Dear Mr. Handke,
In June of this year we received applications and fees for 6 temporary Certificates of
Zoning Compliance for firework stands, produce stands and Christmas tree lots for the
following addresses:
585 S. Meridian Road, 20 E. Fairview Avenue, 375 E. Fairview Avenue, 301 W. Cherry Lane,
535 N. Eagle Road and 97 S. Main Road.
These were not issued or approved because we needed the specific, seasonal dates for the
types of uses of requested. A period of one (1) year had been requested, -but the City of
Meridian Unified Development Code has specific time limits for firework stands, produce
stands and Christmas tree lots.
Dates for fireworks sales must comply with Idaho Code 39-2606 (UDC 11-3E-5). Pumpkin
and Christmas tree sales are limited to time period of two (2) consecutive months and other
produce sales are limited to four (4) consecutive months (UDC 11-3E-8).
If you would please provide us with the specific dates for the Christmas Tree Lot sales and
any other temporary sales you plan to have up until June 2007, we can finish processing the
temporary Certificates of Zoning Compliance and issue them to you.
These temaorarv Certificates of Zoning Compliance will only be good until June 27, 2007.
You will need to aooly for new temporary Certificates of Zoning Compliance for future uses
after that time.

The applicant had requested approval for five temporary CZC's. The proposed
temporary uses included fireworks stands, produce stands, & Christmas tree lots. The
temporary CZC's were. not issued and were not approved, because the applicant did not
provide the specific dates for the temporary uses. The dates requested were for an
entire year June 23, 2006 -June 27, 2007. UDC 11-3E-4A2 requires seasonal stands
or events specify a beginning and e.nd date. Staff attempted to contact the applicant on
three separate occasions and staffs calls were not returned. Also, staff contacted the
Clerk's office to see if they had any contact with Mr. Handke and made their office
aware he hadn't received approval (specifically for fireworks). Once staff receives the
specific dates from the applicant the CZC's may be approved and issued.
