Si ng_age: No signs are approved with this CZC. All signs will require a separate sign permit in compliance with the sign ordinance. Landscapirls: The Landscape Plan is approved per the plan stamped 11/10/03. Irri ag tion: An underground, pressurized irrigation system must be installed to all landscape areas per the specifications provided. It is noted that pressurized ,irrigation is not available to the property and the sprinkler system will be connected Meridian City water. Staffrecommends installing a separate water meter for irrigation uses so that the property owner is not charged sewer fees for irrigation water. Coordinate with the Meridian Public Works Dept. A no- services verification letter from the irrigation district will be required. Curbi~: Per Ordinance 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut, if necessary, to allow for storm water runoff. Protection of Any Existing_Trees: Any existing trees on site must be protected in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per the approved CUP, the existing 6" Siberian Elm may be removed without mitigation. Parking Off-street parking is approved as shown on the approved site plan. Drive aisles must be at least 25 feet wide (MCC 11-13-5). Standard parking stalls shall be at least 9 x 19. Project engineer/architect shall certify that the number and size of handicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have • i signage in accordance per ADA. The 13 spaces in a row shown in front of the building were approved as an `alternative compliance' per the approved CUP. Sidewalks: All internal sidewalks shall be constructed as submitted and in accordance with the Meridian City Code requirements (MCC 12-5-2.K). Sidewalks shall be constructed prior to occupancy. It is noted that sidewalks along Franklin and Linder roads are existing. Drainage: No storm water drainage swales are depicted on the submitted site or landscape plans. If any storm water drainage swales are required by public works, they shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with the Meridian City Code. Lighting: Lighting shall not cause glare or impact the traveling public or neighboring development. Trash Enclosure: All dumpsters must be screened from view and not `be visible by the public or from adjacent properties. Trash enclosure must be built in the location and size as approved by SSC. See Meridian City Code 11-12-1.C. for enclosure requirements. Handicap-Accessibility: The structure, site improvements and parking must be in compliance with all federal handicap-accessibility requirements. ACRD Acceptance: Applicant shall be responsible for meeting the requirements of ACHD as they pertain to this development. All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. No occupancy will be granted until the final plat for the property is recorded. Plan Modifications:. A plan which cannot be drawn in its entirety on a single sheet must be drawn with appropriate match lines on two or more sheets. Number of Copies: 3 Landscape Plan Preparation: Preparing a landscape plan requires special skills. Landscaping involves more than a simple arrangement of plants with irrigation; plants are not haphazardly placed in a way that fills up leftover space. Landscape plans should be artfully and technically organized in a way that conveys coherence, design, and organization. The landscaping should enhance the physical environment as well as the project's aesthetic character. Also, requiring plans prepared by a landscape professional minimizes the likelihood of trees dying or interfering with other adjacent site features. The assessed impact fee will be based on the impact fee ordinance that is in effect at that time. 3. Roadway Improvements Adjacent To and Near the Site Franklin Road is a minor arterial roadway with 4-travel lanes, center turn lane with curb, gutter and sidewalk abutting the site. The intersection with Franklin Road and Linder Road is signalized. Linder Road is a minor arterial roadway with 2-travel lanes, dedicated turn lanes with curb, gutter and sidewalk abutting the site. 8. Existing Right-of-Way Franklin Road has 82-feet of right-of-way (40-feet from centerline). Linder Road has 82-feet of right-of-way (40-feet from centerline). 2 9. Existing Access to the Site The development site has one existing curb return driveway on Franklin Road located approximately 232-feet east from the near edge of Linder Road. There is an existing driveway located on the north side of Franklin Road located approximately 187- feet east of the intersection of Linder Road (approximately 45-feet offset from the existing driveway for the development site). ACHD constructed the driveway with the widening of Franklin Road. There has been no formal development application submitted to ACHD for the parcel. The development site does not have a delineated driveway on Linder Road. The ACRD retention pond parcel to the south has a driveway located approximately 25-feet south of the development site. 10. Site History District staff has not reviewed this site as an application or prepared a report in the past year. 11. Capital Improvements Plan/Five Year Work Program This location is not programmed into the District's current Capital Improvements Plan and/or Five Year Work Program for reconstruction or any roadway improvements. 12. Other Development in Area/Miscellaneous In April 2002, ACHD staff reviewed and approved MCZC02-013 a 13,640-square foot food equipment warehouse. The 1.11-acre site is located on the north side of Franklin Road approximately 1/8 of a mile west of Linder Road. On April 18, 2001, ACHD staff reviewed and approved MCUP01-011 to construct a 3,000-square foot convenience store, 3,000-square foot drive-thru restaurant, gas station, car wash and drive thru coffee shop. The 4.0-acre site is located at the southwest corner of Linder Road and Franklin Road. On December 2001, ACHD staff reviewed and approved MCUP02-046 a bus facility with an accessory 14,850 square foot service building and an 8,250 square foot administration building for the Meridian School District. The site is located on the north side of Franklin Road approximately 1,100-feet west of Linder Road in Meridian. B. Findings for Consideration 1. Right-of-Way District policy requires 96-feet of right-of-way on arterial roadways (Figure 72-F1 B). This right-of-way allows for the construction of a 5-lane roadway with curb, gutter, 5-foot concrete detached sidewalks and bike lanes. Linder Road and Franklin Road is not listed as a proposed project in the District's currently adopted Five-Year Work Program or in the currently adopted 20-year Capital Improvements Plan. Both roadways are improved with curb, gutter and sidewalk abutting the development site. Therefore the applicant should not be required to dedicate any additional right-of--way with this application. 2. Sidewalk District policy requires 5-foot wide (minimum) concrete sidewalk on all collector streets (7204.6.5). Both roadways are improved with curb, gutter and sidewalk abutting the development site. Therefore the applicant should not be required to provide any additional roadway improvements. 3 3. Driveway Offsets/Signalized Intersections/ Collectors and Arterials District policy 72-F4 (1) requires driveways located on arterial roadways near a signalized intersection to be located a minimum of 440-feet feet from the signalized intersection for afull-access driveway and a minimum of 220-feet from the signalized intersection for aright-in/right-out only driveway. District policy 7204.7.3 states, access points for proposed developments at intersections should be located as far from the intersection as feasible, and in no case closer than as illustrated on Figure 72- F4, unless a modification for the access point has been approved by the ACRD Commission. Modification of Policy for the Franklin Road driveway location• The applicant is proposing to utilize the existing full access driveway on Franklin Road located approximately 223-feet east of the edge of pavement of Linder Road. The submitted site. plan shows that the proposed driveway is not in conformance with District policy. District policy requires driveways on arterial roadways to offset a minimum of 440-feet feet from the signalized intersection for afull-access driveway and a minimum of 220-feet from the signalized intersection for aright-in/right-out only driveway. Staff Analysis and Recommendation: Staff is recommending approval of the indicated modification of policy for the driveway on Franklin Road for a full access driveway for the following reasons: - The development site has insufficient frontage to conform to District policy. - The applicant is requesting to utilize an existing driveway. - The applicant is aware that a full access driveway in this location may be restricted to right- in/right-out operations in the future if there is a safety or traffic concern. - Franklin Road has 4-travel lanes with a center turn lane. - The Linder Road access is being restricted to a right-in/right-out. Modification of Policy for the Linder Road driveway location• The applicant is proposing to construct a driveway on Linder Road located approximately 133-feet south of the edge of pavement of Franklin Road and 25-feet north of the existing Ada County Highway District retention pond driveway. The submitted site plan shows that the proposed driveway is not in conformance with District policy. District policy requires driveways on arterial roadways to offset a minimum of 220-feet from the signalized intersection for aright-in/right-out only driveway. Staff Analysis and Recommendation: Staff is recommending approval of the indicated modification of policy for the right-in/right-out driveway on Linder Road for the following reasons: - Due to the low volume of trips generated by the existing ACHD retention pond driveway. - The development site has insufficient frontage to conform to District policy. 4 ~ ~ - The applicant of MAZ01-007/MCUP01-0011 appealed the right-in/right-out driveway located on Linder Road. Per Commission action of June 6, 2001 the driveway on Linder Road was approved as full access with the provisions that the driveway may be restricted to right- in/right-out operations in the future if there is a safety or traffic concern. - Access to a signal for westbound traffic, should the Franklin Road driveway be restricted in the future. 4. Driveway District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles to a maximum width of 35-feet. Most commercial driveways will be constructed as curb-cut type facilities if located on local streets. Curb return type driveways with 15-foot radii will be required for driveways accessing collector and arterial roadways. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of the roadway and install pavement tapers with 15-foot radii abutting the existing roadway edge. C. Site Specific Conditions of Approval 1. Construct a 35-foot wide (maximum) curb return driveway on Linder Road located 133-feet south of the edge of pavement from the Franklin Road intersection as proposed. Pave the driveway to its full- required width and to a point 30-feet beyond the edge of pavement of Linder Road with 15-foot curb radii pavement tapers abutting the existing roadway edge. This driveway is approved as a right- in/right-out access and should be signed accordingly. Coordinate the on site median construction with District staff. 2. Utilize the existing 30-foot curb return driveway adjacent to the east property line on Franklin Road as proposed. Pave the driveway to its full-required width and to a point 30-feet beyond the edge of pavement of Franklin Road abutting the existing roadway edge. This driveway is approved as a full access driveway but may be restricted to right-in/right-out operations in the future if there is a safety or traffic concern. 3. Comply with all Standard Conditions of Approval. D. Standard Conditions of Approval Any existing irrigation facilities shall be relocated outside of the right-of-way. 2. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACRD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 7. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 8. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #197, also known as Ada County Highway District Road Impact Fee Ordinance. 9. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. 10. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. 11. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. E. Conclusions of Law The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are satisfied. 2. ACRD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. Appeal Guidelines 6 Request for Reconsideration of Commission Action Request for Reconsideration of Commission Action: A Commissioner, a member of ACHD staff or any other person objecting to any final action taken by the Commission may request reconsideration of that action, provided the request is not for a reconsideration of an action previously requested to be reconsidered, an action whose provisions have been partly and materially carried out, or an action that has created a contractual relationship with third parties. a. Only a Commission member who voted with the prevailing side can move for reconsideration, but the motion may be seconded by any Commissioner and is voted on by all Commissioners present. If a motion to reconsider is made and seconded it is subject to a motion to postpone to a certain time. b. The request must be in writing and delivered to the Secretary of the Highway District no later than 3:00 p.m. on the day prior to the Commission's next scheduled regular meeting following the meeting at which the action to be reconsidered was taken. Upon receipt of the request, the Secretary shall cause the same to be placed on the agenda for that next scheduled regular Commission meeting. c. The request for reconsideration must be supported by written documentation setting forth new facts and information not presented at the earlier meeting, or a changed situation that has developed since the taking of the earlier vote, or information establishing an error of fact or law in the earlier action. The request may also be supported by oral testimony at the meeting. d. If a motion to reconsider passes, the effect is the original matter is in the exact position it occupied the moment before it was voted on originally. It will normally be returned to ACHD staff for further review. The Commission may set the date of the meeting at which the matter is to be returned. The Commission shall only take action on the original matter at a meeting where the agenda notice so provides. e. At the meeting where the original matter is again on the agenda for Commission action, interested persons and ACRD staff may present such written and oral testimony as the President of the Commission determines to be appropriate, and the Commission may take any action the majority of the Commission deems advisable. If a motion to reconsider passes, the applicant may be charged a reasonable fee, to cover administrative costs, as established by the Commission. 7
