No signs are approved by the issuance of this certificate. All new signs require a sign permit from the City of Meridian prior to installation. Landscapirta: Landscaping shall be installed as depicted on the approved Landscape Plan (stamped 4-10- 02). Weed Control: The undeveloped portion of the property along the south property line must be improved with landscaping (i.e. wildflowers) and irrigation to keep the area free of weeds. Sidewalks: Sidewalks along Fairview are existing and will not have to be replaced as part of this project. New sidewalks will be required along Hickory Ave., which may be attached or detached at the developer's option and as approved by the ACRD. Li_.ghtina: All new lighting, whether attached to the building or placed within the parking area, shall not cause glare or impact the traveling public or neighboring developments, as determined by the City. Parkins: Car washes are not a listed use in the Parking Schedule, so the applicant has submitted a letter stating the anticipated parking needs for the project. The proposed parking is approved as depicted on the approved site plan (stamped 4-10-02). Trash Enclosure: The proposed trash enclosure shown on the approved plans have been approved by SSC and shall be built as shown. ADA: All construction and site improvements shall be in compliance with the Americans with Disabilities Act (ADA). Architect shall certify that the proposed project meets federal accessibility requirements. Future Building The proposed future building shown on the site plan has not been reviewed and is not approved. Separate application must be filed with the City for this project in the future. ~ ~ Certificate of Occupancy: All required improvements must be completed or installed prior to obtaining a Certificate of Occupancy. A temporary Certificate of Occupancy may be obtained by posting a bond or other certified funds in the amount of 110% of the improvements that remain to be completed. ACRD Acceptance: Applicant shall be responsible for meeting the requirements of ACHD as they pertain to this development. All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACRD requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning Staff for approval prior to the issuance of a building permit. Plan Modifications: The Site Plan is not to be altered without prior written approval of the Planning & Zoning Department. No field changes to the site plan are permitted; prior written approval of all changes is required. Corner of Fairview Ave. and Hickory eta project no. 011202 Dear Steve: Thank you for considering this Certificate of Zoning Compliance (CZC) Application. As we have discussed in our previous meeting, we at erstad thornton architects, are beginning to move forward on the Water Works Car Wash project. As the contents of the CZC application requires a written statement from the applicant detailing the proposed use of the S.W. corner of Fairview Ave. and Hickory, such is the intent of this letter. Water Works Car Wash is just as the name states, a car wash. This car wash will provide customers with the option of automatic or manual service for the exterior of the vehicle. Manual vacuum service will also be provided for the interior of vehicles. To provide such previously explained services, the site itself will be organized strategically with customer safety, satisfaction, vehicle flow and quality architectural and landscape elements meshed together. In our effort to make this car wash safe to the public, we have provided a design that allows each individual customer to see and be seen from Fairview Ave. and Hickory. We also intend to provide even evening and nighttime lighting for customers throughout the site, with out glare or hazardous lighting conditions for on coming traffic. Secondly, a special effort to provide customer satisfaction will be achieved with a well designed radiant heated concrete skirt on all spray stalls. This is an effort to keep ice and snow buildup from developing in the winter months. Thirdly, vehicle flow (to include customer and service vehicles) will be provided with two new curb cuts. The first proposed curb cut will exist on the northwest corner of the property, or Fairview Ave. access to the Water Works Car Wash. The second proposed curb cut will exist on the southeast corner of the property, or Hickory access. In coordination with Kristy Richardson with ACHD and Bill Gregory with SSC, these would appear to be the most logical placements for vehicular access. Finally, architectural elements will consist of clean designs for two concrete masonry buildings and two different canopy designs for vacuum stations and spray stalls. The two concrete masonry buildings will contain above ground utilities necessary for such proposed services. Thank you for your consideration on this matter. After discussing this issue with our Legal Department, it has been established that those access points were designated on the plat at the time that Fairview Avenue was under the jurisdiction of ITD. The proposed driveway location as indicated on your plans, meets ACHD policy. However, there is another driveway located just to the west that is allowed by the note on the plat. If the owner of the developing parcel and the parcel to the west are agreeable to a shared driveway, then it should be assumed that no driveway should be constructed in the location that is noted on the plat, as both driveways would not be in conformance with Policy. Therefore, please submit a letter from the property owner to the west that acknowledges that a driveway wilt not be approved in the location as designated on the plat if the proposed MCZC02-011 driveway is constructed; and that future driveway locations for that parcel will have to be reviewed by ACHD and will be assessed under the ACRD Policy Manual that is in effect at that time. This letter will be required prior to plans acceptance by ACHD. Also, ACRD Legal staff is working on an indemnification agreement with relation to the proposed driveway location. That document may not be prepared in time for plans acceptance, so this agreement will be required prior to occupancy. Thank you for following through with the Ada County Engineer with regards to the plat notations. I hope that you have also had discussions with the City of Meridian regarding this issue. The Ada County Highway District (ACHD) staff has received the above referenced application- requesting certificate of zoning compliance approval to construct a carwash consisting of 2- automatic bays with 8-additional self-service bays. The 1.70-acre site is located on the southwest corner of Fairview Avenue & Hickory Avenue. This development is estimated to generate 290 additional vehicle trips per day (0 existing) based on the Institute of Transportation Engineers Trip Generation Manual. B. The application and site plan stamped and received by the City of Meridian on March 20, 2002, and submitted to the District on March 25, 2002, has been reviewed by the ACHD Planning and Development staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. C. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conform to District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. D. On April 1, 2002, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On Apri15, 2002, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. For the purposes of estimating daily trip generation and assessing impact fees for this project, the proposed use of this development has been classified as Carwash. (Per the ITE Manual) The impact fee rate from the fee tables for this use is $1,059 per stall, based on the impact fee ordinance in effect at this time. Note: This rate is provided for informational purposes only and shall not be construed as an impact fee rate certification. The impact fee will be assessed at the time of plans acceptance by District staff, and shall be based on the fee tables and provisions of the District's Impact Fee Ordinance in effect at that time. F. Development patterns in the surrounding area are commercial along Fairview Avenue giving way to residential. To the north of the site is an undeveloped parcel and church facility. To the south of the site is Food Service of America. To the west of the site is undeveloped. To the east of the site is Treasure Valley Business Center/Great Floors G. Fairview Avenue is a classified principal arterial roadway. Fairview Avenue is improved with 5- traffic lanes with curb, gutter, and sidewalk. Fairview Avenue is currently 45-mph. There is 120- feet ofright-of--way, and no additional right-of--way is required with this development. The applicant has approximately 300-feet of frontage on Fairview Avenue and is proposing to locate a shared driveway on Fairview Avenue approximately 290-feet west of the intersection of Fairview Avenue & Hickory Avenue. The proposed driveway will be shared between this site and the parcel to the west. District policy requires that driveways align or offset a minimum of 230-feet from any driveway or street (based on the speed limit of 45-mph). Treasure Valley Business Center Phase #I, plat note # 5 states; Additional private access points (maximum of 4) will be allowed on Fairview Avenue at not less than 400-foot intervals from other access points. H. Hickory Avenue is a classified collector roadway. Hickory Avenue is improved with 2-traffic lanes with no curb, gutter, and sidewalk abutting the proposed carwash site. There is sidewalk across the street abutting Great Floors. A traffic island (approximately 220-feet in length) was constructed with Hickory Avenue. There is 80-feet of right-of--way, and no additional right-of- way is required with this development. The applicant has approximately 300-feet of frontage on Hickory Avenue and is proposing to locate a driveway on Hickory Avenue approximately 220-feet south of the intersection of Fairview Avenue & Hickory Avenue. District policy required that driveways align or offset a minimum of 175-feet from any driveway or street at a controlled intersection. The proposed driveway meets District policy and should be approved with this application. I. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Fairview Avenue and Hickory Avenue intersection is slated for signalization in 2007. The following requirements are provided as conditions for approval: Site Specific Requirements: 1. Treasure Valley Business Center Phase #I, plat note # 5 states; Additional private access points (maximum of 4) will be allowed on Fairview Avenue at no less than 400-foot intervals from other access points. The proposed driveway on Fairview Avenue located approximately 290-feet is not approved with this application. 2. Construct the driveway as proposed on Hickory Avenue approximately 220-feet south of the intersection of Fairview Avenue & Hickory Avenue. 3. Pave the driveway as proposed to its full-required width of 24 to 30-feet and to a point 30-feet beyond the edge of pavement of Hickory Avenue with 15-foot curb radii tapers abutting the existing roadway edge. 4. Construct a 5-foot wide concrete sidewalk on Hickory Avenue located 2-feet within the right- of-way. Coordinate the location and elevation of the sidewalk with District staff. If the sidewalk meanders outside of the right-of--way, provide an easement for the sidewalk 5. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. The Commission shall hear and decide appeals by an applicant of the final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or enforcement of the ACHD Policy Manual. a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged the applicant for the processing of appeals, to cover administrative costs. b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary of Highway Systems, which must be filed within ten (10) working days from the date of the decision that is the subject of the appeal. The notice of appeal shall refer to the decision being appealed, identify the appellant by name, address and telephone number and state the grounds for the appeal. The grounds shall include a written summary of the provisions of the policy relevant to the appeal and/or the facts and law relied upon and shall include a written argument in support of the appeal. The Commission shall not consider a notice of appeal that does not comply with the provisions of this subsection. c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of the filing of the notice of appeal to reply to the notice of the appeal, and may during such time meet with the appellant to discuss the matter, and may also consider and/or modify the decision that is being appealed. A copy of the reply, and any modifications to the decision being appealed will be provided to the appellant prior to the Commission hearing on the appeal. d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal will be noticed and scheduled on the Commission agenda at a regular meeting to be held within thirty (30) days following the delivery to the appellant of the ROWDS Manager's reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal and the reply shall be delivered to the Commission at least one (1) week prior to the hearing. e. Action by Commission: Following the hearing, the Commission shall either affirm or reverse, in whole or part, or otherwise modify, amend or supplement the decision being appealed, as such action is adequately supported by the law and evidence presented at the hearing. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #195, also known as Ada County Highway District Road Impact Fee Ordinance. 3. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACRD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 4. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 5. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The final determination for "cxluivatents" rests with the Architect. Their decision shall be final and binding. 1.11 WARRAIV'I'Y A. Waranty system against dcfcxts of installation and material for a period of 1 year after acceptance of the irrigation system. Guarantee shall also cover repair or damage to any part of the premises resulting from leaks or other defects in material, equipment and workmanship to the satisiasxion of the Architect. Repairs, if required, shall be done promptly upon notification by the Owner, and, at no cost to the Owner. B. As part of the warranty, the Contractor shall be responsible for deactivating and wintetizittg the system prior to the onset of the freezing season and for reactivating the system at the onset of the spring growing season; each event must be accomplished once during the warranty period. In the event the system is completed in a season when it will not be in use, the Contractor shall ~vinterizc the system upon completion of testing (and approval by the Architect) and reactivate the system in the spring. The Contractor shall SUBMIT a fetter to the Architect certifying that the system was winterized and drained and indicate the date such action was accomplished. The Contractor shall be responsible for any damage resulting from failure to comply. Contractor shall instruct noel demonstrate winterization and startup techniques for Owner. Adjust nozZie apray pauern as required to avoid water spray on building walls, roads or sidewalks. 3.14 CLE,~-NiNG AND ADJUSTING A Flush dirt and debris from piping before installing sprinklers and other devices. B. Adjust automatic control valves to provide flow tart of rated operating pressure required for each sprinkler circuit. C. Carefully adjust lawn sprinklers so they wi)[ be flush with, or not more than 2 inch (13 mm) above, finish grade after completion of landscape work. Adjust so that sprinklers do not spray on buildings or walls. D. Adjust settings of convollers and automatic control valves to insure proper watering of all landscaping. 3.15 COMMISSIONING A. Starting Procedures: Follow manufacturer's written procedures. If no procedures are preaa:ribed by manufacturers, proceed as follows: 1. Verify that specialty valves and their accessories have been installed correctly and operate correctly. 2. Verify char specified tests of piping are complete. 3. Check that sprinklers and devices are correct type. 4. Check chat damaged sprinklers and devices have been replaced with new materials. ~. Check that potable water supplies have correct type back-flow preventers. 6. Energize circuits to electrical equipment and devices. 7. Adjust operating controls. $. Operational Testing: Perform operational testing after hydrostatic testing is completed, b«ckflll is in place, and sprinklers are adjusted to final position. 3.16 DEMONSTRATION A. Provide irrigation system demonstration under prvvisions of Section Oib50. Record on VHS video format. B. Demonstrate to Owner: that system meets coverage requirements and that automatic control functions properly. C. Demonstrate to Owner maintenance personnel operation of equipment, sprinklers, specialties, and accessories. Review operating and maintenance information including start up and winterization procedures. D. Provide 7 days' written notice in advance of demonstration.
