Conditions of Approval: Pad is subject to all terms and conditions of existing C.U.P. for The Family
Center (as approved on 10-20-98) for the site. City's failure to specifically identify all
requirements of the C.U.P. in this Certificate of Zoning Compliance does not relieve owner
of responsibility for compliance.
Si na e: All signage is subject to design review and shall require a separate permit. No signage is
permitted in ACHD right-of--way. No temporary signs shall be permitted.
Li hg tiny: All external lighting shall be down shielded, hooded or of the forward throw variety, so as
not to directly illuminate or cause glare to spill onto any adjacent property or roadway.
Parkui~:
1. The official "Schedule of Parking Space Requirements", 1 l -13-5 of the Meridian City Code,
requires 1 parking stall for every 200 square feet of floor area for restaurants, thus requiring
a minimum of 27 parking stalls for this part of the shopping center. However, when this
project was approved (10-28-98), parking was determined based upon the square footage for
the entire shopping center. The submitted parking calculations indicate that the existing
parking, minus the 15 parking stalls to the north of the restaurant and the addition of the 12
stalls adjacent to the west side of the building, meets and exceeds the parking requirements
as set forth in the original conditions of approval.
2. No compact stalls were approved under the original Conditional Use Permit, therefore the 15
compact stalls indicated on the submitted site plan are not acceptable and shall conform to a
minimum length dimension of 17', providing a 2 foot overhang over the landscape island. The
new parking lot landscape island must be moved 2' to the south, reducing the driveway aisle
located just north of the building to 22 feet wide as indicated by the redlines drawn on the
submitted site plan.

3. The 17' long stalls located adjacent to the west side of the building shall be permitted based
on the fact that the adjacent sidewakc is 6.5' wide, thereby allowing for an 18" over hang of
the front end of vehicles and still maintaining the 5' wide minimum requirement for sidewalks.
ADA Requirements: The handicap accessible stalls located on the western side of the restaurant must
be enlarged (from 5' to 8' wide) to accommodate a shared van aisle. This change will cause
one standard parking stall to be eliminated on the western side of the building. Please refer
to the red lines on the submitted site plan. Please reconfigure the parking to reflect this
change. Additionally all construction and site improvements shall meet the minimum
requirements of the Americans with Disability Act.
Landscaping All landscaping shall be installed as submitted on the approved site plan. No
substitutions shall be permitted without the written consent of the Planning and Zoning staff.
All dead or diseased plants shall be replaced.
Underground Irri atg ion: The underground irrigation system shall be designed to provide 100%
coverage and shall be installed as submitted.
Trash Enclosure: The location and screening of the trash enclosure, as noted on the approved site
plan, shall meet minimum requirement for trash enclosures and must be approved for
construction by SSC.
Certificate of Occupancy: All required improvements must be completed or installed prior to
obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be
obtained by providing surety to the City in the form of a Letter of Credit or cash in the
amount of 110% of the cost of the remaining improvements (including paving, striping,
landscaping, and/or irrigation). A bid must accompany any request for Temporary
Occupancy.
Plan Modifications: The approved Site Plan and Landscape Plan are not to be altered without prior
written approval of the Planning & Zoning Department. No field changes to the site or
landscape plans are permitted; prior written approval of all material changes is
required.
The Site Plan & Landscape Plan stamped 03/26/01 is approved with the comments noted above.

The District has reviewed the plans for the above referenced project, and they are accepted for public street
construction. By stamping and signing the improvement plans, the Registered ingineer rnsures the District that the
plans conform to all District policies and standards. Variances or waivers must be specifically and previously
approved by the District in writing. Acceptance of the improvement plans by the District does not relieve the
Registered Engineer of these responsibilities. The District will assess the following impact fee for this project. 't'tte
impact fee must be paid prior to issuance of a building permit.
Total Impact Fee Due: $15,646.00
Standard Requirements:
1. Utility street cuts in new pavement less than five years old aze not allowed unless approved in writing
by the District.
2. All irrigation facilities must be located outside the public right-of--way unless otherwise approved by
the District. g utter and sidewalk to match existing
3, Replace dams ed curb, gutter, and sidewalk with new curb, 8 ,

4. All facilities to be constructed with a proposed development, and to be owned and mai,ntaitied by the
District, must be constructed according to the latest edition of I.S.P.W.C. and the District's

5. Submit to Idaho Department of dater Resources a Shallow Injection Well -Notice of Construction /
Inventory Form at least thirty days prior to construction of the facility. 7'he .District «ryll require a copy
of the completed form prior to granting of final occupancy.
(. Any work in the public right-of.-~~ay requires a permit from A.CI:,ID Construction Services.
7. An engineer registered in the State of Idaho shall prepare and certify all impro~~ement plans.

to allow fora 20' setback along Presidential Drive. The following is enclosed:
