The applicant shall be responsible for ensuring that ACHD requirements/restrictions are met in regards to the location and construction of the pool as it pertains to said easement. The Planning and Zoning Administrator has determined that the intent of the term "non-buildable" on the plat was to maintain the lot as open space and prevent residential structures, not to prevent subdivision amenities such as the one proposed. Therefore, staff finds that the proposed use is allowed under MCC and the conditions approval for Tuscany Village No. 1 Subdivision. Si na e: No signs are approved with this CZC. All signs will require a separate sign permit in compliance with the sign ordinance. Site Plan: The Site Plan is approved per Sheets 2.21 and 2.22 (dated 4/08/05, by The Land Group, Inc.), stamped approved on 4/13/05, and per the 8 `/2 x 11" site plan. Landscape Plan: The Landscape Plan is approved per Sheets 2.51 and 2.52 (dated 4/08/05, by The Land Group, Inc.), stamped approved on 4/13/05, and per the 8 '/~ x 11" landscape plan. ~ ~ Parkin: The parking area shall be paved and striped in accordance with MCC 11-13-4. Project engineer/architect shall certify that the number and size of handicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA. Irri ag tion: An underground, pressurized irrigation system must be installed to all landscape areas per the specifications provided. Protection of Existin Trees: Any existing trees on site must be protected in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per Ordinance 12-13-13-4, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection measures prior to construction. Any severely damaged tree must be replaced in compliance with Ordinance 12-13-13-6. Sidewalks: All sidewalks shall be constructed as shown on the approved Site Plan and in accordance with the Meridian City Code requirements (MCC 12-5-2.K). Sidewalks shall be constructed prior to occupancy of the permanent building. Curbing: Per Ordinance 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Lighting: Lighting shall not cause glare or impact the traveling public or neighboring development. Trash Removal: The trash removal plan has been discussed and approved by SSC. A 95-gallon upgraded waste removal trashcan will be used at the site, and will be taken to the street weekly through the direction of the homeowners association. This is an acceptable solution to trash removal which does not require additional written approval. ACHD Acceptance: Applicant shall be responsible for meeting the requirements of ACHD as they pertain to this development. All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. Ste. 202 Meridian, ID 83642 RE: Usage of Pool Structures (Tuscany Village #1 a Tuscany Subdivision) Attn: Planning and Zoning Review Department Tuscany Development Inc. is submitting this application for the approval of a community pool in the Tuscany Subdivision. The pool will be constructed in a common lot area and will be an amenity for the homeowners in the community. The community pool will also benefit the City of Meridian alleviating some traffic that would travel to the public pools This letter is to inform the Planning and Zoning department at Meridian City about the uses of this structure. The pool site will be used for leisure and swimming recreation. Parking is available according to the Meridian City off street parking code we recognize that the distance to the pool from the parking area on this particular pool structure is more than the normal allowed distance set forth by the city for standard parking facilities. We would like to request a wavier on proximity to the pool due to the fact that the Tuscany subdivision will have multiple other pools with parking immediately adjacent to the pool areas. Any person with the need to have parking immediately next to a swimming facility would be able to use the approved pool located in Messina Village #2 and a future pool, which will be located in Messina Hills #3. Although we are requesting the wavier for the distance from our parking lot location to the pool area~wheelchair and other handicap access is still available to the Tuscany Village #1 pool via the handicap accessible sidewalk on S Murlo Ave to the pool area locations. The trash removal plan has been discussed and approved by SSC the waste management company serving the Tuscany Subdivision. A 95-gallon (toater), which is the common, upgraded waste removal trashcan used for home sites will be used at the pool site. This trash bin will be taken to the street on a weekly basis through the direction of the homeowners association. I have contacted (SSC) and this is an acceptable solution to trash removal, which does not require and additional written approval. Other subdivisions with pools use this same method, which is approved by (SSC). Tuscany Development Inc will be directing and supervising the installation of all the pool structures. The construction will be done in accordance with all the building provisions set forth by the Building Department when approved by the Planning and Zoning Department. It has been determined that the Right-of-Way and Development Services Department does not have any site specific requirements for you at this time due to the fact that: • This application is for a swimming pool within Tuscany Village No. 1 and will generate no additional vehicle trips per day (VTD). If the site plan or use should change in the future, ACRD will review the site plan and may require improvements to the transportation system at that time. You will need to submit final plans to the ACRD Development Review Department prior to receiving final approval. A traffic impact fee may be assessed by ACRD and will be due prior to the issuance of a building permit.
