As part of this application, ITD respectfully requests that the City Council consider modifying or deleting DA item 5.11. As currently written, this item would relieve the Developer of the requirement to construct off-site road improvements on Eagle Road if such improvements cannot be reimbursed pursuant to the STARS legislation. ITD is working with the Developer and ACRD to identify improvements to surrounding roadways necessary to mitigate traffic impacts from the proposed development. Both transportation agencies are working with the Developer towards a possible STARS agreement, which would allow reimbursement of eligible transportation expenses from future sales tax collections. At this time, ITD anticipates that an agreement will be reached. Should those efforts fail to result in an agreement acceptable to all parties; the Developer still should construct all the road improvements needed to mitigate traffic impacts to background operational levels. It is likely with a development of this size that the package of mitigation measures will include off-site road improvements. There are several recent examples of developers constructing or committing to construct off-site improvements to mitigate their development impacts. Changes to the Meridian Town Center layout since ITD issued a decision in July 2001 have prompted ITD to reconsider the decision regarding access to the site and in February, ITD revised the decision to consider signalization of the'/. mile access to the development. Further, ITD plans to install medians on Eagle Road as part of the 2013 pavement rehabilitation project. The current approved access to the project at the'/. mile location is the proposed U-turn break of the ITD-constructed median. The access will operate as a single lane, unsignalized left-in. A copy of ITD's February 2, 2011 letter revising the access decision is attached. It should be noted that a permit allowing the approaches from Eagle Road has not been issued to date and the developer has appealed ITD's decision to deny the''/e mile signal request. Capitol Blvd, Suite 301 Boise, Idaho 83702 RE: Meridian Town Center Access Permit Application #03-09-061 Dear Mr. Ringert: On July 1, 2009, the Idaho Transportation Department (ITD) issued a letter that served as the record of decision of the Chief Engineer for the above referenced permit application. Periodic updates for the Meridian Town Center project (also known as the CenterCal project) have been provided to Brent Jennings of ITD's Office of Highway Safety and Wade Christiansen and Pam Golden from District 3. During the time that has passed, there have been notable changes to the proposed site layout. tTD understands that the changes were made to accommodate changing and challenging market conditions. The northern half of the site is currently proposed to have a typical strip mall style with several large box stores while less dramatic changes were made to the southern half of the site. The'/-mile drive circuitous aisle was replaced with a straight roadway connecting Eagle Road to Records Avenue. The new site layout is similar to existing development elsewhere on Eagle Road. Additionally, in 2010, District 3 decided to add the installation of medians on Eagle Road to Project A(012(044), Key 12044, the upcoming pavement resurfacing project currently programmed in FY 2013. While it is not possible to realize all of the improvements identified in the 2005 Eagle Road Infrastructure Improvements Concept Report, the locations of median breaks will reflect those locations previously identified in that plan. The plan provided for consistency in turning movements along Eagle Road. As stated in the July 2009 letter, River Valley was identified as a future signal location and the %4 mile location was contemplated as a median break for U-turns. Because the Meridian Town Center site layout is now similar to existing Eagle Road development, District 3 will install the medians as part of the 2013 project with the same access layout as will be provided elsewhere along Eagle Road. The % mile access to the project is located at the proposed U-turn break and will be allowed to operate as a single lane, unsignalized left-in.
