Irri ag tion: An underground, pressurized irrigation system is required for in all landscaped areas. Trash Enclosure: Any dumpsters must be screened from view and not be visible by the public or from adjacent properties. Handicap-Accessibility: The structure, site improvements and parking must be in compliance with all federal handicap-accessibility requirements. ACRD Acceptance: Applicant shall be responsible for meeting the requirements of ACHD as they pertain to this development. The 5100 sf building includes two classrooms of 1000 sf, designed for two classes each per day (morning and afternoon) of up to 18 children each. -Each classroom will have two teachers. Each classroom has a children's toilet and storage room accessed directly from the classroom. Each classroom includes access directly to the fenced exterior play area south of the building. Each classroom includes a double handwashing sink with bubbler outside the toilet room. The main circulation space includes additional width to accommodate exhibits of student work and connects the front entrance (north) through to the play area (south). All spaces except those accessed directly from the classrooms and the mechanical room (which is accessed from the exterior) are accessed from this space. The facility includes a kitchen for the serving of breakfast and lunch. The kitchen is equipped with a grease hood and dishwashing hood. There is a 1000 gal. grease interceptor downstream of the kitchen which is located in the trash area access drive. The trash area is directly outside the exterior kitchen door and will house a 3 yard dumpster as well as a recycling area. The trash area is on the west side of the building and has a paved access drive separated from the main entrance drive on the east. The trash area is screened from the street. The facility includes two offices, one to serve the teachers and one to serve the Family Advocates who spend most of their time outside the facility. There is also a workroom, janitor's closet and telecommunications closet. The facility includes a dividable 400 sf conference room which will serve families and staff and can also be used for community meetings. The conference room is located on a separate hallway with a door to secure the rest of the facility when the conference room is in use after hours. One of the two adult toilet rooms is accessible from this hallway for use by users of the conference room. In addition to the play area there is a lighted and paved parking area with turnaround along the east side of the site. Parking for 10 cars includes one accessible space. The front entrance is protected by a covered porch as are all other entrances. Irri~axion Water Source Use of non-potable irrigation water is required when determined to be available by the City Public Works Department as regulated by City Ordinance ~ 1-28. If city potable water is used, a separate waxer meter is recommended so the owner can avoid paying sewer fees for irrigation water. Includes, but not limited to furnishing and installing sprinkler system complete with accessories necessary for proper function. B. Coordinate head location with plant material. Irrigation heads to take priority over plant material. C. Coordinate all irrigation work with existing utilities and respective trades. 1.2 GUARANTEE: A. All components of installed sprinkler system shall be guaranteed for one (1) year from date of acceptance by Owner. B. Fill and repair depressions and replacing plantings due to settlement of irrigation trenches. C. Any repair or replacement of the sprinkler system during the guarantee period shall be without any additional cost to the owner. 1.3 QUALITY ASSURANCE: A. Work and materials shall be in accordance with the latest rules, regulations, and other applicable state and local laws. Nothing in the Contract Documents is to be construed to permit work not conforming to these codes. Contractor shall obtain anal pay for any and all permits and fees required for this work. B. Perform work with personnel experienced in the work required in this section under the direction of a skilled foreman. C. Contractor shall furnish all components, labor, tools, and equipment as necessary for the proper execution and completion of all irrigation work. D. During construction, protect materials from damage and prolonged exposure to sunlight. 1.4 SUBSTITUTIONS: A. Any requested substitutions shall be in writing, submitted to the Owner, giving reason for substitution and specifications of requested substituted product which meet or exceed specified one. 1.5 SUBMITTALS: A. Prepare an accurate record drawing, as installation proceeds, to be submitted prior to final inspection. Record drawings to show, by dimension, all components. B. Final payment for sprinkler system will not be authorized until accurate and complete record drawings are submitted. • 1.6 MAINTENANCE: A. Submit manufacturer's operation and maintenance manuals, to include manufacturer's parts catalog, for each head type, valves, backflow prevention device, and controller. B. Provide operation and maintenance instruction to the Owner for proper operation, maintenance, and length of watering time each valve is required to be open for proper watering of area covered throughout the watering season. C. At the beginning of the first winter -drain, blow out, and make any required adjustments to the system, to insure complete winterization. 1.7 EXTRA STOCK: A Provide owner with the following extra stock items; 1. One valve key for shut-off and drain valves. 2. One valve marker keys. 3. One head of each type. PART 2 PRODUCTS 2.1 MATERIALS: A. Pipe and pipe fittings; 1. Pipe for pressure lines (mainlines) shall be Schedule 40 PVC. Pipe for lateral lines shall be Class 200 PVC. Pipe for drip zones shall be minimum 100 PSI Polyethylene (PE). Pipe shall be continuously and permanently marked with manufacturer's name, size, weight, type, and working pressure. 2. Fittings shall be Schedule 40 PVC. 3. Sleeving shall be Class 200 PVC. B. Sprinkler heads and nozzles: 1. Small Lawn Areas; Rainbird 1804 heads with Rainbird 1800 series nozzles. 2. Large Lawn Area; Hunter PGP heads or Hunter I-20 heads. 3. All heads shall include a triple swing assembly. Horizontal nipple (parallel to side of lateral lines) shall be a minimum of 6" long. All other nipples on swing assembly shall be of length required for proper installation of heads. A minimum of 12" (maximum of 18") of Swing Riser Pipe and Swing Riser Fittings shall be on all pop-up spray heads. 4. Shrub Areas; Netafim tubing, .9 GPH/12" Dripperline. C. Valves: 1. Circuit valves; Weathermatic 11000 series, sized as not to lose more than 4 PSI through valve. 2. Manual shut-off valves; brass gate, size same as mainline, non-rising stem. Place in 6" PVC class 200 sleeve (length as required to be flush with finish grade) with valve box and cover. 3. Manual drain valves; brass, 1/2" gate or ball. Place in 2" PVC class 200 sleeve (length as required to be flush with finish grade) with locking valve marker. Underground, Irrigation System 02813-2 D. Filter: 1. Netafim Disk Filter; 100 mesh screen, size as required for manufacturer's recommendation. E. Controller: 1. Irritrol "Total Control", station number as required. 2. Control wire shall be OF-UL listed annealed copper conductor direct burial. Minimum size; 14 gauge. Control wire placed next to mainline, provide a 10"-12" expansion coil at 100' intervals and at corners. Splices at valves shall be with UL listed waterproof wire connectors. No splices shall be permitted between valve boxes and controller. F. Backflow Preventer: 1. Wilkins Reduced Pressure Principle, 975XL Series, size to not exceed 7.5 FPS through valve, provide with galvanized steel nipples and fittings from manual shut-off valve to beginning of PVC mainline. Provide blowout fitting and plug. PART 3 EXECUTION 3.1 PREPARATION: A. Design system for available PSI and GPM, size mainline pipe so as not to exceed 5 FPS. Route piping to avoid plants and structures and perpendicular to slopes. Review layout requirements with existing utilities and respective trades. Lawn areas and shrub zones shall not be mixes on the same circuit. Gear heads and pop-up heads shall not be on same zones. All shrub planting beds shall be irrigated with Netafim tubing. Northern and eastern exposed areas shall not be on the same zones as southern and western exposed areas. B. Coordinate location of sleeves, under paving, with existing utilities and respective trades. C. Space all heads so as not to exceed 90% of manufacturer's performance charts maximum spacing. Space Netafim tubing in parallel lines not more than 24" apart. 3.2 PERFORMANCE: A. Trenching and backfilling (PVC pipe): 1. Over-excavate trenches 2" and bring back to proper depth by filling with sand or fine, rock free soils. Do not cut roots on existing plants larger than 2". 2. Cover pipe with 2" sand or fine, rock free soil. 3. Backfill remaining portion of trench with rock free excavated trenching material and compact to 90%. B. Grades and Draining: 1. Install manual drain valves on each end of main line. Provide 1 cu. ft. drain rock below each drain valve. Underground Irrigation System 02813-3 2. Slope pipe under paving and walks to drain outside these areas. C. Pipe Installation: 1. Install pipe in a manner to provide for expansion and contraction as recommended by the manufacturer. 2. Install mainline with a minimum of 18" of cover and lateral lines with a minimum of 12" of cover based on finish grade. 3. Install sleeves under walks and/or paved areas with a minimum of 18" of cover based on finish grade of base material. Extend all sleeves a minimum of 6" beyond walks, curbs, and/or paving. 4. Cut pipe square and remove burrs at cut ends prior to installation. Make solvent weld joints per manufacturer's recommendations. Do not use an excessive amount of solvent to cause an obstruction to form inside the pipe. 5. Use Teflon tape on all threaded connections. Apply per manufacturer's recommendations. D. Heads: 1. Locate pop-up sprinkler heads no closer than 2" from walk or back of curbs in lawn areas. 2. Flush all lines prior to installation of heads. 3. Set all heads perpendicular to and flush with finish grade. 4. Install Netafim tubing 4" below surface of planting beds, after completion of planting and fine grading. Pin with 6" wire pins at a maximum of 3" O.C. Install so all tubing is looped, space lines at 24" O.C. with PVC headers, and provide drain/flush valves at ends of tubing zones. Provide air relief valve at high point(s) of zones. E. Control valves and Controller: 1. Controller: Wall mounted, install per manufacturer's's recommendations. Location per Owner's requirements. 2. Install control valves in Ametek or Brook plastic valve boxes, size as required for easy access and maintenance. Provide snap top plastic covers. Top of valve box to be flush with finish grade and place 1/2 cu. ft. of drain rock in boxes below valves. Install filter on Netafim tubing zone(s) per manufacturer's recommendation. 3. Install backflow prevention device per manufacturer's recommendations and local regulations. Locate valve in shrub bed. 4. Provide 1 extra control wire to each end of mainline. 3.3 FIELD TEST: A. Prior to backfilling, fill mainline with water and pressure test to 100 PSI. Mainline shall not lose more than 15 PSI in 15 minutes. Pressure test to be approved by Owner or Owner's representative. B. Perform water coverage test by irrigation industry approved method to insure uniform precipitation rate. Perform coverage test for each type of lateral circuit, i.e. one each for lawn rotors, lawn pop-ups. Coverage test to be approved by Owner or Owner's representative. 3.4 ADJUSTMENTS: Underground Irrigation System 02813-4 A. Adjust all heads to be flush and perpendicular with finish grade. Adjust all heads and or nozzles for distance and arc per field conditions and so water does not spray on any building, parts of buildings, walks, or paving. 3.5 CLEAN UP: A. Immediately clean up and properly dispose of off site any debris created from sprinkler installation operation. Roadway Improvements Adjacent To and Near the Site Broadway Avenue has 2-travel lanes with no curb, gutter or sidewalk abutting the site. There is sidewalk to the east of the site ranging in various widths. 8 Existing Right-of-Way Broadway Avenue has 80-feet of existing right-of-way (40-feet from centerline). 4th Street is not extended on the south side of Broadway Avenue. ACHD's arc-view (GIS) program indicates that the District has 15-feet of right-of-way connecting Broadway Avenue on the north and extending approximately 310-feet to the south that boarders the Union Pacific Railroad. There are no roadway improvements in the right-of-way. The District has no plans to extend a road to the south of the site. (The District vacated the west side of the unopened right-of-way to the parcel to the west of the proposed development site approximately 30 years ago.) 2 • 9. Existing Access to the Site The proposed development site has two driveways. • Driveway # 1 is located approximately 5 to 10-feet into the unopened right-of-way to the west of the site. • Driveway # 2 is located approximately 61-feet east of the west property line. 10. Site History The ACRD Commission reviewed and approved MCUP-03-037 on November 26, 2002. As a condition of approval the applicant was required to vacate or improve the unopened right-of-way adjacent to the site. The applicant was proposing to construct a building over the right-of-way which would require the right-of-way to be vacated. The applicant has revised the site plan and the building is proposed to be located outside of the right- of-way. 11. Five Year Work Program This location is not programmed into the District's current Five-Year Work Program (FY 03-07) for reconstruction or any roadway improvements B. .Findings for Consideration Right-of-Way/Curb, Gutter and Sidewalks District policy requires 54-feet of right-of-way on industrial/commercial roadways (Figure 72-F1 B). This right-of-way allows for the construction of a 3-lane roadway with curb, gutter and a 5-foot wide detached concrete sidewalks. There is 80-feet of existing right-of--way on Broadway Avenue (40-feet from centerline) the applicant should not be required to dedicate any additional right-of-way. The site plan indicates the applicant is proposing to construct curb, gutter and detached sidewalk with a planter strip. There is sufficient right-of-way for the required improvements. There is unopened right-of--way (4~h Street) abutting the western boundary of the site approximately 15-feet in width and approximately 310-feet in length. There are no roadway improvements in the right-of--way. The District has no plans to extend a road to the south of the site. In accordance with District policy, the applicant should be required to improve the unopened right-of--way or vacate. ACRD Commission Action on April 9, 2003 The applicant requested a waiver of policy relating to the vacation of the unopened right-of-way, based on financial reasons and time constraints. The Commission required the applicant to vacate the right-of-way, but delayed the time for application. The Commission granted the applicant a license agreement for landscaping in the right-of-way, for six months, with the condition that the applicant apply for vacation of the right-of-way within that six months. Further, the Commission waived the $600 application fee for the vacation, and agreed to a 5-year payment plan. The applicant should enter into a development agreement with the District outlining the conditions of the payment plan. 2. Street Sections District policy 7202.8 and 72-Fi B, requires roadways abutting commercial developments to be constructed as a 40-foot street section with curb, gutter and 5-foot concrete sidewalk within 54-feet of right-of-way. 3 This street section should be constructed on Broadway Avenue. 3. Driveways District policy F2-F4 (1) and 72-F4 (2), requires driveways located on commercial/industrial roadways to offset a controlled and/or uncontrolled intersection a minimum of 50-feet (measured near edge to near edge). Modification of Policy for Broadway Avenue driveway location: As indicated on the site plan the applicant is proposing to construct a service driveway (# 1) on Broadway Avenue located approximately 15-feet east of the west property line (which is approximately 15-feet from the near edge of 4"' Street) and is 12-feet in width. This proposed driveway is for sanitation service and access to the trash receptacle. This location does not meet District policy for offsets from an intersection. Staff recommends approval of the indicated modification of policy due to the fact the proposed service driveway shall be used predominately for sanitation services and the applicant does not have the adequate frontage to align with 4th Street. This driveway will have limited use. As indicated on the site plan the applicant is proposing to close and relocate the existing residential driveway on Broadway Street located 60-feet east of the west property line. As indicated on the site plan the applicant is proposing to construct driveway # 2 on Broadway Street located 86-feet from near edge of the proposed service driveway to near edge of driveway # 2. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of the roadway and install pavement tapers with 15-foot radii abutting the existing roadway edge. District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles to a maximum width of 35-feet. Most commercial driveways will be constructed as curb-cut type facilities if located on local streets. Curb return type driveways with 15-foot radii will be required for driveways accessing collector and arterial roadways. The District will consider alternatives to the standard turnaround on a case-by-case basis. This will be based on turning area, drainage, maintenance considerations and the written approval of the emergency fire service for the area where the development is locate. Submit a design of the turnaround for review and approval by District staff. C. Site Specific Conditions of Approval 1. In accordance with District policy, the applicant shall be required to vacate the unopened right-of-way of 4th Street. The vacation does not have to be completed prior to issuance of a building permit, or occupancy. The applicant shall enter into a license agreement for six months, for the landscaping in the right-of-way, and shall apply for a vacation prior to the expiration of the license agreement. The applicant shall also enter into a development agreement that outlines the payment plan for the vacated right-of-way, should it be approved by the Commission. 2. Construct curb, gutter, 5-foot wide detached concrete sidewalk and match paving on Broadway Avenue abutting the parcel as proposed on the site plan. Coordinate the location and elevation of the sidewalk with District staff. If the sidewalk meanders outside of the right-of-way, provide an easement for the sidewalk. The District will require a license agreement for the landscape strip with 4 the detached sidewalk. An agreement must be approved prior to scheduling the final plat for signature. Please contact the Right-of-Way Division at 387-3271 for guidelines. 3. Construct the service driveway # 1 on Broadway Street located 15-feet east of the west property line. This location does not meet District policy for offsets from an intersection, but shall be approved by Commission action with a modification of policy. 4. Construct driveway # 2 on Broadway Street located 110-feet east of the west property line as proposed on the site plan. This location meets District policy and is approved with this application. 5. Replace any unused curb cut on Broadway Avenue with standard curb, gutter and 5-foot wide detached concrete sidewalk to match proposed improvements. 6. Pave the driveways to their full-required width and to a point 30-feet beyond the edge of pavement of Broadway Avenue. 7. Comply with all Standard Conditions of Approval. D. Standard Conditions of Approval 1. Any existing irrigation facilities shall be relocated outside of the right-of-way. 2. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 7. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 8. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #195, also known as Ada County Highway District Road Impact Fee Ordinance. 9. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. 5 ~ ! 10. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. 11. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. E. Conclusions of Law 1. The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are satisfied. 2. ACRD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. Request for Reconsideration of Commission Action: A Commissioner, a member of ACRD staff or any other person objecting to any final action taken by the Commission may request reconsideration of that action, provided the request is not for a reconsideration of an action previously requested to be reconsidered, an action whose provisions have been partly and materially carried out, or an action that has created a contractual relationship with third parties. a. Only a Commission member who voted with the prevailing side can move for reconsideration, but the motion may be seconded by any Commissioner and is voted on by all Commissioners present. If a motion to reconsider is made and seconded it is subject to a motion to postpone to a certain time. b. The request must be in writing and delivered to the Secretary of the Highway District no later than 3:00 p.m. on the day prior to the Commission's next scheduled regular meeting following the meeting at which the action to be reconsidered was taken. Upon receipt of the request, the Secretary shall cause the same to be placed on the agenda for that next scheduled regular Commission meeting. c. The request for reconsideration must be supported by written documentation setting forth new facts and information not presented at the earlier meeting, or a changed situation that has developed since the taking of the earlier vote, or information establishing an error of fact or law in the earlier action. The request may also be supported by oral testimony at the meeting. d. If a motion to reconsider passes, the effect is the original matter is in the exact position it occupied the moment before it was voted on originally. It will normally be returned to ACHD staff for further review. The Commission may set the date of the meeting at which the matter is to be returned. The Commission shall only take action on the original matter at a meeting where the agenda notice so provides. e. At the meeting where the original matter is again on the agenda for Commission action, interested persons and ACHD staff may present such written and oral testimony as the President of the Commission determines to be appropriate, and the Commission may take any action the majority of the Commission deems advisable. f. Broadway Avenue, Meridian, Idaho Commissioners: In regard to our proposed Head Start school building at 321/333 W. Broadway, we respectfully request a waiver of policy related to improving or vacating unopened right of way for the 15' of unopened ROW on the west side of the property. We would instead request a License Agreement to locate plantings on the unopened right of way. We have several reasons for our request. First, we believe a License Agreement is in fact the most sensible approach. I apologize to the Commission that I was unaware of the license possibility when I authorized our application. Mistakenly, I thought that there were only two alternatives: either improve the right of way or request to vacate the ROW and purchase from ACHD. Had I been more knowledgeable I would have initially requested a License Agreement. This License Agreement will work since we will not build in the right of way. If we were to continue with the vacation of ROW, we estimate the cost to buy the ROW based on the square foot cost for the property to be as high as $9,292 (3,871.5 sf x $$2.4/sf = 49,292.) When we initially purchased the property we were unaware of the extensive process and expense related to the right of way issue and, as a consequence, we were stunned at the additional cost. Our budget is very tight and so if the License Agreement could be possible from ACHD's perspective, it certainly is better for our program financially. As the Head Start grantee for Ada and. Elmore Counties, Friends of Children and Families, Inc. is anon-profit entity serving low-income young children and their families for the purpose of developing school readiness. We have served Meridian children by transporting them to Boise on our buses or their families drive them to our site at 4707 Camas in Boise. It has been our great hope and dream to be able to offer services to Meridian families in Meridian. We have had a very difficult time finding a suitable building to remodel or land on which to build. After a long and arduous search, we finally found the property on Broadway in Meridian just months before our grant for Meridian services was to expire. We are prepared to start building this April with a completion date in time for school to start in September 2003. The ROW vacation process has been described to me as one, which can take from 3 to 6 months. A delay of this amount of time would prevent us from meeting our grant requirements. Again, I apologize for my mistakes in not understanding the process and time requirements to achieve a vacation of ROW. In order to request a ROW License Agreement with ACHD, we have proposed moving the small portion of the building that was originally to be in the ROW outside of the ROW. Our revised drawings show this change. We propose plantings in the ROW, which may be removed if ever the need for a public pathway to canals to the south arises. Mature healthy trees on the west of the ROW would be maintained. Your consideration of our request will be very much appreciated.
