The Coryell Family Trust is the owner of property located near the southeast
comer of Franklin Road and Meridian Road in Meridian, Idaho. My father
handled matters related to this matter until his demise on November 10, 2000.
My mother, Elizabeth Coryell, is the surviving Trustee for the Trust. I am the
successor Trustee to my mother.
On February 23, 2001, while in Boise, I stopped by your office to discuss this
matter and talked briefly with you. At that time, I provided you a copy of the
enclosed Notice of Public Sale. On February 26, I stopped by your office a
second time and met with you and Scott Rudel, Development Analyst for
ACRD.
In 1999, the Coryell Family Trust sold a portion of its property at the Southeast
corner of Meridian Road and Franklin Road to Home Federal Savings Bank.
Home Federal has constructed a branch bank on the property it purchased
from the Coryell Family Trust. The Coryell Family Trust retains ownership to
property to the South and East of the Home Federal property. The Surplus

Property of ACRD described above is to the South and contiguous to the
property owned by the Coryell Family Trust. In August of 2000, Cary and Lynn
Hooper purchased the ACRD Surplus Property described above from ACRD.
The concern of the Coryell Family Trust is that the Notice of Public Sale for the
ACHD Surplus Property states that "The properly is accessible from
Meridian Road, although no curb cut provides ingress/egress directly.
Shared access would have to be acquired from the property immediately
to the north or application for access requested from ACHD." There is
presently a curb cut on the easterly side of Meridian Road that exits Meridian
Road. That curb cut appears to be approximately 9-12' on the ACRD Surplus
Property purchased by the Hoopers and the remaining approximate 23' or so
of the curb cut is on the Coryell Family Trust land. The Hoopers would
presumably be entitled to the exclusive use of the approximately 9-12' of the
curb cut that is on their property. The Coryell Family Trust would presumably
be entitled to the exclusive use of the approximate 23' of the curb cut that is on
its property. No agreement for shared access has been entered into
between the Coryell Family Trust and the Hoopers.
When I met with you and Mr. Rudel on February 26, you indicated that your
office would be reviewing this matter and would advise me of the position of
ACHD. It has now been in excess of one month and I have had no
communication from you.
It is believed that the Hoopers have filed an application for a building permit
with the City of Meridian to construct a building on the property they purchased
from ACRD. It may be that the City of Meridian has relied upon statements or
representations regarding access that there is an agreement for shared
access between the Coryell Family Trust and the Hoopers. As stated above,
there is no agreement in place between the Coryell Family Trust and the
Hoopers for shared access via the curb cut on Meridian Road.
In an effort to keep the City of Meridian informed of these developments, I am
forwarding copy of this letter with enclosures to Brad Hawkins-Clark, Planner
for the City of Meridian. I am also forwarding a copy of this letter and
enclosures to Daunt Whitman of Whitman & Associates, Inc., whom I am
informed may be a contract building inspector for the City of Meridian.

ACHD approved the• existing access point for Mr. Hooper's Glass Doctor development because
approximately 10-feet of the existing driveway is•constructed on his property. ACHD also had'a copy of a
record of survey indicating cross access over the entire driveway. Apparently-tbas record of survey was never
.recorded, and therefore, there is r-ot an existing cross access between the Coryells and the Hoopers, as was
understood by ACHD stafi'.
Staff has talked with Mr. Hooper and has provided him with tfte following options:
1. Widen the existing driveway on Meridian Road to the south to provide z0-feet of sole access on the
Hooper parcel.
OR ~. ~ .
2. Close the Hooper portion of the existing driveway orl< Meridian Road .(approximately l 0-feet) and
construct a. new driveway on Meridian Road at approximately the south property line to provide sole
access ~to the Hooper property. To "close" a portion of the existing driveway, Mr. Hooper could install
vertical curbing;'benming, or landscaping to prevent motorists from usi~lg that portion of the existing
driveway; or could close lus portion of the existing driveway with curb, gutter and concrete sidewalk to
match existing improvements.
OR
3. Work out a cross access agreement with the Coryells to allclw the driveway to function iaa.its current state
and widt}l.
There has been some talk about "fencing" the property line beta-een the Coryell and Novper property. Piny
' proposed fence should be constructed and• located outside of the public right-of--way. •
