing material from the site. The Applicant minimizes the use of audible back up alarms by gravel trucks through a site design in which the trucks travel in a loop so that they are moving forward and generally have no need to use the audible backup alarms. Any effort to prohibit the use of audible back up alarms affects the Applicant's operations under the conditional use permit. OSHA and MSHA require the use of audible back alarms during daylight hours and only allow visual back up alarms on equipment used after dark. MSHA permits the use of a person acting as signaler; however, use of a signaler is both impractical and presents a safety hazard for the regular operations conducted under this CUP. Placing an individual behind the loader that is regularly moving between the truck and stock pile presents a significant safety concern. Use of a signaler is more typical for the infrequent or isolated backing of a piece of equipment. Practically speaking it is difficult and hazardous for the individual to move and keep pace with the loader as it moves back and forth from the truck being loaded to the stock pile of material. Lastly, adding another full time employee to the operations on this site makes removing material under this CUP cost prohibitive. Removal of gravel from this site under the CUP accomplishes something that the developer will need to do in the future as part of the approved residential development of this site. The current amount and density of residential development in the area is low and waiting until sometime in the future when additional growth and development in the area has occurred further increases the potential for complaints. Removing material from the site is beneficial in that it provides a source for material to supply local public and private projects reducing the potential cost on a public projects and reducing the impacts to the transportation system as a whole. The Applicant's operations for removal of material are limited by the specified hours of operation and operational design thus limiting the impact of audible back up alarms on the surrounding area. The typical day to day use of audible backup alarms on the site is limited. The conditional use permit is limited in duration with said duration being a very short period relative to typical gravel operations. Use of an audible backup alarm during daylight business hours is appropriate for this operation and the area. It is important to note that use of an audible backup alarm in accordance with OSHA and MSHA requirements does not violate the city's noise ordinance and is granted a specific exception. Other gravel operations and heavy construction activities have occurred in this area and the limited scope and duration of our use is well within the character of the area and of those previous operations and will not cause an unreasonable negative impact to the area. Additionally, we consider the written findings of Facts, Conclusions of Law, and Decision and Order to be clear in that they do not contain a condition requiring the applicant to use visual back up alarms instead of the standard audible alarms. This application is submitted in an effort to work with and cooperate with the City of Meridian and does not constitute a waiver of any rights or defenses the Applicant may have or claim under the existing CUP.
