APPLICATION SUMMARY The applicant, Pride, LLC, requests approval of a two year time extension (TEC) on the preliminary plat for Crossfield Subdivision in order to obtain the City Engineer's signature on the final plat for the fourth and last phase of the subdivision. II. STAFF RECOMMENDATION Staff recommends approval of the subject time extension, to expire on March 28, 2013, with the conditions included below in Exhibit B. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property is located on the southwest corner of W. Ustick Road and N. UNIFIED DEVELOPMENT CODE Per UDC 11-6B-7, approval of a preliminary plat shall become null and void if the applicant fails to obtain the City Engineer's signature on the final plat within two years of the approval of the preliminary plat. Where the development of the preliminary plat is made in successive phases in an orderly and reasonable manner, and conforms substantially to the approved preliminary plat, such segments, if signed by the City Engineer within successive intervals of two years, may be considered for final approval without resubmission for preliminary plat approval. Upon written request and filing by the applicant prior to the termination of the allowed time period, the City Council may authorize a time extension up to two years. With all extensions, the City Council may require the plat to comply with current provisions of the UDC. VI. PROCESS FACTS A. The subject application is for a time extension. A public hearing is required before the City Council on this matter, consistent with Meridian City Code Title 11, Chapter 5. B. Newspaper notifications published on: February 22, and March 14, 2011 C. Radius notices mailed to properties within 300 feet on: February 24, 2011 D. Applicant posted notice on site by: March 12, 2011 VII. HISTORY OF PREVIOUS ACTIONS: • This property received preliminary plat (PP-OS-017) approval from City Council on October 18, 2005. The preliminary plat consists of 245 building lots and 27 common/other lots on 59.3 acres of land. • The final plats (FP-OS-080; FP-06-025; FP-06-034) for the first three phases of development for Crossfield Subdivision have been recorded. The final plat (FP-09-004) for the last fourth)phase of development has been approved by City Council but has not yet been signed by the City Engineer. An 18-month time extension (TE-08-020) on the preliminary plat to obtain the City Engineer's signature on the final plat for the third phase of development was approved by the Director on October 7, 2008 the City Engineer signed the final plat for the third phase on August 28, 2009 within the time period allowed, which gave the applicant 18 months (until February 28, 2011) from the date of signature to obtain the City Engineer's signature on the next final plat (fourth phase). VIII. STAFF ANALYSIS This is the second time extension requested for the subject preliminary plat. Approval of the subject time extension will allow the applicant to proceed with the platting process and finalize the subdivision. If the subject time extension is not granted, only the portion of the site approved as phase four would need to be resubmitted for preliminary plat as the final plats for the remainder of the subdivision have been recorded. As conditions of approval of the first time extension in 2008, the applicant was required to develop the site consistent with the building elevations approved with the conditional use permit and construct a 10-foot wide multi-use pathway on the north side of Lot 18, Block 11 from the sidewalk on Sommersby Avenue to the east property line. This sidewalk has been constructed.
