Conditions of Approval: Project is subject to all current City Ordinances and conditions of approval
for Intermountain Wood Products and Development Agreement requirements for Medimont
Subdivision. The issuance of this permit does not release the applicant from any requirements
ofthe approved Conditional Use Permit (File No. CUP-Ol-035) issued for this development.
Si Jna ~e: No signs are approved with this CZC. All signs will require a separate sign permit in
compliance with the sign ordinance.
Landscanins;: The Landscape Plan is approved per the plan stamped 2/4/03. The approved landscape
plan is not to be altered without prior written approval of the Planning & Zoning Departmerrt.
No field changes to site plan permitted; prior written approval of all material changes is
required.
Irri ag tion: An underground, pressurized irrigation system must be installed to all landscape areas per
the specifications provided.
Fencin :Install fencing as shown on approved site plan.
Curbing: Per Ordinance 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other
vehicle use areas, must be protected by curbing, wheel stops, or other approved protective
devices. Curbing may be cut to allow for storm water runoff.
Protection of Existing Trees: Any existing trees on site must be protected in accordance with the
Tree Preservation section of the City's Landscape Ordinance. Per Ordinance 12-13-13-4,
coordinate with the Parks Department Arborist (Elroy Hufi) for approval of protection
measures prior to construction. Any severely damaged tree must be replaced incompliance
with Ordinance 12-13-13-6.
Parking Off-street parking is approved per red-line note shown on the approved site plan. All
standard parking stalls must be 9 x 19 minimum and drive aisles must be at least 25 feet wide.
Project engineer/architect shall certify that the number and size ofhandicap-accessible spaces
conforms to the Americans with Disabilities Act. Handicap accessible stalls must have
signage in accordance per ADA.
Sidewalks: All sidewalks shall be constructed as submitted and in accordance with the Meridian City
Code requirements. Sidewalks shall be constructed prior to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully
vegetated, and shall be designed incompliance with the Meridian City Code.
Li tin :Lighting shall not cause glare or impact the traveling public or neighboring development.
Trash Enclosure: All dumpsters must be screened from view and not be visible by the public or from
adjacent properties. Trash enclosure must be built in the location and size as approved by
SSC.
Handicap-Accessibility: The structure, site improvements and parking must be in compliance with all
federal handicap-accessibility requirements.
ACRD Acceptance: Applicant shall be responsible for meeting the requirements of ACHD as they
pertain to this development. All impact fees, if any, shall be paid prior to the issuance of a
building permit. If any changes must be made to the site plan to accommodate the ACRD
requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning
staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by
providing surety to the City in the form of a Letter of Credit or cash in the amount of 110%
of the cost of the remaining improvements. A bid must accompany any request for
Temporary Occupancy. No occupancy will be granted until the final plat for the property is
recorded.
Plan Modifications: The approved Site Plan and Landscape Plan, stamped 2/4/03 are not to be
altered without prior written approval of the Planning & Zoning Department. No significant
field changes to the site or landscape plans are permitted; prior written approval of all changes
is required.

CONTENTS OF CZC APPLICATION
(Incomplete applications will not be processed)
An application for a Certificate of Zoning Compliance shall be filed with the Planning and Zoning
staff by the owner of the property or the applicant of the proposed use. The application shall contain
the following information:
Completed and signed CZC application form.
2. The last deed of record for the subject property.
3. Notarized Affidavit of Legal Interest (attached).
4. Four (4) copies of a detailed site plan, drawn to a scale of not less than 1 "=50'. Also include
an 8 %z" x 11" reduction.
5. Three (3) copies of the landscape design in compliance with the Landscape Ordinance,
drawn to a scale of not less than 1"=50'. See attached landscape submittal requirements.
6. Three (3) copies of irrigation performance specifications in compliance with the Landscape
Ordinance.
7. Written approval or a stamped site plan from Sanitation Service Company (SSC) indicating
that the designs of the trash enclosure and access drive are acceptable.
A calculations table that shall list the number of parking stalls, building size, lot size,
landscaping, open space, setbacks, fencing, screening and coverage.
9. A written statement from the applicant detailing the proposed use(s) of the property. Please
list as many details as possible.
10. A fee of $60.00.
ACRD Acceptance: Applicant shall be responsible for meeting the requirements of ACRD as
they pertain to this application. All impact fees, if any, shall be paid prior to the issuance of a
building permit. If any changes must be made to the site plan to accommodate the ACRD
requirements, a new site plan shall be submitted to the City of Meridian Planning & Zoning
Department for approval prior to the issuance of a building permit.

B. Conditions of Approval
1. PLANNING DEPARTMENT
1.1 ANNEXATION COMMENTS
Prior to the annexation ordinance approval, a Development Agreement (DA) shall be entered into
between the City of Meridian, property owner (at the time of annexation ordinance adoption), and
the developer. The applicant shall contact the City Attorney, Bill Nary, at 888-4433 to initiate this
process within 18 months of City Council approval of the annexation request. The DA shall
incorporate the following:
• That all future uses shall not involve uses, activities, processes, materials, equipment and
conditions of operation that will be detrimental to any persons, property or the general welfare by
reason of excessive production of traffic, noise, smoke, fumes, glare or odors.
• That all future development of the subject properly shall be constructed in accordance with City
of Meridian ordinances in effect at the time of development.
• That the applicant will be responsible for all costs associated with the sewer and water service
extension.
• That any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service, per City Ordinance Section 5-7-517, when services are
available from the City of Meridian. Wells may be used for non-domestic purposes such as
landscape irrigation.
• That prior to issuance of a Certificate of Zoning Compliance for construction of the new building,
the applicant shall submit a recorded cross access and parking easement between the two parcels.
2. PUBLIC WORKS DEPARTMENT
1. The proposed project has no Public Works concerns.

D. Required Findings from Zoning Ordinance
] . Annexation Findings:
Upon recommendation from the Commission, the Council shall make a full investigation
and shall, at the public hearing, review the application. In order to grant an annexation
and/or rezone, the Council shall make the following findings:
1. The map amendment complies with the applicable provisions of the comprehensive
plan;
The applicant is proposing to zone all of the subject property to C-G. Staff finds that the
proposed zoning map amendment complies with the applicable provisions of the
comprehensive plan. Please see Comprehensive Plan Policies and Goals, Section 8, of the
Staff Report.
2. The map amendment complies with the regulations outlined for the proposed
district, specifically the purpose statement;
Staff finds that animal care facilities are allowed within the requested zoning district of
C-G as a Principally Permitted Use. The applicant will be required to submit for
approval of a Certificate of Zoning Compliance prior to commencement of any
construction on the property, to ensure compliance with City Code.
3. The map amendment shall not be materially detrimental to the public health, safety,
and welfare;
Staff finds that the proposed zoning amendment will not be detrimental to the public
health, safety, or welfare. Staff recommends that the Commission and Council rely on
any oral or written testimony that may be provided when determining this finding.
4. The map amendment shall not result in an adverse impact upon the delivery of
services by any political subdivision providing public services within the City
including, but not limited to, school districts; and,
Staff finds that the proposed zoning amendment will not result in any adverse impact
upon the delivery of services by any political subdivision providing services to this site.
5. The annexation is in the best of interest of the City (UDC 11-SB-3.E).
Staff finds that all essential services are available or will be provided by the developer to
the subject property and will not require unreasonable expenditure of public funds. The
applicant is proposing to develop the land in general compliance with the City's
Comprehensive Plan. This is a logical expansion of the City limits. In accordance with
the findings listed above, staff finds that Annexation and Zoning of this pro e~rty to C G
would be in the best interest of the City

This memo is in response to a letter written by Mr. & Mrs. Smith, dated September
22, 2003, regarding concerns associated with an adjacent land use and approved
conditional use permit (CUP 01-035). Staff has been working with the Smiths as well
as the owner and general contractor for the Intermountain Wood Products facility to
come to an agreeable solution to the three concems that the Smiths .raised in the
letter addressed to the Council.
To accommodate emergency services, ahard-surfaced french drain system, rather
than a retention pond, was installed on the east side (back) of the site. The Smiths
have requested that the applicant put in crushed rock over the french drain to keep
potential dust down. The applicant has agreed.
A hooded light was installed above the door on the southeast comer of the building.
The Smiths have requested that a motion detector be installed above .the door to
minimize the amount of light that shines in the Smiths' direction. The applicant has
agreed.
As for the third concern raised by the Smiths, staff has contacted Sanitary Services,
Inc., to request that the garbage be picked up after 7 am. The operator that staff
talked to made a note to the route driver requesting a later garbage pick-up time for
the business park.
The general contractor has stated to staff that the crushed rock and motion light will
be installed within the next 2 to 3 weeks (mid-October). Staff has informed the
Smiths on the progress of their requests and believes with the applicant's
compliance the above-mentioned concerns should be alleviated.

Dear Mr. Miles:
This purpose of this letter is to approve alterations to the previously approved site plan and
landscape plan, stamped 2/4/03, for the I>rrtermountain Wood Products facility located at 300 S.
Adkins Way, Meridian, Idaho. If the applicant complies with the original conditions of approval
for the Conditional Use Permit (CUP-O1-035) and the previously approved site and landscape
plans for the Certificate of Zoning Compliance (CZC-03-007), including the changes listed
below, the Planning & Zoning Department shall consider the project to be in full compliance.
On the previously approved plans for CUP-01-035 and CZC-03-007, a drainage retention pond
with cobble landscaping was shown along the east property line. In lieu of the retention pond
and cobble, a french drain system has been proposed. Staff is supportive of this change as long
as enough crushed rock is placed along the east property line to provide adequate ground-cover
to prevent weeds from growing in excess (approximately 2 to 3 inches in depth). The crushed
rock should not inhibit the- ability of the drain to function adequately, nor should it inhibit the
ability of emergency vehicles to service the site (maximum of 4 inches in depth). The crushed
rock should extend from the current terminus of the pavement to the south property line.
After the pubic hearing for the Conditional Use Permit (CUP-O1-035), the Meridian Fire
Department required an emergency door on the east face (back) of the building. The submitted
and approved site plan did not show any doors on this east facing facade. Since this change,
Planning & Zoning staff received a phone call from an adjacent property owner in opposition to
the door, and more specifically the light above the door. It appears that the .door and associated
light meet Meridian City Code for installation. However, the abutting property owner has asked

that a motion light be installed above the door to minimize the amount of light that shines in that
direction. In order to mitigate the amount of time that the light above the back door is on, the
applicant has agreed to install a motion detector.
In conclusion, the City has approved the above-mentioned changes to the approved site and
landscape plans, subject to the conditions included with the changes. The project is still subject
to all current City Ordinances. This letter does not change any of the conditions and
requirements outlined in the approved Conditional Use Permit (CUP-O1-035) issued for this
development:
