The Landscape Plan is approved per the plan stamped 9/26/03. The requested alternative compliance for the perimeter landscape buffers is granted as depicted on said plans. ~~ Irrigation: An underground, pressurized irrigation system must be installed tip all landscape azeas per the specifications provided. Curbin :Per Ordinance 12-13-7-9, all landscape azeas adjacent to driveways, parking lots, or other vehicle use azeas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Protection of Any Existing Trees: Any existing trees on site must be protected in accordance with the Tree Preservation section ofthe City's Landscape Ordinance. Per Ordinance 12-13-13-4, coordinate with the Pazks Department Arborist (Elroy Huff) for approval of protection measures prior to construction. Any severely damaged tree must be replaced in compliance with Ordinance 12-13-13-6. Parkin. Off-street parking is approved as shown on the approved site plan. 17-foot deep spaces will be allowed for pazking adjacent to landscape areas, as depicted on the site plan. Drive aisles must be at least 25 feet wide (MCC 11-13-5). Project engineer/architect shall certify that the number and size ofhandicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA. Sidewalks: All sidewalks shall be constructed as submitted and in accordance with the Meridian City Code requirements (MCC 12-5-2.K). Sidewalks shall be constructed prior to occupancy. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with the Meridian City Code. Ling: Lighting shall not cause glare or impact the traveling public or neighboring development. Trash Enclosure: All dumpsters must be screened from view and not be visible by the public or from adjacent properties. Trash enclosure must be built in the location and size as approved by SSC. See Meridian City Code 11-12-1.C. for enclosure requirements. Handicap-Accessibility: The structure, site improvements and parking must be incompliance with all federal handicap-accessibility requirements. ACHD Acceptance: Applicant shall be responsible for meeting the requirements of ACHD as they pertain to this development. All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACRD requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. No occupancy will be granted until the final plat for the property is recorded. Plan Modifications: The approved. Staff objected to this arrangement and had written a staff report recommending denial of this request. The appli- cant requested that the application be removed from previous agenda and has met with staff to work uut a compromise posi- tion that both staff and applicant can support. The appli- cant's stated objection to installing sidewalks in industrial developments is that the heavy equipment that is used to erect industrial land commercial) buildings will break the sidewalks and cause the need for them to be replaced. staff accepts this argument and believes that the deferral of sidewalks to a certain time is acceptable fora test case in industrial developments for which there is no clear indication that significant pedestrian ravement naafis to be accounted for. The applicant has agreed to install sidewalks in a por- tion of this -roject that is near existing residential areas. These arc along the west side of Fifth Street frown the exist- ing development to Bower and in front of the occupied build- ings. The applicant wants to defer the sidewalk along Bower until all the buildings have been constructed and occupied. Staff is of the opinion that this area is subject to pedestri- an usage from existing homes in the area and should be con- structed now. The A:ND Cap3.ta1 improvement Plan indicates that Franklin is apprcved for use of Road Impact Fee funds to increase its capacity. If the developer wishes to be paid for the addition- al right-of-way, he/she must submit an application to the impact fee administrator prior to breaking ground, in accor- dance with Section 15 of ACRD Ordinance N188. 5. Bower Street is a local street that has 80-feet of right-of- way and is improved with 24-feet of paving. 6.
