Meridian City Code 11-4-7 states that not more than one (1) principal detached building shall be located on a lot, except in the case of a Planned Development. A Conditional Use Permit for a Planned Development, or a Preliminary/Final Plat, shall be approved for the property by Meridian City Council prior to issuance of any additional building permits. Signaae: No signs are approved with this CZC. All signs will require a separate sign permit in compliance with the sign ordinance. Site Plan: The Site Plan is approved per Sheet 3 of 15 (dated December 2004, by Civil Survey Consultants), stamped "approved" on 2/2/05, and per the 8 '/z x 11"plan, with the following change (see redline on plan): The width of the drive aisle perpendicular to the south building is shown as 24-feet. Meridian City Code 11-13-4(F) requires that drive aisles be 25-feet in width. Landscape Plan: The Landscape Plan is approved per Sheet L-1 (dated 1/20/05, by The Land Group, Inc.), stamped "approved" on 2/2/05, and per the 8 '/2 x 11"plan. The landscape plan is not to be altered without prior written approval of the Planning and Zoning Department. No field changes to the landscape plan permitted; prior written approval of all material changes is required. Parkin>;: The parking area shall be paved and striped in accordance with MCC 11-13-4. Project engineer/architect shall certify that the number and size ofhandicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA. .~ - i ~ Irri ag tion: An underground, pressurized irrigation system must be installed to all landscape areas per the specifications provided. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with the MCC. Protection of Existing Trees: Any existing trees on site must be protected in accordance with the Tree Preservation section ofthe City's Landscape Ordinance. Per Ordinance 12-13-13-4, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection measures prior to construction. Any severely damaged tree must be replaced in compliance with Ordinance 12-13-13-6. Curbin :Per Ordinance 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Handicap-Accessibility: The structure, site improvements and parking must be incompliance with all federal handicap-accessibility requirements. Li~tin~: Lighting shall not cause glare or impact the traveling public or neighboring development. Down- shield all lighting so it does not spill onto adjacent properties. Sidewalks: All sidewalks shall be constructed as shown on the approved Site Plan and in accordance with the Meridian City Code requirements (MCC 12-5-2.K). Sidewalks shall be constructed prior to occupancy of the permanent building. Trash Enclosure: All dumpsters and/or carts must be screened from view and not be visible by the public or from adjacent properties. Trash enclosures must be in the location and size as approved by SSC. ACRD Acceptance: Applicant shall be responsible for meeting the requirements of ACHD as they pertain to this development. All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. No occupancy will be granted until the final plat for the property is recorded. Plan Modifications: The approved Site Plan and Landscape Plan, stamped 1112/O5, are not to be altered without prior written approval of the Planning & Zoning Department. Capital Improvements Plan/Five Year Work Program Locust Grove Road is listed in the FYWP for construction in 2006 to a 5-lane section with curb, gutter and sidewalk. In conjunction with this project, Nola Road will be disconnected from Franklin Road and will not cross the railroad tracks. Nola Road will terminate in a culdesac adjacent to this site and north of the railroad tracks, and will terminate in a culdesac south of the railroad tracks. The culdesac improvements are included in the Locust Grove Road project description. B. Findings for Consideration 1. Right-of-Way and Street Improvements Policy: • District policy requires 96-feet of right-of--way on arterial roadways (Figure 72-F1 B). This right-of-way width allows for the construction of a 5-lane roadway with curb, gutter, 5-foot wide detached sidewalks and bike lanes. Applicants are required to construct a 5-foot wide detached concrete sidewalk on arterial roadways. • Policy requires 54-feet of right-of--way on local/commercial roadways fora 40-foot street section with curb, gutter and sidewalk. Applicants are required to construct commercial roadways as one-half of a 40-foot street section with curb, gutter and 5- foot wide concrete sidewalk. Applicant Proposal: The applicant has proposed to dedicate and construct the following: • Locust Grove Road: 56 to 58-feet of right-of-way from section line (arterial) and no roadway improvements. • Nola Road: 54-feet of right-of-way, 27-feet from centerline (commercial), plus additional right-of--way for the culdesac, and proposing full street improvements. The plans show the road shifting slightly to the west starting at the north property line. Nola Road is fully improved abutting other properties and therefore this applicant should extend the existing improvements. Staff Recommendation: • The applicant should dedicate right-of--way as proposed for both streets. ACRD will compensate the applicant for the right-of-way on Locust Grove Road because the project is listed in the District's Five Year Work Program. The applicant will not be compensated for the right-of--way on Nola Road because local streets are to be dedicated and brought up to standards as development occurs. (Note: If sufficient right-of--way exists on Nola Road to construct improvements, then additional right-of- way is only required for the culdesac.) • ACHD will purchase the necessary right-of--way for the culdesac that is to be constructed with the Locust Grove Project at the future terminus of Nola Road at the railroad tracks. The applicant is not required to construct the culdesac, and should terminate Nola Road improvements approximately 175-feet south of the proposed driveway. • The applicant should provide a road trust for the sidewalk on Locust Grove Road in lieu of constructing sidewalk before the roadway improvement project. The road trust can only be used for improvements abutting the site and is calculated at $20/lineal foot of frontage, for a total of $10,900. • The applicant should improve Nola Road in accordance with District policy to match improvements to the north of the site. 2. Access Policy: District policy requires driveways to align or offset any driveways or streets a minimum of 150-feet (measured near edge to near edge) based on a 35mph speed limit. 3 • Applicant Proposal: The applicant is proposing to construct one driveway on Nola Road to align with Commercial Street, and one driveway on Locust Grove Road to align with the western segment of Commercial Street. The driveway is proposed to be gated to prevent cut-through traffic through the site between Nola Road and Locust Grove Road. Staff Recommendation: The proposed driveways are located in conformance with District policy and should be approved as proposed. Commercial Street has not been previously designated to connect Nola Road to Locust Grove Road, and a public street through the site is not necessary to serve the proposed development. Therefore, the layout is approved as proposed. There is a power pole on the northerly edge of the Nola Road driveway. The applicant may construct a detached sidewalk around the pole if necessary to avoid moving the pole. 3. Gates Policy: District policy requires a minimum of 50-feet of stacking at any gated access point. Applicant Proposal: The applicant is proposing to gate the driveway that intersects Nola Road. This access point is necessary to allow on-site delivery and maneuvering of large trucks. Staff Recommendation: The applicant should gate the driveway on the eastern side of the site to prevent cut-through traffic from Nola Road to Locust Grove Road. 4. Temporary Access to Site Applicant Proposal: The applicant is proposing to construct a temporary paved access to the site across the unopened/unimproved Locust Grove Road right-of--way at the intersection of the western segment of Commercial Street. Staff Recommendation: The applicant is seeking secondary access to the site until such time that Locust Grove Road is improved. The applicant should enter into a license agreement with ACRD for the temporary access. The access cannot be utilized during construction, and the license agreement will terminate before that time, until the roadway is full constructed and officially opened to vehicular traffic. C. Site Specific Conditions of Approval 1. Dedicate approximately 56 to 58-feet of right-of--way from the section line of Locust Grove Road abutting the parcel by means of a warranty deed and in accordance with the Locust Grove Road design plans. The right-of-way purchase and sale agreement and deed must be completed and signed by the applicant prior issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of--way dedication after receipt of all requested material. 2. Dedicate right-of--way for the future Nola Road culdesac abutting the parcel by means of a warranty deed and in accordance with the Locust Grove Road design plans. The right-of--way purchase and sale agreement and deed must be completed and signed by the applicant prior issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. 4 • 3. Dedicate 27-feet of right-of-way from centerline (if not already existing) and improve Nola Road to one-half of a 40-foot street section with curb, gutter and 5-foot wide concrete sidewalk to match existing improvements to the north. (The applicant should submit revised drawings that show the road extending in a straight alignment, not shifting to the west.) If not already existing, then dedicate right-of--way to extend to 2-feet beyond the back of curb. The improvements shall be constructed on the west side of Nola Road from the north property line to a point approximately 175-feet south of the proposed driveway. Culdesac improvements are not required. 4. Provide a $10,900 road trust for sidewalk on Locust Grove Road abutting the site. 5. Construct a 40-foot wide (maximum) curb return driveway on Locust Grove Road located in alignment with Commercial Street on the west side of Locust Grove Road as proposed. 6. Construct a 36 to 40-foot wide (maximum) curb return driveway on Locust Grove Road located in alignment with Commercial Street on the east side of Locust Grove Road as proposed. 7. Driveway gates shall be located a minimum of 50-feet from the edge of pavement. 8. The applicant may construct temporary pavement to connect the site to Commercial Street on the west side of Locust Grove Road. This will provide secondary access to the site until the roadway is constructed. Enter into a license agreement with ACHD to utilize the unimproved Locust Grove Right-of--Way. The license agreement will expire at the time that construction begins on Locust Grove. At that time, all access will be taken from Nola Road until the project has been completed and the road officially opened. 9. Comply with all Standard Conditions of Approval. D. Site Specific Conditions of Approval 1. Any existing irrigation facilities shall be relocated outside of the right-of--way. 2. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACRD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 6. The applicant shalt submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 7. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 5 • 8. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #200, also known as Ada County Highway District Road Impact Fee Ordinance. 9. It is the responsibility of the applicant to verify all existing utilities within the right-of--way. The applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACRD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. 10. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. 11. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. Development Process Checklist 6 • s Request for Appeal of Staff Decision Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or enforcement of the ACRD Policy Manual. a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged the applicant for the processing of appeals, to cover administrative costs. b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary of Highway Systems, which must be filed within ten (10) working days from the date of the decision that is the subject of the appeal. The notice of appeal shall refer to the decision being appealed, identify the appellant by name, address and telephone number and state the grounds for the appeal. The grounds shall include a written summary of the provisions of the policy relevant to the appeal and/or the facts and law relied upon and shall include a written argument in support of the appeal. The Commission shall not consider a notice of appeal that does not comply with the provisions of this subsection. c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of the filing of the notice of appeal to reply to the notice of the appeal, and may during such time meet with the appellant to discuss the matter, and may also consider and/or modify the decision that is being appealed. A copy of the reply, and any modifications to the decision being appealed will be provided to the appellant prior to the Commission hearing on the appeal. d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal will be noticed and scheduled on the Commission agenda at a regular meeting to be held within thirty (30) days following the delivery to the appellant of the ROWDS Manager's reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal and the reply shall be delivered to the Commission at least one (1) week prior to the hearing. e. All requests need to have the following information and/or items included: - A complete description of how the area will be used. - The name, address and telephone number of the licensee. - The name(s) to appear on the signature line. - If area being licensed is for landscaping, please provide a complete landscaping plan depicting types of trees, shrubs, lawn, sprinklers, and any storm drain structures being affected by the landscaping. - If area being licensed is a subdivision, please provide a copy of the preliminary plat (this will work for the legal address). - A site drawing of the area to be under license together with adjacent streets and/or alleys. Indicate your property and provide your parcel number or street address. - A general vicinity map. - If the license agreement is for a sign, the dimensions of the sign. A picture or drawing of the proposed sign is also helpful. - A $25.00 application fee, unless it is a Storm Drain License Agreement request, which requires a $200 application fee. If additional application fees are required, an agent from the Right of Way division will notify you. - If the License Agreement is a requirement of your development, please include a copy of ACHD's approval letter and Development Application Report detailing the License Agreement requirements. - All maps provided are to be no larger that 11x17. - PLEASE ALLOW 3 WEEKS PROCESSING TIME. All License Agreements must be signed by the Licensees, or their representatives, and by ACRD before the Agreement is in effect. License Agreements are generally processed in the order they are received. As far as the Planning Department is concerned, permanent occupancy may be granted for this development (Josh Wilson granted temp. occ. in Feb.).
