Lytle BuildingCERTIFICATE OF ZONING COMPLIANCE REPORT— 1 DATE: April 27, 2011 TO: Lytle Signs, Inc.E IDIAN� -- FROM: Bill Parsons, Associate City Planner IDAHO SUBJECT: Lytle Building (CZC-11-013) OWNER: RELM, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Lytle Signs, Inc., requests Certificate of Zoning Compliance (CZC) approval to allow three uses on the developed property. In 1996, the site was developed with a 2,100 square foot building (Building #1) and a 9,381 square foot building (Building #2). Building # 1 is currently vacant and building #2 is operating with the manufacturing use (light industry) on the site. This use is to remain operating in Building #2. The owner wishes to lease out a 1,000 square foot tenant space (located within Building 2) for a proposed vehicle repair facility and incorporate a 510 square foot display area for vehicle sales. In order to process the tenant improvement, the applicant has requested CZC approval for all three (3) uses because a CZC has never been processed or approved for any use on the site. No changes are proposed to the exterior of the property except for the vehicle display area. At this time, building # 1 will be used for accessory office for the associated manufacturing use, vehicle repair and vehicle sales. Per the UDC, office is an accessory use provided it is incidental and subordinate to the principal use. Stand alone office use is prohibited in the I -L zoning district. NOTE: If a new principal use is proposed for the Building#1 than a new CZC is required for a change of use. The site consists of 1 acre of land and is currently zoned I -L (Light Industrial). The proposed uses are classified in the Unified Development Code (UDC) as light industry, vehicle repair, minor and vehicle sales which are principally permitted uses in the I -L zoning district and are subject to specific use standards outlined in UDC 11-4-3-25, UDC 11-4-3-37, and UDC -11-4-3-38. The site is located at 2070 E. Commercial Street. DECISION The applicant's request for CZC is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide two sets of the final, stamped "approved" Planning Department plans. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. Conditions Document 1 Lytle Building CZC 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. 3. The site plan prepared by Lytle Signs attached as Exhibit B is approved (stamped "approved" on April 27, 2011 by the City of Meridian Planning Department) with no changes. 4. The landscape plan prepared by Lytle Signs attached as Exhibit C, is approved (stamped "approved" on April 27, 2011 by the City of Meridian Planning Department) with no changes. 5. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 6. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 7. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 8. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances. 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 1I - 3A -3. 7. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed uses as set forth in UDC 11-4-3-25, UDC 11-4-3-37 and UDC -11-4-3- 38. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before May 12, 2011, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 1I - 5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. Conditions Document 2 Lytle Building CZC EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. This lot was previously developed in 1996 so the buildings, parking area, and landscaping are all existing, with no proposed changes on the exterior of the property at this time. The front building (building 1) is office space and we are proposing no change to that space. The majority of building 2 will remain as is except for the front east corner where the proposed KKM Motorsports will be located. KKM Motorsports is an aftermarket bolt -on automotive retail business. It will occupy 1000 sq ft of building space with their own entrance. This business will be able to install rims, tires, lift kits, car stereos, as well as other minor automotive accessories. There will be no engine building or welding allowed in this area.
