DESCRIPTION OF APPLICANT'S REQUEST The applicant, Fred Meyer Stores, Inc., requests Certificate of Zoning Compliance (CZC) approval to expand the fuel facility located at 1850 E. Fairview Avenue. The proposed expansion includes the addition of two (2) new multi-product dispensers, the extension of the fuel canopy, removal of 54 parking stalls and installation of five (5) new landscape planters to replace the six (6) proposed for demolition. The site consists of 15.46 acres and is zoned C-G. DECISION The applicant's request for CZC is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verb if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide two sets of the final, stamped "approved" Planning Department plans. You must provide these plans in PDFformat and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The site plan prepared by Barghausen Consulting Engineers, Inc., dated 01/03/11, labeled C3 is approved (stamped "approved" on 03/09/11 by the City of Meridian Planning Department) with no changes. 5. The landscape plan prepared by Barghausen Consulting Engineers, Inc., dated 09/10/10, labeled PL-1 is approved (stamped "approved" on 03/09/11 by the City of Meridian Planning Department) with no changes. The fuel canopy elevations prepared by Barghausen Consulting Engineers, Inc., dated May 2010, labeled A2 is approved (stamped "approved" on 03/09/11 by the City of Meridian Planning Department) with no changes. 7. The approved site plan, landscape plan and/or canopy elevations may not be altered without prior written approval of the City of Meridian Planning Department. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (MCU-10-003; DES-10-047). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 7. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-20. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before 03/24/2011, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Conditions Document 2 Fred Meyer Fuel Facility Expansion CZC Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Scope of the Project Fred Meyer seeks to expand the existing fuel facility at the Fairview Avenue location through the addition of two (2) multi-product dispensers (MPDs); creating four (4) additional vehicle fueling positions (VFPs). The expansion will result in a larger fuel facility with seven (7) MPDs and fourteen (14) VFPs and an expanded fuel canopy of 43 feet by 126 feet or 5,418 square feet. The existing cashier's kiosk and underground storage tanks (USTs) will not be affected by this expansion. Existing signage will be removed for construction and reinstalled in similar locations on the expended canopy; no increase in sign surface area is proposed. To improve onsite circulation and promote more efficient queuing, in accordance with the approved site plan, Fred Meyer will remove fifty-four (54) parking spaces and relocate four (4) landscape planters and provide appropriate landscaping and additional mitigation/tree replacement in accordance with code requirements and the conditions of approval mandated by the review process. This project was initially reviewed and approved by the City of Meridian's Planning and Zoning Commission on December 16, 2010, with the subsequent publication of required findings on January 6, 2011. The expansion will result in a larger fuel facility with seven (7) MPDs and fourteen (14) VFPs. While traffic/trip generation will increase proportionately, preliminary consultation with Ada County Highway District staff indicates an updated traffic impact analysis will not be required; however, Upon receipt of revised development plans, Ada County will calculate additional traffic impact fees. Additional MPDs/VFPs dictate enlarging the canopy from its current dimensions (43' x 92' / 3,956 square feet) with an expansion (43' x 34' / 1,462 square feet). The size of the completed expanded canopy will be 43' x 126' or 5,418 square feet. The existing cashier's kiosk and underground storage tanks (USTs) will not be affected by this expansion. The expanded canopy's construction and materials will be similar to the current canopy and remain classified as Type II-B Construction and Group M Occupancy. Existing signage will be removed for construction and reinstalled in similar locations on the expended canopy; no increase in sign surface area is proposed. To improve onsite circulation and promote more efficient queuing, Fred Meyer proposes to remove fifty-four (54) parking spaces; leaving the Fred Meyer retail operation with 796 parking spaces -exceeding Meridian's parking requirement. As part of this improvement, Fred Meyer also proposes to relocate four (4) landscape planters and provide appropriate landscaping and mitigation/tree replacement in accordance with code requirements. Design Criteria Compliance The design elements of this proposed expansion have been constrained by the previously approved plans for a Fred Meyer retail fuel facility onsite; approved/permitted as a conditional use by the City of Meridian, under Case No. CUP-01-005, in May, 2001. Table 1, Design Criteria Compliance, included as part of our Design Review submittal, provides apoint-by- point comparison of this project's design elements. Fred Meyer is proposing a commercial project designed to continue, expand and enhance the design elements already defining the site, through the existing fuel facility. The existing structure iswell-integrated with the surrounding properties and uses, and while minor changes will result from the expansion proposal, no major impacts will be experienced by any of those properties or uses. City of Meridian Project Narrative February 14, 2011 Compliance with Conditions of Approval In response to the conditions of approval outlined in the Planning and Zoning Commission Findings, MCU 10-003, dated January 6, 2011, full compliance will be documented on all specified items, as submitted and confirmed by plan review during the construction permitting process. Specifically with this submittal, the following items have been addressed as noted, to verify compliance on issues of immediate concern: PLANNING DEPARTMENT 1.3 The landscape plan prepared by Barghausen Consulting Engineers, dated 09/09/10, labeled PL-1, is approved with the following changes: • The new landscape island proposed along the east side of the 6 parking stalls that front along the E. Fairview Avenue landscape buffer shall be planted in accord with UDC 11-3B-8C.2.d. Response: BCE has revised the landscape plan to accommodate the required planting. FIRE DEPARTMENT 3.1 Provide signage ("No Parking Fire Lane") for all fire lanes and all entryways into the site in accordance with International Fire Code Sections 503.4 and D103.6. Response: BCE has provided the required signage along the fire lane as indicated on our revised site plan; should the Fire Department desire additional signs and/or placement in a different location or vary the spacing along said fire lane, BCE will revise the plans accordingly. 3.2 Fire lanes, streets and structures (including the canopy height of mature trees) shall have a vertical clearance of 13'6" as set forth in International Fire Code 503.2.1. Response: As designed, the fuel canopy provides adequate vertical clearance to fully comply with code. With the relocation of landscape planters, the presence of mature trees in the immediate vicinity of the fuel canopy is unlikely. Ongoing maintenance will assure ongoing compliance with the vertical clearance requirements of new landscape plantings, as maturity is achieved. PARKS DEPARTMENT 5.1 Protect any existing trees on the subject property that are greater than four-inch caliper and/or mitigate for the loss of such trees as set forth in UDC 11-3B-10. Response: The proposed landscape plan, as revised, provides mitigation to the extent required by Meridian code. Any trees which may be impacted by construction activity will be protected to the maximum extent possible, and replaced as needed, if damaged during construction. ADA COUNTY HIGHWAY DISTRICT Preliminary ACHD review indicated no traffic study was required, but that standard plan review would be required for the calculation of traffic impact fees associated with the additional dispensers and vehicle fueling positions being installed. A standard lighting plan addressing all of these issues has been developed for each typical canopy configuration used at Kroger supermarket petroleum facilities, and each design is in compliance with the "Recommended Illuminances for Outdoor Service Station Environments" as included in the current edition of the Recommended Practice for Liahting Merchandise Areas published by the Illuminating Engineering Society of North America (IESNA RP-2-01 ). It is important to note that the recommended illuminance values shown in the IESNA RP-2-01 document are "target maintained levels", not "initial foot-candle levels". Since the lumen output of all light sources will depreciate over time, an accepted industry standard for an average maintenance light level factor (LLF) for metal halide lamps is 0.72. If local zoning regulations require light levels less than that provided with our standard lighting plan, a variance to the regulation should be requested and diligently pursued.
