Conditions of Approval: Project is subject to all current City Ordinances and conditions of approval
for Bridgetower Crossing Subdivision No. 2. The issuance of this permit does not release the
applicant from any requirements of the approved Conditional Use Permit (File No. CUP-Ol -
006), Preliminary Plat (File No. PP-O1-005), and Development Agreement issued for this
development.
Si~,na~e: No signs are approved with this CZC. All signs will require a separate sign permit in
compliance with the sign ordinance.
Landscaping: The Landscape Plan is approved per the' plan stamped 12/30/03. The approved
landscape plan is not to be altered without prior written approval of the Planning & Zoning
Department. No field changes to site plan permitted; prior written approval of all material
changes is required.
Irrigation: An underground; pressurized irrigation system must be installed to all landscape areas per
the specifications provided.
Curbin :Per Ordinance 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other
vehicle use areas; must be protected by curbing, wheel stops, or other approved protective
devices. Curbing may be cut to allow for storm water runoff.
Parking_ Off-street parking is approved as shown on the approved site plan. All standard parking
stalls must be 9 x 19 minimum and drive aisles must be at least 25 feet wide (MCC 11-13-5).
Project engineer/architect shall certify that the number and size of handicap-accessible
spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls
must have signage in accordance per ADA.
Sidewalks: All sidewalks shall be constructed as submitted and in accordance with the Meridian
City Code requirements (MCC 12-S-2.K.). Sidewalks shall be constructed prior to occupancy.

Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully
vegetated, and shall be designed in compliance with the Meridian City Code.
Li tin :Lighting shall not cause glare or impact the traveling public or neighboring development.
Trash Enclosure: All dumpsters must be screened from view and not be visible by the public or
from adjacent properties. Trash enclosure must be built in the location and size as approved
by SSC. See Meridian City Code 11-12-1. C. for enclosure requirements.
Handicap-Accessibility: The structure, site improvements and parking must be in compliance with
all federal handicap-accessibility requirements.
ACHD Acceptance: Applicant shall be responsible for meeting the requirements of ACRD as they
pertain to this development. All impact fees, if any, shall be paid prior to the issuance of a
building permit. If any changes must be made to the site plan to accommodate the ACHD
requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning
staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by
providing surety to the City in the form of a Letter of Credit or cash in the amount of 110%
of the cost of the remaining improvements. A bid must accompany any request for
Temporary Occupancy. No occupancy will be granted until the final plat for the property is
recorded.
Plan Modifications: The approved Site Plan and Landscape Plan, stamped 12/30/03 are not to be
altered without prior written approval of the Planning & Zoning Department. No significant
field changes to the site or landscape plans are permitted; prior written approval of all
changes is required.

Statement of Proposed Use•
The Cottages are made up of small elderly group homes located in communities
throughout south west Idaho. Residents are typically able to care for themselves with
moderate supervision by on-site staff. Each building contains 15 bedrooms with
individual bathroom facilities and a group kitchen, dining, and living area arrangement.
One garage space is provided per site for storage.
Landscape area on each site is typically a larger percentage than a typical
office/commercial use. Parking area requirements are minimal due to the nature of the
clientele. These two factors lend a very residential feel to the environment.
This site design allows for 2 homes with 15 units each in phase one with a conceptual
layout on the adjacent lot for 2 more buildings.

homes. We do not have any trash enclosures on site as per the owner they use standard garbage eans~
and bring them out to the curb or sidewalk on the set garbage day. They-have done this with their past
buildings and it is working good for them. Also depicted on this drawing is the dimensions of the
parking lot for access purposes. Could you please review this as we are require to obtain written

development, is approved.
4. Commercial Lots: No building elevations were submitted for the
proposed commercial buildings on Lots 28, 31, 32, 34.and 36, Block 23.
As stated in the Annexation Requirements above, all of these lots shall
'be processed only under CUP applications.
5. Applicant shall note that, as depicted on the CUP Site Plan,
Commercial Lots 36 and 28 do not reflect the minimum number of
required parking stalls to operate at 100% retail occupancy. Also, several
of the office and commercial lots are below the required number of ADA
stalls, have parking rows split between different lots and have drive
aisles below the minimum 25-foot width. These issues can be resolved at
the time of CUP or Certificate of Zoning Compliance.
6. Office Lots: Sample photos/elevations of the office buildings were
submitted with the application. The Applicant has stated on the face of
the PUD Site Plan that a detailed CUP application shall be required for
the development of each lot. However, since parking, trash enclosures,
landscaping and elevations were all submitted for the office lots, the
Planning and Zoning Commission and City Council do not feel the
office lots would require CUP applications for each lot. The office lots
shall be allowed to be processed under a Certificate of Zoning
Compliance process only, subject to Ordinance 12-6-6.F, which allows
minor changes up to 10% flexibility.
7. Townhouse Lots: Sample photos/elevations of the townhomes were
submitted with the application. The Applicant has stated on the face of
the PUD Site Plan that a detailed CUP application shall be required for
the development of these townhome lots. However, since a Final Plat
application shall be submitted for this phase (shown as Phase #7) and
detailed landscaping and fencing plans shall be required at that time,
The Planning and Zoning Commission and City Council do not feel
these lots would require a CUP application. Any tri-plex units would,
however, require a CUP application.
8. Pathways: The Comprehensive Plan, policy 4.1, pg. 56, of the
Transportation Chapter, designates Five Mile Creek as a multiple use
pathway. Any pathway along Five Mile Creek shall require Bureau of
Reclamation (BOR) and NMID approval. Since BOR owns the Five
