Existing Access to the Site Access to this site is currently taken from Olive Avenue and Florence Street. Access restrictions to Fairview Avenue and were stipulated as part of approval for this site. 10. Site History In 1984 ACHD reviewed this site as Lot 1, Block 4, of Treasure Valley Business Center # 1. As part of the plat, the Commission did not require the developer to construct sidewalk abutting this site on the internal streets. 11. Five Year Work Program A signal is scheduled to be installed at the intersection of Hickory/Fairview Avenue in 2007. Franklin Road from Meridian Road to Five Mile Road is also in the Five Year Work Program for roadway improvements within the next five years. B. Findings for Consideration Sidewalk District policy requires 5 -foot wide (minimum) concrete sidewalk on all commercial streets (Figure 72- F1 B). There is a possibility of heavy pedestrian traffic in this area due to the undeveloped parcel to the west and on the north side of Lanark Street. There are some large office complexes in the area and the infrastructure for pedestrians is deficient in the area. However, District policy 7204.9.1 states that in some existing industrial developments or expansions of those developments, the District will allow deviations from the street standards by not requiring the construction of sidewalks. These developments include primary uses of storage facilities, trucking terminals, contractor shops, utility shops and selective heavy manufacturing facilities in which significant pedestrian movement is not anticipated. This development does not seem to fit into one of the above listed uses, and the applicant should be required to install sidewalk abutting the site on Olive Avenue and Florence Street (Eagle Road is under the jurisdiction of ITD). 2. Access State Highway 55 (Eagle Road) is under the jurisdiction of the Idaho Transportation Department (ITD). Access to Eagle Road is permitted by ITD on an individual application basis. ITD normally requests ACHD to comment on driveway applications in Ada County. With the Treasure Valley Business Center Subdivision, a note was placed on the plat that restricts direct lot access to Eagle Road for this property. In accordance with District policy 72028.2, lot access to industrial and commercial streets from abutting property is permitted. The applicant is not proposing any direct lot access to Eagle Road and unless otherwise approved by the Idaho Transportation Department, none is approved with this application. Controls for driveway and intersection placement should be required. District policy F2 -F4 (1) and 72-F4 (2), requires driveways located on local residential roadways to offset a controlled and/or uncontrolled intersection a minimum of 50 -feet (measured near edge to near edge). The applicant is proposing a driveway that is in alignment with a driveway across Florence Street and 50 -feet back from the intersection of Florence/Olive Avenue. The applicant is also proposing two additional driveways on Olive Avenue that meet District policy for location and spacing on a local street. District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles to a maximum width of 35 -feet. Most commercial driveways will be constructed as curb -cut type 3 • facilities if located on local streets. The applicant is proposing to construct three driveways all of which should be restricted to a maximum width of 35 -feet. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to pave the driveway its full width and at least 30 -feet into the site beyond the edge of pavement of the roadway and install pavement tapers with 15 -foot radii abutting the existing roadway edge. C. Special Recommendation to ITD State Highway 55 is under the jurisdiction of Idaho Transportation Department (ITD). The plans for the intersection of Eagle Road and Fairview Avenue should be reviewed by ITD to ensure that if additional right-of-way is needed along Eagle Road abutting this parcel for the interchange that it is acquired with this application. D. Site Specific Conditions of Approval Comply with requirements of ITD for State Highway 55 (Eagle Road) frontage. Submit to the District a letter from ITD regarding said requirements prior to District approval of the final plat or issuance of a building permit (or other required permits), whichever occurs first. Contact District III Traffic Engineer Michael Garz at 334-8340. 2. Construct a 5 -foot wide concrete sidewalk on Florence Street and Olive Avenue abutting the parcel. 3. Construct a maximum 35 -foot wide driveway on Florence Street located a minimum of 50 - feet east of the pavement on Olive Avenue as proposed. 4. Construct a maximum 35 -foot wide driveway on Olive Way located approximately 150 -feet south of Florence Street as proposed. 5. Construct a maximum 35 -foot wide driveway on Olive Way located approximately 310 -feet south of Florence Street as proposed. 6. Pave all driveways to their full -required width and to a point 30 -feet beyond the edge of pavement of Florence Street/Olive Avenue. 7. Unless otherwise approved by the Idaho Transportation Department, direct lot or parcel access to Eagle Road is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. 8. Comply with all Standard Conditions of Approval. E. Standard Conditions of Approval Any existing irrigation facilities shall be relocated outside of the right-of-way. 4 • 2. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 3. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 7. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 8. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #195, also known as Ada County Highway District Road Impact Fee Ordinance. 9. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. Existing utilities damaged by the applicant shall be repaired by the applicant at no cost to ACRD. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387- 6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. 10. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. 11. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. Parking will be provided for the completed build out of 8,000 sq. ft. The clinic will provide for both immediate care visits and appointment based visits to physicians and staff. The operation of the clinic will be identical to the clinic at 1130 E. Fairview Ave. The site plan includes two future building pads totaling 11,800 sq. ft. of additional office space.
