permitted in ACRD right-of--way. No portable signs or temporary signage permitted (such
as A-Frames).
Parkin :The approved site plan depicts 44 standard parking stalls and 2 handicap accessible van
parking stalls. All parking shall be striped as submitted. The handicap stalls shall be painted
and mazked in accordance with ADA requirements.
Handicap-Aeeessibility: All construction and site improvements must be in compliance with all
Federal handicap-accessibility requirements.
Landscaping: All landscaping trees shall be 2" caliper minimum. The approved landscape plan
meets the minimum requirements as set forth in the landscape ordinance. All landscaping
shall be in accordance to the approved site plan. No changes shall be allowed in the
landscape plan, unless written authorization has been obtained from a member of the
Planning and Zoning Staff.
Irrigation: An underground, pressurized irrigation system shall be installed as part of the approved
landscaping plan.
Li htin : All lighting shall be down-shielded, or of the "forward throw" variety and shall not
adversely impact the surrounding properties and right of way.
Trash Enclosure: The location and screening of the trash enclosure, as noted on the approved site
plan, meets or exceeds the minimum requirement for trash enclosures and has been approved
as noted by SSC (attached).
Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by
providing surety to the City in the form of a Letter of Credit or cash in the amount of 110%

of the cost of the remaining improvements (including paving, striping, landscaping, and/or
irrigation). A bid must accompany any request for Temporary Occupancy.
Plan Modifications: The approved Site Plan and Landscape Plan are not to be altered without prior
written approval of the Planning & Zoning Department. No field changes to the site or
landscape plans are permitted; prior written approval of all material changes is
required.

In order to process your CZC the following items must be submitted in addition to the previously
submitted information:
Landscape Plan (in accordance with the City's Landscape Ordinance) -
A copy of the "Landscape Plan Submittal Requirements" will follow this fax transmission. The
site plan that has been submitted and the plant materials schedule submitted by Family
Landscape, Inc. do not agree with each other. A new landscape plan (three copies) must be
submitted prior to approval.
Additionally, 4 feet of the required 10-foot wide landscape buffer on Baltic Place is located
within ACHD's Right Of Way. The entire buffer must be located on the property and not in the
Right Of Way.
The landscape plan must include performance specifications for the underground irrigation
system as required by the landscape ordinance.
Parking: In order to accommodate the entire 10-foot wide landscape buffer on Baltic Place, the
parking area in the front of the building must be redesigned as the driveway aisle width would

In late December, the City received a letter from the Pastor at Calvary Chapel
Meridian which, when viewed in light of the materials that accompanied the letter, can be viewed
as "threatening". Calvary Chapel Meridian has been looking for a space to locate its church and
has discussed the possibility of putting its church in leased space near the Campbell's Siding on
Baltic, north of Franklin Road. Churches are not permitted, under our current code, in Industrial
zones. As you can see from Pastor Jacobson's letter, he makes references to the Religious Land
Use and Institutionalized Persons Act (RLUIl'A), which is the federal law mandating deference
for religious uses in zoning decisions. A copy of Pastor Jacobson's letter, minus the
accompanying materials, is attached to this memo.
As I read RLUIl'A, a city is not precluded from applying its zoning ordinances to
churches, but has to be caxeful about how it does so. While churches are generally not permitted
in Industrial zones, neither are clubs and lodges, and thereby meeting places, whether secular or
spiritual are treated the same.
It would be my recommendation that the City consider amending the Zoning
Schedule ofUse Control to allow churches as conditional uses in two additional zones, those
being the R 40 and Industrial zones. These additions would give us sufficient inventory of land
for Permitted and Conditional Uses for churches. It would also allow the City to entertain an
application from Calvary Chapel Meridian to use this space on Baltic.

In the ten years we have been in the City of Meridian, we feel we have had,
a positive influence on the community, by helping and ministering to the needs of
our_city. We have feed, clotfied, paid rent, paid bills,. and purchase cars for those
in need among other things.':r~ number of times wve'have approached the Planning
and zoning department in relation to a number of different buildings; and property.
We'have for the most part encountered a sense of.hostility;when it comes tq Zoning
issues.
We have the opportunity to lease some warehouse space on Baltic from Campbell's
siding.. We don't feel there~wou~d be any interference with the other businessesin
the area, since we would primarily be meefing on weekends and evenings, when
others would be closed..There is also a mixed use of businessesin that-area, that are
not industrial or manufacturing. We are a small church of approximately 85 people.
It is also well located for our needs, as it is close to I-84 for families coming in from
Boise, Nampa, and Caldwell. We also do a-lot of ministry in the park nearby as well
as Hope Arms apartments and St. Lukes.
Please read-and consider the enclosed information. After consulting with Roger Ho,
an Attorney,with the Pacific Justice Institute, he is willing to come to Idaho- and

Dear Pastor Jacobson:
The City is still considering your request to lease space in an industrial area in order to
establish a physical location for your church.
As you are aware, churches are permitted uses in Limited Office, Neighborhood
Commercial, and Old Town zones in the City. Currently, they are also permitted through the
Conditional Use Permit process in R-8 and R-15 which are Residential zones, and also in the
Community Business District zone.
I have been discussing with staff the possibility of amending the Zoning Schedule of Use
Control to provide for churches in additional zones. We will need to discuss the issue with the
City Council, and if they approve expanding the areas in which churches can obtain Conditional
Use Permits, we will prepare an ordinance which will then go in front of the Planning and Zoning
Commission, as well as the City Council for adoption.
In the meantime, staff is continuing to review your request to be allowed to establish a
physical location for your church in the Industrial zone. I understand a meeting has been
scheduled for you to meet with staff next Tuesday to continue the discussion on this matter.
