Applications for a Conditional Use Permit (CUP) and Preliminary Plat (PP) are exempt from requirements M, N, O, and P of the `Contents' section and may instead show conceptual landscaping with tree locations only and conceptual screening structures; all other sections of the landscape ordinance still apply. Plan Size & Scale The landscape plan must have a scale no smaller than 1 "=50' (1 "=20' is preferred) and be on a standard drawing sheet, not to exceed 36"x48" (24"x36" is preferred). A plan which cannot be drawn in its entirety on a single sheet must be drawn with appropriate match lines on two or more sheets. Number of Copies The number of copies of the landscape plan that must be submitted is shown on the following schedule: • Conditional Use Permit: 10 copies • Preliminary Plat: 10 copies • Final Plat: 3 Copies • Certificate of Zoning Compliance: 3 Copies Contents The landscape plan shall comply with the provisions of this ordinance and shall include the following elements. A. .Date, scale, north arrow, and title of the project. B. Names, addresses and telephone numbers of the developer and the person/firm preparing the plan. C. Existing boundaries, property lines, and dimensions of the lot. D. Relationship to adjacent properties, streets, and private lanes. E. Easements and right-of--way lines on or adjacent to the lot. F. Existing/proposed zoning of the lot, and the zoning and land use of all adjacent properties. G. Existing natural features such as canals, creeks, drains, ponds, wetlands, floodplains, high groundwater areas, and rock outcroppings. H. Location, size, and species of all existing trees on site with trunks 4 inches or greater in diameter, measured 6 inches above the ground. Indicate whether the tree will be retained or removed. I. A statement of how existing healthy trees proposed to be retained will be protected from damage during construction. Existing buildings, structures, planting areas, light poles, power poles, walls, fences, berms, parking and loading areas, vehicular drives, trash areas, sidewalks, pathways, stormwater detention areas, signs, street furniture, and other man-made elements. Landscaping involves more than a simple arrangement of plarrts with irrigation; plarrts are not haphazardly placed in a way the fills up leftover space. Landscape plans should be artfully and technically organized in a way that conveys coherence, design, and organization. The landscaping should enhance the physical environment as well as the project's aesthetic character. Also, requiring plans prepared by a landscape professional minimizes the likelihood of trees dying or interfering with other adjacent site features. We're glad to see this project moving forward! With one exception (see below) the Landscape and Fencing Plan (prepared by Harvest Design) looks good. There are, though, a few items on the Site Plan (both Marbury's civil and Springer Group's architectural drawings) that need to be brought into compliance with the Council-approved plan and final Order of Conditional Use Permit. When I refer below to the Order of Conditional Use Permit, I'm referring to the Order prepared on 12-18-01, which is the last version distributed by our Legal Department. 1. I understand from the City Attorney's Office (Marlene St. George) that the final ~pt-~- Findings of Fact, Conclusions of Law and Decision and Order for Tramore are not yet complete. Bill Nichols has prepared amemo -forthcoming early this week - responding to Sharon's letter of last month. I cannot issue a Certificate of Zoning Compliance until these final legal documents have been agreed upon by you and the City. I don't believe there are major issues of disagreement and I did my review based on what I understand to be the forthcoming edits to the FF/CUDO. However, I won't be able to actually issue the CZC until these documents are final. 2. Both the architectural and civil drawings still show a 20 foot wide dimension (inside curb to inside curb) at the entrance off Pine Ave. This drive needs to be a minimum of 25 feet the full length (see Order of CUP condition #2.14 on pg. 4). (Note that this impacts the Landscape Plan, because the Landscape Plan only shows a 21 foot cross-access driveway, which places the sidewalk on the east side of the cross- accessdriveway about 4 feet Goser to the driveway than it will actually be.) • July 15, 2002 3. Per Order of CUP condition #2.15, please submit a statement of building materials and, if possible, an elevation of the storage bay buildings. 4. Per Order of CUP cond~ion #2.11 (pg. 3), please revise the civil and landscape plans to add a minimum 5 foot wide pathway along the south boundary, north of the chain link fence. The existing pathway to the east is concrete, but you have the option to construct the pathway of either concrete or asphalt. 5. Here are my comments on your suggested additional changes to the Findings. First, we have already gone through one series of changes with regard to the Findings, so it makes it somewhat difficult to go back again. Where we have made mistakes, that is understandable and we are willing to correct those. However, in the future, please help us by doing as thorough a review as soon as you can. Internally, we are discussing ways where drafts can be sent to the applicant's representative in advance of adoption by the Council so that these types of things get caught. Referencing your first bullet point, we can change those since they were already reviewed and approved before, it's just that we did not catch all of the references. With regard to the second bullet point, regarding parking requirements, I do not believe that a revision to the Findings is necessary. It is clear in the "four corners of the document" that you have been allowed a reduction in the number of parking spaces. I see no reason to change the items that you have cited. With regard to your third bullet point, regarding Nampa & Meridian Irrigation District's requirement prohibiting trees within their easement, I am not sure why this needs any change at all. Since we know the District prohibits trees within their easement, and since our Findings cannot change their easement rights, why does there need to be anything deleted? The motion accepted staff and agency conditions, and this was one of their Sharon Gallivan July 15, 2002 Page 2 conditions. If you can help me understand why this needs to be deleted, let me know, otherwise I do not think it should be changed. With regard to your fourth bullet point, you are correct, there were problems with the word processing program which we did not catch when it came to the numbering of the paragraphs. We can correct that numbering and submit substitute pages. I look forward to hearing from you. If I do not hear from you within seven (7) days of the date of this letter, we will go ahead and proceed as I have outlined in this letter, and, hopefully, put this matter to rest. Stevens have been active multi-family developers in the Idaho market for several years. Developments include: Claremont - 56 units -affordable Packwood - 56 units -affordable Brookside - 84 units -upper end market rate River Oaks - 43-unit for sale townhomes Maryland Village I - 40-unit senior affordable Maryland Village II - 40-unit senior affordable Without exception, all of these developments have performed satisfactorily. Maryland Village I leased up rapidly and maintains 100% economic occupancy with a significant wait list. The wait list is being utilized to market Maryland Village II, which should be 100% leased at completion with occupancy with the first building scheduled for December, 2000. The Tramore site is located just west of downtown Meridian, one of Idaho's fastest growing cities. To date, no senior affordable housing has been constructed in Meridian. The market study prepared by Mr. Moe Therrien suggests the demand is substantial. The site is ideally located on a well traveled street, close to downtown shopping opportunities and medical and dental facilities. Additionally, the site is conveniently located to both the St. Luke's campus at Eagle Road and Interstate 84 and the Mercy Medical north campus at Garrity and Interstate 84. Plans -The architectural plans and specifications are included under Blue Tab 6 elsewhere in this Tax Credit and HOME Application. The final architectural working drawings will be prepared following receipt of aloes-income housing tax credit reservation and ctammitment for HOME financing. The structural quality of this apartment community will be top notch in every way. The apartments meet or exceed the most stringent energy codes. See further description of construction materials in the letter to Mr. Robert Reed and Ms. Julie Williams dated September 28, 2000. 2. Landscape Plan and Oven Space Calculation -The landscape plan will feature a good mix of both deciduous and evergreen trees, providing a variety of plant type, color and shade The entire site will be served by an underground automatic sprinkler system. The lawn areas will be hydro seeded. The density of Tramore Apartments is low, approximately 15 units per acre. This yields an open space calculation of an excess of 50 percent of the entire project site while still including ample parking, 132 open spaces and 12 garages meeting the City of Meridian required parking ratio. 3. Exterior Design, Floor Plans and Site Plan -The buildings have strong architectural features with low pitched roofs. The floor plan for each unit type is also very strong. The entry of each opens into a living room/dining room combination, both of which are extremely large for a typical one bedroom senior unit. The living room includes a coat closet and other storage shelves similar to a china cupboard. The kitchens have an eating bar, dishwasher, double-basin sink and garbage disposal. The dining area is directly off of the kitchen. The living room features an outside door going directly onto the patio. The bathroom in the one bedroom unit can be entered. off both the hallway and through the master bedroom, thus offering substantial privacy to the bedroom. The units have walk-in closets which are larger than normal. The bedrooms are substantially larger than typical seniors apartments. The bathroom in the two bedroom unit is centrally located and accessible to all living space in both bathrooms. • The bedroom in the one bedroom unit is very large with ample space for furniture arrangement and a large walk-in closet with excellent storage organization. The bedrooms in the two bedroom units provide a master suite with a lazgewalk-in closet. The second bedroom is large enough for afull-size bed and dresser, day bed, home office or craft room. The bathrooms are very spacious and feature ample lighting, storage and aone-piece fiberglass tub/shower combination for low maintenance. Each unit features lots of windows permitting substantial natural light and creating an illusion of even more space than exists in each unit. The units have been designed with maximum efficiency. The Ada County Highway District (ACHD) staff has received the above referenced application requesting preliminary approval to construct a 2-lot subdivision. Lot # 1 will be a 3-story 72-unit senior residential facility and lot #2's use will be determined at a later date. The 10-acre site is located on the south side of Pine Avenue approximately '/4 of a mile east of Linder Road. This development is estimated to generate 206 additional vehicle trips per day (0 existing) based on the Institute'of Transportation Engineers Trip Generation Manual (Estimated trips are based on the senior residential facility only) B. The application and site plan stamped and received by City of Meridian on September 26, 2001, and submitted to the District on October 4, 2001, has been reviewed by the ACRD Planning and Development staff. and conforms to applicable District standards/policy, or can be made to conforn~ with the change(s) to the plan described in the requirements stated below. C. This is a staff level approval and ~~~ill not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conform to District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. D. On October 9, 2001, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On October ] 2, 2001, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation systemm. For the purposes of estimating daily trip generation and assessing impact fees for this project, the proposed use of this development has been classified as Retirement Community. (Per the ITE Manual) The impact fee rate from the fee tables for this use is based on the impact fee ordinance in effect at this time. Note: This rate is provided for informational purposes only and shall not be construed as an impact fee rate certification. The impact fee will be assessed at the time of plans acceptance by District staff, and shall be based on the fee tables and provisions of the District's lmpact Fee Ordinance in effect at that time. F. The applicant is proposing a driveway located approximately 150-feet east of the west property line. This location meets District policy and should be approved with this application. The applicant's site has approximately 475-feet of frontage on Pine Avenue. District policy states, "The applicant is required to align or offset any or proposed driveway or street a minimum of 150-feet from any existing or proposed streets or driveways." Special Recommendations to the City of Meridian: 1. Connectivity is critical for the District and the City of Meridian and the potential westward extension of two existing stub streets (West Idaho Avenue and West Broadway Avenue) District staff recommends that some form of vehicular access be preserved along the east property line of Lot 2. The following Site Specific Requirements and Standard Requirements must be met or provided for prior to ACHD approval of the final plat: Site Specific Requirements: ~~ edicate 35-feet of right-of--way from the centerline of Pine Avenue abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required pern~its), whichever occurs first. Allow up to 0 business days to process the right-of--way dedication after receipt of all requested material. he owner will be compensated for all right-of--way dedicated as an addition to existing right- ' ~ f-way from available impact fee revenues in this benefit zone, if the owner submits a letter of ill` application to the impact fee administrator prior to breaking ground, in accordance with ACRD rdinance #193. The right-of--way purchase agreement must be completed and signed by the p applicant prior to scheduling the final plat for signature by the ACRD Commission. Q' 2. The applicant should be required to constrict a 5-foot wide detached concrete sidewalk on Pine Avenue located 2-feet. within the new right-of--way. Coordinate the location and elevation of the sidewalk with District staff. ]f the sidewalk meanders outside of the right-of--way, provide an easement for the sidewalk. 3. Applicant is proposing a driveway approximately 150-feet east of the west property line. This location does meet District policy and is approved with this application. Pave the driveway to its full-required width of 24 to 30-feet and to a point 30-feet beyond the edge of pavement of Pine Avenue with 15-foot radii pavement tapers abutting the existing roadway edge. 5. Replace unused curb cuts on Pine Avenue with 5-foot wide concrete sidewalk to match the existing improvements. 6. If during construction any of the improvements are damaged the applicant is required to replace any damaged curb, gutter, and/or sidewalk on Pine Avenue to match existing improvements. Segments to be replaced shall be determined by ACHD Construction Services staff. Contact Construction Services at 387-6280 (with file number) for details. 7. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact ACHD's Utility Coordinator at 387-2516 or 378-6258 (with file number) for details. 8. Meet District drainage requirements per section 8000 of the ACHD Development .Policy Manual. Contact District staff at 387-6170 for details. 9. If utility relocation is necessary to construct improvements required with this development, then all utility relocation costs associated with improving street frontages abutting the site should be borne by the developer. 10. Any existing irrigation facilities should be relocated outside of the right-of--way. 11. Other than the access point specifically approved with this application, direct lot or parcel access to Pine Avenue is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. Standard Requirements: l . This decision of the Planning and Development Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by another party within l5 calendar days from the date of this report. The request shall specifically identify each requirement to be reconsidered and- include a written explanation of ~~~hv such a requirement would result in a substantial hardship or inequity. The request will be heard by the District Commission at an evening meeting within 20 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After ACRD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall S:\DSTECH\SUBS\Trama~e.sla.doc Pa~~e _' ~ ~ specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of its original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. ==5~---===T-he applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conforn~ance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the terms and conditions of this approval shall be valid unless they are in writing -and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District.
