Comments: The original Site Pan for Roaring Springs Water Park was approved through a
Conditional Use Permit approved by City Council on 12-15-96 All original conditions must be met
for this new ride In addition a Lot Line Adjustment (No 5653) was approved by the CiV Engineer
on 1 10-02 that expanded the Bowden Properties/RoaringSprings Lot 9, Block 1 to the east to allow
adequate space for the Avalanche ride.
Approved Plan: The Site Plan (Sheet C1.1), stamped 1-16-02, is approved.
Landscaping: Per condition # 1.1.17 of the Decision and Order of the original CUP, a minimum 20 -
foot landscape setback is required beyond the I-84 right-of-way. The Landscape Plan (Sheet LS -1) is
approved, with the exception of relocating the three Austrian Pine trees outside of the existing
irrigation and sanitary sewer easements. Applicant shall submit a revised Sheet LS -1 showing the
relocated trees prior to issuance of the building permit. All other landscaping, including the berm and
groundcovers, shall be as per Sheet LS -1, dated 12-5-01.
Parkin : No new parking is proposed with this application. However, as noted in the Certificate of
Zoning Compliance issued on 1-30-01, overflow parking has been frequently observed on the vacant
lot east of the Roaring Springs park. The City recognizes Bowden Properties does not own or have
control over the use of Lot 17 of Interstate Center Subdivision, the adjacent property to the east. We
also recognize that, as noted in Mr. Lee Hovis' 12-18-01 letter, Roaring Springs LLC cannot enforce
parking regulations on said property and that the existing parking lot should be adequate to meet park
capacity. However, the City strongly encourages Roaring Springs to work with the owner of Lot 17
to clearly sign that property as a "No Parking" area and if necessary to exercise prlv_ate penalty
enforcement to get the water park users to utilize the paved off-street parking lot instead of
unimproved vacantr� o, und.
Lighting: Lighting -shall not cause glare or impact traveling public, as determined by City.
Signage:, No free-standing signage is shown or proposed. A separate sign permit and approval process
is required for all free-standing and wall signs.
Drainage: This Site Plan and Certificate will be sent to the Public Works Department for review. If
applicable, Applicant shall be responsible to comply with all drainage requirements determined by
Public Works.
Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas.
Bonding: All site improvements must be completed or bonded for at 110% of the incomplete amount
prior to P&Z Department signature of Certificate of Occupancy.

The applicant is requesting conditional use approval for a family water park. The 1493 -acre site
is located on the north side of Overland Road, approximately 600 -feet west of Meridian Road.
This development is estimated to generate 3,000 additional vehicle trips (3,000 total) per day
based on the Institute of Transportation Engineers Trip Generation manual.
This application was approved by the Commission on December 23, 1998. At the request of a
neighborhood's representative the Commission voted to reconsider this item at the meeting of
December 30, 1998. The neighborhood's representative sent a letter stated their withdrawal of
opposition on January 12, 1999. This application is placed on the consent agenda for approval.

Overland Road is improved with 2 lanes of pavement with no curb, gutter or sidewalk.
On November 29, 1995, the Commission reviewed and approved Interstate Center Subdivision,
a 26 -lot commercial subdivision on 39.06 -acres. That site was estimated to generate 7,800
additional vehicle trips per day if developed as a business park of commercial use. A traffic
study was submitted for that application. The current application covers approximately 60% of
the original subdivision.
Utility street cuts in new pavement less than five years old are not allowed unless approved in
writing by the District. Contact Construction Services at 387-6280 (with file numbers) for
details.
4. State Highway 1-84 is under the jurisdiction of Idaho Transportation Department (ITD).
Application materials should be submitted to ITD for review and requirements of that
Department and the applicant should submit to the District a letter fi-om ITD regarding said
requirements prior to District approval of the final plat or issuance of a building permit (or
other required permits), whichever occurs first. The applicant may contact District Ill Traffic
Eng=ineer Walter Burnside at 334-8340.
District policy requires the applicant to construct a 5400t \vide concrete sidewalk on Overland
Road abutting the parcel. The sidewall: should he located two feet within the nc\\ right-of-wav
of Overland Road. Coordinate the location of the sidewall: with District staff.
6. The applicant is proposing to construct a 24 -foot wide driveway on Overland Road, located
approximately 630 -feet east of the west property line (between Lots 27 and 28, Block 1, of
Interstate Center Subdivision). The location of this driveway was previously approved by the
Commission in the approval of Interstate Center Subdivision. The applicant should be required
to pave the driveway its full width and at least 30 -feet beyond the edge of pavement of
Overland Road and install pavement tapers with 15 -foot radii abutting the existing roadway
edge.
7. The applicant will have additional access to the site via a private road, Blue Marlin Lane,
abutting the site's western property line. The private road was previously approved in the
Commission's approval of Interstate Center Subdivision.
8. District policy states that direct access to arterials and collectors is nonnally restricted and that
the developer shall try to use combined access points. In accordance with District policy the
applicant should be required to provide a recorded cross access easement for the parcels to the
east and west to use this parcel for access to the public streets prior to issuance of a building
pen -nit (or other required permits). The District intends to require a similar agreement of the
owners of the parcels to the east and west if they are the subject of a future development
application.
9. A traffic study has been submitted for this development. According to the traffic study, the
applicant should be required to construct a center turn lane on Overland Road between the
private road and driveway intersections. The turn lane should be constructed with shadow
tapers for both the approach and departure for the center turn lane. The applicant should also be
required to construct a deceleration taper on Overland Road for the eastern driveway/Overland
Road intersection. The deceleration lane should be constructed beginning at a point 90 -feet east
of the driveway/Overland Road intersection tapering to a width of 9 -feet wide. Coordinate the
design of the turn lane and deceleration taper with District staff. A deceleration taper has
previously been constructed for the private road.
10. As required by District policy, restrictions on the width, number and locations of driveways,
may be placed on future development of this parcel.
11. The existing transportation system will be adequate to accommodate the additional traffic
generated by this proposed development with the requirements outlined within this report.
The following requirements are provided as conditions for approval:

Standard Requirements:
A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the ACHD Planning and Development Supervisor. The request
shall specifically identify each requirement to be reconsidered and include a written explanation
of why such a requirement would result in a substantial hardship or inequity. The written
request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for
ACHD Commission action. Those items shall be rescheduled for discussion with the
Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action
do not provide sufficient tinge for District staff to remove the iteral from the consent agenda and
report to the Commission regarding the requested modification. variance or waiver. Those

of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein.
The applicant shall submit revised plans for staff approval, prior to issuance of building pen -nit
(or other required penults), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.
Conclusion of Law:
9. ACRD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

Dear Mr. Hawkins -Clark:
This letter is in response to your request concerning our Certificate of Zoning Compliance application
for our new attraction. I agree that items 1 and 2 of your request can easily be resolved. There does
seem to be a considerable misunderstanding in regard to parking availability. At no time during the
2000 or 2001 season did the parking lot ever reach capacity. There have been times when our guests
elected to park outside of our lot. During those times however our parking lot still had spaces available.
This includes our biggest attendance days on record (5503 on June 30, 2001 and 5544 on August
25, 2001). Our daily attendance has never been close to reaching those days. Our in park capacity is
approximately 3000 visitors at one time. The eastern property adjacent to the park is no longer owned
by Roaring Springs Water Park L.L.C. therefore we can not enforce parking regulations on property that
does not belong to our company. I have included the park attendance figures for both the 2000 and
2001 seasons. As documented on the enclosed forms, the park experienced a decrease in attendance
of over 21,000 people. Furthermore, the success of our waterpark depends on repeat business. Based
on surveys conducted over the past two years, this attraction is needed to ensure that our guests do
not become bored with the same attractions and continue to enjoy the waterpark. We are not
expecting to increase capacity but we do want to maintain our current attendance. In our opinion, there
is no need for additional parking and I am formally requesting that you approve our request for the new
attraction. Jim Kinsey, our Park Engineer, and I will make ourselves available to discuss this matter
further.

I am in receipt of your application for a Certificate of Zoning Compliance for a new ride
at Roaring Springs, submitted to our office on 12-11-01. I have reviewed the plans and
below are my review comments:
1. Lot Line Adjustment (LLA): During our phone conversation, you said that
Pinnacle Engineers prepared and recorded a Record of Survey to adjust the east
boundary line of Lot 9, Block 1 to create the additional 98 feet necessary to
accommodate the new ride. I left a message for Pinnacle Engineers to provide a
copy of said LLA. However, I do not show any evidence of the City Engineer's
approval of the LLA application and accompanying Record of Survey. I will
await a copy of Pinnacle's approved LLA and ROS. If our City Engineer did not
stamp the ROS with his approval, this will need to be done prior to issuance of a
CZC from our department.
2. Landscaping: It appears the three (3) Austrian Pine trees proposed along the north
boundary lie within the NMID ten -foot irrigation easement and the city's 20 -foot
sewer easement. Please review the plat, easements, and tree locations. If this is the
case, the landscape buffer between the Avalanche ride and I -84's right-of-way
will need to be increased in width to accommodate the trees. (See Ordinance 12-
12-4.10.B.)
3. Pte: Please see the attached Certificate of Zoning Compliance for the 212 s.f
vendor space expansion, issued on 1-30-01 by Steve Siddoway. As noted in the
second paragraph, you were requested to provide a letter to the City, stating how
Roaring Springs intends to address the lack of adequate off-street parking. Our
records do not show that this letter was ever received. Roaring Springs received a
Conditional Use Permit (CUP) granting approval for the existing rides and
parking area. However, now that the original CUP is being amended through the
construction of a new ride, the off-street parking must be adjusted to meet the
needs of the potential increased user traffic. Please reply to the 1-30-01 request
with a letter explaining Roaring Springs off-street parking capacity, anticipated
increase in ridership and what, if any, modifications to the parking lot you
propose.
Jim, once I receive your response to these three issues, I will be able to complete my
review of the CZC application. It appears that Items 1 and 2 can be resolved
promptly. I will review your letter regarding Item 3 with Shari Stiles, Planning
Director, and hopefully we can meet and come to a resolution.

zoning and development ordinances. Therefore, the project is granted this Certificate of Zoning
Compliance (CZC).
However, the site parking currently available is inadequate to meet the parking demand. Customers
regularly park on the dirt lot east of the water park. Planning & Zoning staff have witnessed several
days last summer when no parking was available in the entire Roaring Springs parking lot. While
we are pleased that the park has been successful, we are also anxious to correct the ongoing parking
problem. Therefore, Roaring Springs is hereby put on notice that a parking solution must be worked
out with the City of Meridian prior to the issuance of a CZC for any future development or site
improvements that require a building permit. Please respond to this concern with a letter stating how
Roaring Springs intends to address the parking issue. Staff would like to see the vacant lot east of
the water park (where customers park regularly) developed into a parking lot.
The plans stamped 1/30/01 are approved with the comments noted above.
