Scope of Development: This Certificate of Zoning Compliance shall be valid for only the 23,296
square foot addition to the existing Capital Christian Center.
Landscaping: All existing landscaping shall be protected and maintained as depicted on the approved
site plan (stamped 04-03-02).
Li t• :All new lighting, whether attached to the building or placed within the parking azea, shall
not cause glare or impact the traveling public or neighboring developments, as determined by the
City.

ADA: All construction and site improvements shall be in compliance with the ADA.
Sidewalk: Afive-foot (5') wide sidewalk shall be installed as depicted on approved site plan prior to
the issuance of a final Occupancy Permit.
Certificate of Occupancy: All required improvements must be completed or installed prior to
obtaining a Certificate of Occupancy. A temporary Certificate of Occupancy may be obtained by
posting a bond or other certified funds in the amount of 110% of the improvements that remain to be
completed.
ACRD Acceptance: Applicant shall be responsible for meeting the requirements of ACRD as they
pertain to this type of development. All impact fees, if any, shall be paid prior to the issuance of a
building permit. If any changes must be made to the site plan to accommodate the ACRD
requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning Stafffor
approval prior to the issuance of a building permit.
Plan Modifications: The Site Plan is not to be altered without prior written approval of the Planning
& Zoning Department. No field changes to the site plan are penmitt~i; prior written approval of all

generated, then ACRD will review the site plan and may issue requirements based on the ACRD Policy Manual.

Dear Shari,
Thank you for'the long meeting Bob Henbest and I had with you a couple of weeks ago in
regards to'Capital Christian Center. The church is low on the mave`again to complete
final occupancy on their present building. This of course includes landscaping at the
parking lot, parking lot lighting and then also the completion inside the current building.
As you may remember from our meeting, Bob Henbest will be completing the landscaping
from the east pump house all the way around the south side of the building and site, and
then up along the length of the west adjacent properties.
Once these-tasks are completed, Bob Henbest from the church will call upon the
appropriate departments to review final sign off approval and to obtain final occupancy.
In review of the possible future plans for the church we discussed the following at our
meeting together:
1. The church desires to plan an eventua13,000 seat auditorium, possibly phased
by going to l'700 seats first and expandable to 3,000 later. In our initial planning,
we know. we can adequately parkthis and accommodate required landscaping.
2. Obviously a conditional use permit will. be required for .this development. We
desire to keepyou appraised of the development of the masterplan and wilt `
continue. a dialogue with'you in regards to the requirements for submitting fore
a GI.JP.

3. I have obtained the zoning code and aware of the requirements for this zone.
Most requirements are very achievable including the requirement for
open space and one 3" caliber tree of landscaping per 1500 sq ft. of parking.
However the 35' building height requirement may be undesirable from an
structural and architectural stand point especially in the interior of the sanctuary.
The church may elect to ask for a higher limit through the CUP process and it is
our understanding this is possible to apply for in the CUP (rather then pursuing a
. variance process): Do you have any further recommendation in regards to this?
4. As we commence and continue in this process with the church and working with
the city, it would be extremely helpful if the city could retrieve past files in
regards to Capital Christian. If they have been move to the. city archives, is it
possible to request they be removed for copy?
I will be back again on August 7th and 8th to meet with the church. As we finalize the
overall site plan, I would like to set up another meeting .with you Shari so you can be kept
informed on the church progress. This likely will be sometime in late August or early
September.

The purpose of this meeting was to determine what would be required by the City

1. The original Conditional Use Permit will cover this project. Floor plan

improvements at Capital Christian Center. After meeting with the Elders of the church,
architects and landscaping contractor, we offer the following responses.
Parking lot fixtures and poles have been ordered and are scheduled for installation on
or before March 21, 1996. We will be installing three new poles and relocating the
existing pole.
Our landscaping contractor is preparing a detailed drawing of our proposed
landscaping between the south side of our building and Fairview Ave. We will be
submitting this drawing next week to the City of Meridian for your approval before work
starts.
Upon your approval, CCC will submit a detailed timetable outlining the completion of
the landscaping.
We hope the above mentioned responses will meet with your approval.. Thanks again

The meeting kicked off with introductions. Gary Smith, Meridian City Engineer, then led the discussion
with a general description of the imgation return flow (i.e., waste flows), drainage and irrigation situation
in the subject area. Generally, the existing system was described by Gary as a system of inadequately sized
open drainage ditches and some piping (of appazently adequate capacity to handle waste flows).
Performance of the system is impacted by the deposition of water-home silt when Mows transition from
piped to ditched conveyances. (The example discussed was the current deposition of silt on Ewing's
property.)
Councilman Morrow stated that in his opinion Don Bryan's place is being flooded and Aschenbrenner is
being damaged by the performance of the existing system. He further stated that Meridian has intended to
issue constructive notice if the drainage system is not operating properly by April 15, 1995. Finally, the
city's position is that the cost of the solution will not be the sole responsibility of the AVEST project as the
problem is being caused primarily by properties from the Shoshone Center upstream.
Jim Aschenbrenner described the JMK irrigation system. Areas irrigated by Aschenbrenner include the
SE'/2 of the SE'/. of Section 5 (the 80 acre parcel at the NW comer of Eagle Rd. and Fairview Ave.) plus
ground to the east of Eagle Road along Fairview Ave. Aschcnbrenner's best estimate ofmaximum irrigation
runoffdue to his agricultural practices on these lands is 300 (miners) inches. (Note: 1 miner's inch = 9.05
gal/min.) [Three hundred miner's inches (ldaho units) equals 2,? 16 gaVmin = 6.05 ft lsec.]
Aschenbrenner also stated his intention to excavate silt basins before irrigation season on the downstream
end of his agricultural operation. This should help alleviate downstream problems.
John Anderson initiated a discussion on the Jackson Stub, including the feat that the NMID's most westerly
jurisdiction on the Stub extends froth the Jackson Drain westerly to the right-of--way for Locust Grove Road.
The NMID claims no jurisdiction either under the Locust Grove right-of--way or to points easterly of the r/w.
The NMID has concerns regarding the current capacity of the Stub and will resist any efforts to add
additional flow in the future.
A round-house discussion followed on the history of irrigation and drainage in the area, including the
Jackson Stub and areas which drain into the Stub. A brief discussion ensued concerning the 5 acre parcel
immediately west of Locust Grove and immediately south of the Stub. By the account ofBryan, the owner

of the property moved out in 1992 and the property has not been irrigated since. Mr. Aschenbrenner, 5r.
also mentioned that it was his impression that under a previous arrangement during dcvelopmen[ of Chateau
Meadows (Blaser), this landowner had his delivery re-routed from the north through Chateau Meadows_
Delivery of irrigation water to Ewing and the Shoshone Center was also discussed. the opinion of the
NM1D was that since the Shoshone Center property was greater than 5 acres, the property would not be
excluded from the NM1D roles and delivery to the property would remain as a District requirement_
Drainage provisions for the property would also be required. Details were left to be worked out by the
owners of Dove Meadows and the Shoshone Center.
The Iast genera! topic discussed was the status of the drain and delivery feed at Bryan's property. AVEST,
within the last two weeks, has cleaned the ditch in front of Bryan's property and relocated the waste ditch
away from his southerly property line. In the opinion of both Bryan and J. Aschenbrenner, the temporary
ditch will work properly. Both gentlemen were also of the opinion that the 15 inch diameter corrugated
metal pipe under Bryan's driveway was adequate to handle any anticipated waste flows.
1~e meeting concluded with a summary by Councilman Morrow. The summary was as follows:
1. To the best of the knowledge of the parties involved, the 15 inch diameter CMP under Bryan's
driveway and frontage is adequate to handle waste !lows.
2. The temporary drainage ditch installed by AVEST should function properly in keeping waste flows
from flooding Bryan's property.
3. In light of Items 1 and 2 above, the short-term problem is solved.
4. !n the long-term, AVEST will cooperate with. the city of Meridian in developing a solution on the
drainage (waste and storm) situation.
5. The developers of Dove Meadows will work with AV]/ST in the routing and sizing of waste flow
lines.
Following review of these minutes, please inform Quadrant Consulting of any significant deviations from
your recollection of the events at your earliest possible convenience. Unless notified prior to Tuesday, April
4, 1995, the minutes as prepared herein will be submitted to Council on April 4, 1995.
