Victory Road Meridian, ID 83642 Re: Troy Place Subdivision Dear Mr. Russell: The site specific conditions for approval for Troy Place state that all required improvements for this 4-lot development, which includes a tri-plex lot, two four-plea lots, and the private drive lot, be completed prior to obtaining a certificate of occupancy. It has recently come to my attention that the Building Deparhnent granted occupancy of the tri-plea located on Lot 2, Block 1, Troy Place (1236, 1242, and 1248 2 '/z Street). Please be advised that the Planning Department did not sign off on occupancy for the above-mentioned tri-plex. In accordance with the approved conditions for CUP-OS-025, PFP-04-001, CUP-04-003, CUP-03-038, CZC-04-097, CZC-OS-095, and CZC-OS-096, all relating to Troy Place, the Planning Department will not sign off on occupancy of the two four-plexes that are currently under construction on Lots 3 and 4, Block 1, Troy Place Subdivision until all required site improvements are complete These improvements include but are not limited to: construction of the (minimum) 25 oot wide shared drive aisle off of 2 %2 Street; construction of a 10-foot wide landsca e buffer along 2 %2 Street (excluding the width of the -drive aisle mentioned above); construction of a basketball court and a BBQ pit area with a picnic bench; constru tion of sidewalk along 2 'h Street; and, construction of all other landscaping, fencing, amenities, parking areas and all other improvements shown on the approved site an landscape plans for this project. Landsca~ing_ The Landscape Plan prepared by Alyssa Yensen of Pinnacle Engineers on December 22, 2004, Sheet LS-1, is approved (stamped "Approved" on 12/27/04 by the Meridian Planning & Zoning Department): NOTE: MCC 12-13-11-3.E requires all interior planters that serve a double row of parking spaces to be landscaped with at least two trees and to be covered with low shrubs, lawn, or other vegetative groundcover. All fencing shall be installed as agreed in The approved landscape plan is not to be altered without prior written approval of the Planning & Zoning Department. One tree must be added to the road frontage alond 21/Z steet to satisfy the requirements of 12-13-10 No field changes to landscape plan permitted; prior written approval of all material changes is required. Site Plan: The Site Plan prepared by Pinnacle Engineers, on December 15, 2004, Sheet Sitel, is approved (stamped "Approved" on 12/27/04 by the Meridian Planning & Zoning Department): The approved site plan is not to be altered without prior written approval of the Planning & Zoning Department Irri ation: An underground; pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with MCC 12-13-8 and MCC 9-1-28. ~ ~ Curbing: Per MCC 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. .Curbing maybe cut to allow for storm water runoff. Protection of Existing Trees: Any existing trees on site must be protected in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per MCC 12-13-13-4, coordinate with the Parks Department Arborist (Elroy Huff) for approval of protection measures prior to construction. Any severely damaged tree must be replaced in compliance with MCC 12-13-13-6. Parkin: Off-street parking is approved as shown on the approved site plan. The project engineer/architect shall certify that the number and size ofhandicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance with ADA. The applicant shall be responsible for meeting the requirements of ACHD as they pertain to this development. Sidewalks: All sidewalks shall be constructed in accordance with MCC 12-5-2.K. Sidewalks shall be constructed prior to occupancy. See Red Line change on Sheet 0. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with MCC 12-13. Fencing: Any required or proposed fencing shall be installed in compliance with current City Code. Li htin :Lighting shall not cause glare or impact the traveling public or neighboring development. Signnage: No signs are approved with this CZC. All signs will require a separate sign permit in compliance with the sign ordinance. Trash Enclosure: Any dumpster(s) must be screened in accordance with MCC 11-12-1.C. Trash enclosures must be built in the location and to the size approved by SSC. Handicap-Accessibility: The structure, site improvements and parking must be in compliance with all federal handicap-accessibility requirements. ACRD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new. site plan shall be submitted to the City of Meridian Planning and Zoning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy maybe obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements.
