Facts and Findings:
A. The Ada County Highway District (ACRD) staff has received the above referenced application-
requesting certificate of zoning compliance approval to construct a 58-acre park. ?he 58-acre
site is located on the northwest corner of Ustick Road and Meridian Road. This development is
estimated to generate 92 additional vehicle trips per day (0 existing) based on the Institute of
Transportation Engineers Trip Generation Manual.
B. The application and site plan stamped and received by the City of Meridian on September 14,
2001, and submitted to the District on September 21, 2001, has been reviewed by the ACHD
Planning and Development staff and confot7ns to applicable District standards/policy, or can be
made to conforn~ with the chant=e(s) to the plan described in the requirements stated below.
C. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan
is changed in such a manner as to not conform to District standards/policy or an appeal of the
Planning and Development staff decision is submitted as described within the Standard
Requirements outlined below.
D. On September 24, 2001, the District Planniny~ and .Development staff inspected this site and
evaluated the transportation system in the vicinity. On September 29, 2001. the staff met as the
District's Technical Review Comn~ittcc and revie~yed the. impacts of this proposed development
on the District's transportation system. The results of that analysis constitute the lollowing Facts
anal Findings and recommended Slle Specific Requircntents.

E. For the purposes of estimating daily trip generation and assessing impact fees for this project, the
proposed use of this development has been classif ed as City Park. (Per the 1TE Manual) The
impact fee rate from the fee tables for this use is $32 ~ per acre, based on the impact fee ordinance
in effect at this time. Note: This rate is provided for informational purposes onl~• and shall
not be construed as an impact fee rate certification. The impact fee will be assessed at the
time of plans acceptance by District staff, and shall be based on the fee tables and provisions
of the Dist-ict's Jmpact Fee Ordinance in effect at that time.
F. Staff has recently been receiving large amounts of inquiries from developers in this northwest
Meridian area. Many developers are prepared to plat entire section-miles, and have site plans
developed. The preliminary plans generally include 700 to 900 residential lots, schools,
office/commercial lots, and city and neighborhood parks
Due to the large number of inquiries in this area, staff and the development community realized
that the potential for development in this area is extreme, and that the traffic impact studies that
each individual developer was submitting, did not include the major surrounding developments that
are "in the works". If we examine each development individually, the roadway system is
adequate, but when we begin to add in a second or third large-scale development, the traffic
capacities of these roadways (Ustick Road, McMillan Road, Ten Mile Road, Linder Road) reach
their 2020 planning thresholds.
Based on development patterns in this area, and the concern surrounding the abutting roadways,
staff hired a consultant from the "on-call" list to conduct a traffic impact study of the northwestern
Meridian area from Ustick Road to Chinden Boulevard, and from Meridian Road to one-half mile
west of Black Cat Road. The study is currently in "DRAFT" form while ACHD staff, City of
Meridian staff, and COMPASS staff review the final phases of the study.
After examining the final phase of the Northwestern Meridian study, staff anticipates implementing
an extra-ordinary impact fee overlay district to pay for roadway improvements (mainly widening
and traffic signals) to these surrounding roadways. Staff estimates that it will take three to four
months to determine what improvements need to be made at this time to handle the additional
traffic being generated by the conglomeration of these developments, and to calculate an
extraordinary fee to make those improvements. This cui7-ent development (the Meridian City Park)
under review may also be subject to any extraordinary fees that the District may impose.
G. Cedar Springs Subdivision is cu~7-ently in the application process with the City of Meridian and the
District. The subdivision design is- currently undetermined at this time. If Cedar Springs
Subdivision has a public roadwav abuttin~~ the north property line. the Meridian Park should be
responsible for their portion of the roadw~av. 1 f the l\''leridian Parl: should develop before Cedar

H. The applicant is proposing to construct the main entrance to the park on Meridian Road, located
700-feet north of the south property line. The proposed main driveway should be designed with
21-foot street sections on either side of a center median. The median should be constructed a
mininnun of 4-feet wide (maximum 12-feet ~~~ide) to total a minimum of a 100-square foot area.
The following requirements are provided as conditions for approval:
Site Specific Requirements:
Dedicate 48-feet of right-of--way from the centerline of Meridian Road abutting the parcel by
means of recordation of a final subdivision plat or execution of a wan-anty deed prior to
issuance of a building pen~~it (or other required permits), whichever occurs first. Allow up to
30 business days to process the right-of--way dedication after receipt of all requested material.
The owner will be compensated for all right-of--way dedicated as an addition to existing right-
of-way from available impact fee revenues in this benefit zone, if the owner submits a letter of
application to the impact fee administrator prior to breaking ground, in accordance with ACRD
Ordinance #193. The right-of--way purchase agreement must be completed and signed by the
applicant prior to issuance of a building permit (or other required permits), whichever occurs
first.
2. Dedicate 48-feet of right-of--way from the centerline of Ustick Road abutting the parcel by

4. The applicant should he required to construct a 5-foot wide detached concrete sidewalk on
Ustick Road located ?-feet within the new right-of-wav. Coordinate the location and elevation
of the sidewalk with District stair. 1 f the sidewalk meanders outside of the right-oJ=way,
provide an easement for the sidewalk.
S. applicant is proposing to locate the main driveway on 1~leridian Road approximately 700-feet
north of the intersection of Usticl: Road and 1~~1eridian Road. This drivewa~~ location meets
District police and is appro~~cd with this applir~tion.
6. Pave the driveway to its full-required width of 30 to 35-feet and to a point 30-feet beyond the
edge of pavement of Meridian Road with 1 S-foot radii pavement tapers abutting the existing
roadway edge. Applicant shall be required to construct an acceleration lane and decele~ ration
lane. with a minimum of 100-feet of storage with shadow tapers for both the approach and
departure directions
7. If Cedar Springs Subdivision has a public roadway abutting the north property line, the
Meridian Park will be responsible for their portion of the roadway. if the Meridian Park should
develop before Cedar Springs Subdivision, the Meridian Park will be required to construct one-
half of a 36-foot street section plus 12-feet of additional pavement within 42-feet of right-of-
way. If Cedar Springs Subdivision should develop before the Meridian Park, the Meridian Park
will be required to complete the roadway making it a full 36-foot street section within 50-feet
ofright-of--way.
8. Replace unused curb cuts on Meridian Road and Ustick Road with 5-foot wide concrete
sidewalk to match the existing improvements.
9. If during construction any improvements are damaged the applicant is required to replace any
damaged curb, gutter, and/or sidewalk on Meridian Road and Ustick Road to match existing
improvements. Segments to be replaced shall be determined by ACHD Construction Services
staff. Contact Constriction Services at 387-6280 (with file number) for details.
10. Utility street cuts in pavement less than five years old are not allowed unless approved in
writing by the District. Contact ACHD's Utility Coordinator at 387-2516 or 378-6258 (with
file number) for details.
Il. Meet District drainage requirements per section 8000 of the ACHD Development Policy
Manual. Contact District staff at 387-6170 for details.
12. All utility relocation costs associated with improving street frontages abutting the site shall be
borne by the developer.
13. Any existing irrigation facilities should be relocated outside of the right-of--way.
14. Other than the access point specifically approved with this apphcatlOll, direct lot or parcel
access to Meridian Road and Ustick Road is prohibited.

Standard Requirements:
1. This decision of the Planning and Development Supervisor may be appealed to the Ada County
Highway District Commission by the applicant or by another parry ~~ ithin l 5 calendar days
from the date of this report. The request shall specifically identify each requirement to be
reconsidered and include a written explanation of why such a requirement would result m a
substantial hardship or inequity. The request swill be heard by the District Commission at an
evening meeting within 20 calendar days of the District's receipt of the appeal letter. 'The
appellant will be notified of the date and time of the Commission meeting.
2. After ACRD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two days of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
specifically identify each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of its original dec~s~on. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction m
accordance with Ordinance #193, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, COnSt'LlCton Services
procedures and all applicable ACHD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building penn>t
(or other required pern~its), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application. shall require the applicant to comply with all rules. re~~ulations. ordinances, plans.
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the }-lighwav District of its intent to ch~~n~~e the planned use of the subject
property unless a ~~~~aiver/variance of said requirements or other le~~al relief is granted pw~suant
to the lava in effect at the time the change in use is sought.

Dear Sirs,
I am writing this letter to urge you to consider the importance of adding tennis courts to your plans for the
new and badly needed Meridian city pazks. The parks in general are much overdo for such a fast growing
and family oriented community. The Meridian area, both city limits and surrounding subdivisions are
booming with families. Tennis is a wonderful way for families to get out together for virtually no money
and enjoy active time together. My family is now grown ,but my husband and two sons and I spent many
hours playing tennis at a local park in Boise. I have become very awaze as I have moved out to the
Meridian azea that there are no such opportunities at our new location. There are virtually no tennis courts
available other than the school courts that are not always available to the general public. The Boise parks
are the only alternative for families to paztake in this fun, healthy, inexpensive lifetime sport. This causes
a long drive and the courts in Boise aze crowded with players from all over the Treasure Valley.
Please keep this need in mind as you are developing plans for the future pazks in Meridian. I appreciate
your concern and attention as city planners.

Dear Mr. Kuntz,
This letter is meant to clarify the issue of the public roadway adjacent to the north property line of the
proposed City Park.
Over the course of the last year-and-a-half, ACRD has been reviewing the preliminary plat for Cedar Springs
Subdivision. The City has required several changes to the plat, and with each revision, the applicant has
brought the plat back to ACHD for approval. The original plat had houses abutting the Park site, but the City
required the applicant to construct a road in that location due to safety concerns. Based on that decision and
requirement by the City, a portion of the roadway improvements and some right-of-way of that local street
are located on Park property along the north property line of the Park site.
When ACHD received the Park application, the Park plan did not show the local street in Cedar Springs, but
the ACRD staff report for the Park addressed the requirement based on the Cedar Springs plat and City
requirement. The final ACHD staff report dated December 14, 2001, and all prior "draft" reports, included the
following Fact & Finding and subsequent Site Specific Requirement:

ACHD did not require the construction of a public street for access to the Park. However, because the City
designated a local street to be constructed through the park site, this issue has to be addressed with the
Park application, as was noted in Plan Review comments dated December 26, 2001, and again on February
7, 2002. The risk to ACRD is that the Cedar Springs development is only required to construct a portion of
the roadway, and it is necessary that it is established that the Park is also responsible for a portion of the
road because of its location.
Rather than requiring the construction of the roadway with the Park site (item #2, February 7, 2002 Plans
Review Comments), ACHD will accept written documentation that explains the nature of your agreement with
the Cedar Springs developer as it relates to funding and construction of the roadway. It is not our intent to
impede the development of the Park, but ACHD must also have assurance that the road will be built, or we
risk having an unfinished and unsafe roadway in the future. A second concern is that the Park site will have
to dedicate right-of--way for the roadway improvements. Generally we would require that right-of-way
dedication to occur with Plans Acceptance at this time. Again, ACHD is willing to allow you to provide written
documentation that the City agrees to dedicate the right-of-way to ACHD at the time the roadway is
constructed with the Cedar Springs development. As you know, ACHD does not compensate for right-of-
way dedicated for local streets.

For the Ada County Highway District to accept the plans for the above referenced project, please complete the
following requirements:
1. Dedicate 48-ft right-of--way from the centerline of Meridian Rd abutting the pazcel by
execution of a warranty deed prior to issuance of a building permit (or other required permits),
The owner will be compensated for this right-of--way. Provide legal description, site plan
highlighting dedicated right-of--way area, proof of ownership, name, title, and address of
signatory.
2. If the City of Meridian develops the pazk before Cedaz Springs Subdivision develops, the City
shall construct the proportionate shaze of a new roadway adjacent to the north property line.
Civil plans shall be submitted for review, which exhibit a street section of one-half of a 36-ft
street section (with curb gutter, and sidewalk) plus 12-ft of additional pavement within 42-ft of
right-of--way. If Cedar Springs Subdivision develops before the City of Meridian park is
developed, the city will be required to complete the roadway making it a fu1136-ft street
section with curb, gutter, and sidewalk within 50-ft ofright-of--way. Civil plans shall be
submitted for review, which exhibit a full 36-ft street section with curb, gutter, and sidewalk
within 50-ft ofright-of--way.
3. Construct all sidewalk per SD-709. Verify the width of the sidewalk (5-ft) on plans.
4. Revise plans to construct the detached sidewalk to match centerline elevation or to be within a
foot above centerline elevation of Meridian Road.
5. Provide a sidewalk easement for those portions of sidewalk located out of public right-of--way.
Provide a legal description for the easement azea, site plan highlighting easement azea, proof of
ownership, name, title, and address of the appropriate signatory. .
6. Provide a striping and obliteration plan per section 1100 of the ACRD Supplemental
Provisions for the two-way left turning lane. Coordinate all striping and pattern plans with
ACRD traffic services---contact Mike Villnave at 387-6146.
7. Provide a note on the striping and obliteration plan that states all conflicting pavement marking
shall be removed according to section 1134.02 of the ACRD Supplemental Provisions.
8. Exhibit on plans a 21-ft back of curb to back of curb street width for the park entrance
(i.e. E- 21-ft -~ ).
9. Provide a signed affidavit to the District stating that the City will move the existing well on
Meridian Rd at the City's expense, when the roadway is widened.
10. Provide four copies of the revised plans.

Facts and Findings:
nw/c Ustick Road. Meridian Road Park
A. The Ada County Highway District (ACHD) staff has received the above referenced application-
requesting certificate of zoning compliance approval to construct a 58-acre park. The 58-acre
site is located on the northwest corner of Ustick Road and Meridian Road. This development is
estimated to generate 92 additional vehicle trips per day (0 existing) based on the Institute of
Transportation Engineers Trip Generation Manual.
B. The application and site plan stamped and received by the City of Meridian on September l4.
2001, and submitted to the District on September 21, 2001, has been reviewed by the ACHD
Planning and Development staff and conforms to applicable District standards/policy. or can be
li~ade to conform with the change(s) to the plan described in the requirements stated below.
C. On September 24, 2001. the District I'lannin~ and Development staff inspected this site and
evaluated the transportation system in the vicinity. On September 29. 2001. the staff net as the
District's Technical Revie~y Conunittee and reviewed the impacts of this proposed development
on the Districts transportation system. "fhe results of that analysis constitute the following Facts
and Findings and recommended Site Specific Requirements.

E. For the purposes of estimating daily trip generation and assessing impact fees for this project, the
proposed use of this development has been classified as City Park. (Per the ITE Manual) The
impact fee rate from the fee tables for this use is $323 per acre, based on the impact fee ordinance
in effect at this time. Note: This rate is provided for informational purposes only and shall
not be construed as an impact fee rate certification. The impact fee will be assessed at the
time of plans acceptance by District staff, and shall be based on the fee tables and provisions
of the District's Impact Fee Ordinance in effect at that time.
F. Staff has recently been receiving large amounts of inquiries from developers in this northwest
Meridian area. Many developers are prepared to plat entire section-miles, and have site plans
developed. The preliminary plans generally include 700 to 900 residential lots, schools,
office/commercial lots, and city and neighborhood parks
Due to the large number of inquiries in this area, staff and the development community realized
that the potential for development in this area is extreme, and that the traffic impact studies that
each individual developer was submitting, did not include the major surrounding developments that
are "in the works". If we examine each development individually, the roadway system is
adequate, but when we begin to add in a second or third large-scale development, the traffic
capacities of these roadways (Ustick Road, McMillan Road, Ten Mile Road, Linder Road) reach
their 2020 planning thresholds.
Based on development patterns in this area, and the concern surrounding the abutting roadways,
staff hired a consultant from the "on-call" list to conduct a traffic impact study of the northwestern
Meridian area from Ustick Road to Chinden Boulevard, and from Eagle Road to McDermott Road.
That study has been completed. An economic study is underway to determine the costs of
widening the roadways, right-of--way, and signal costs; based on the recommendations of the traffic
study.
It is possible that ACHD may have to fiend a portion of these improvements with extraordinary
impact fees, or some other funding source. This current development (the Meridian City Park)
under review may also be subject to any extraordinary fees that the District may impose.
G. Cedar Springs Subdivision is cun-ently in the application process with the City of Meridian and the
.District. If Cedar Springs Subdivision has a public roadway abutting the north property line of the
Meridian Park, the Meridian Park should be responsible for their portion of the roadway. If the
Meridian Park should develop before Cedar Springs Subdivision, the Meridian Park should
construct one-half of a 36-foot street section plus 12-feet of additional pavement within 42-feet of
right-oi=way. If Cedar Springs Subdivision should develop before the Meridian Park, the Meridian
Park should complete the roadway making it a full 36-foot street section with curb, gutter and
sidewalk within 50-feet of right-ol=~~•ay. If the Meridian Park ~a%ould like a detached or meancierin~
sidewalk, they will be required to provide and easement to the District. v
H. "fhe applicant is proposing to consh•uct the main entrance to the park on Meridian Road, located
700-feet north of the south property line. The proposed main driveway should be designed with

2l -foot street sections on either side of a center median. The median should be constn~cted a
minimum of 4-feet wide (maximum 12-feet wide) to total a minimum of a 100-square foot area.
1. There is an existing well on Meridian Road that will be located within the new right-of--way. The
applicant (City of Meridian) has indicated that they will move the well at their expense in the future
when the roadway is widened. The applicant should provide a signed affidavit to the District
stating that agreement.
J. Request for Modification/Commission Action:
On November 2, 2001, the applicant filed a request for modification of the Ustick Road sidewalk
requirement. The request was heard by the ACHD Commission on December 12, 2001. The
applicant, Meridian Parks & Recreation, testifed that the Ustick Road frontage is not a part of
Phase 1, and that the sidewalk was not budgeted for FY 2002. The applicant further testified that
Phase 2 budgeting would occur in the Fall of 2002, and .that Phase 2 of the park would occur
thereafter. Phase 1 of the park is expected to open in the Spring of 2003, based on testimony from
the applicant.
The Commission offered an alternative to the applicant that would allow deferral of the Ustick
Road sidewalk until April of 2003. The applicant indicated to the Commission that the timing was
acceptable to Parks & Recreation.
The Commission granted a modification of policy to waive the sidewalk requirement on Ustick
Road for Phase 1 of the park, but placed a time limit on the modification. Regardless of future
phasing (because funding of those phases is unknown), the sidewalk on Ustick Road shall be
constructed on or before April 1, 2003. At the time of construction, ACHD will acquire the Ustick
Road right-of--way.
The following requirements are provided as conditions for approval for Phase 1:
Site Specific Requirements:
Dedicate 48-feet of right-of--way from the centerline of Meridian Road abutting the parcel by
means of recordation of a final subdivision plat or execution of a wan•anty deed prior to
issuance of a building pe~7nit (or other required permits), whichever occurs first. A11ow up to
30 business days to process the right-of--way dedication after receipt of all requested material.

of-way from available impact fee revenues in this benefit zone, if the owner submits a letter of
application to the impact fee administrator prior to breaking ground, in accordance .a-ith ACHD

5. Locate the main driveway on Meridian Road approximately 700-feet north of the intersection of
Ustick Road and Meridian. Road as proposed. This driveway location meets District policy and
is approved with this application.
6~ Pave the driveway to its full-required width of 30 to 35-feet and to a point 30-feet beyond the
edge of pavement of Meridian Road with 15-foot radii pavement tapers abutting the existing
roadway edge. Applicant shall be required to construct an acceleration lane and deceleration
lane with a minimum of 100-feet of storage with shadow tapers for both the approach and
departure directions

Standard Requirements:
This decision of the Planning and Development Supervisor may be appealed to the Ada County
Highway District Commission by the applicant or by another party within 10 calendar days
from the date of this report. The request shall specifically identify each requirement to be
reconsidered and include a written explanation of why such. a requirement would result in a
substantial hardship or inequity. The request will be heard by the District Commission at an
evening meeting within 20 calendar days of the District's receipt of the appeal letter. The
appellant will be notified of the date and time of the Commission meeting.
2. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #195, also known as Ada County Highway District Road Impact
Fee Ordinance.
3. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACRD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
4. The applicant shall submit revised plans for staff approval, prior to issuance of building pei7nit
(or other required pei7nits), which incorporates any required design changes.
~. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada COlIl1tV Highway District prior to District approval for occupancy.
G. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, pl~uis,
or other re~~ulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject

7. No change in the teens and conditions of this approval shall be valid unless they are in writing
anal signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
Conclusion of Law:
1. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

REQUEST FOR WAIVER
Staff has reviewed an application fora 58-acre public park located at the northwest corner of Ustick Road
and Meridian Road. The applicant is requesting a waiver a Site Specific Requirement #4, the requirement to
construct a 5-foot wide concrete sidewalk on Ustick Road.
The applicant, Meridian Parks & Recreation, is proposing to construct the park in two phases. The first
phase has frontage on two public streets, Meridian Road and a local street within a proposed subdivision.
The second phase has frontage on Ustick Road. Meridian Parks & Recreation requests that the requirement
to build sidewalk on Ustick Road not be required until Phase Two of the project due to budgetary concerns.
DISTRICT POLICY
7203.4 Abutting Streets: The developer is responsible for improving all street frontages abutting the
development's site, regardless of whether access is taken to all of the abutting streets.
7203.4.3 Collector and Arterial Streets: If a proposed development abuts a collector or arterial street,
the developer shall provide a sidewalk along the paved frontage and dedicate right-of-way
required by the proposed land use and scale of the project.
STAFF COMMENTS
Staff met with the applicant on at least two occasions prior to the submittal of this application. The applicant
was informed of the sidewalk requirement, along with right-of-way dedication requirements at those
meetings.
Staff is concerned that a large scale neighborhood park is being constructed, without providing pedestrians a
means to reach the site. The applicant's letter indicates pedestrian access on Meridian Road, but the users
of the park will also come from the west of the site along Ustick Road.
ACHD will be purchasing the right-of-way along Ustick Road, and that will help offset the cost of the sidewalk
and related improvements to that frontage.
OPTIONS
Sta- ff p des the Commission with the following options:
1. Require the construction of sidewalk on .Ustick Road abutting the site, and dedicate sufficient right-of-
. way for Ustick Road. This is consistent with District policy and requires no waiver of policy.
2. Delete the requirement for sidewalk along Ustick Road. This requires a waiver of policy. No right-of-
way should be purchased along Ustick Road with this option. The right-of-way will be purchased in
the future when the sidewalk is required to be constructed. If the Commission elects Option #2, then
staff also recommends that the Commission make a "Special Recommendation" to the City of
Meridian, recommending an on-site path that will enable pedestrians to use the park from Ustick
Road.
3. Another option that the Commission finds suitable.

Facts and Findings:
A: The Ada County Highway Disfricf (ACHD) staff has received the above referenced application-
requesting certificate of zoning compliance approval to construct a 58-acre park.. The 58-acre
site is located on the northwest corner of Ustick Road and Meridian Road. This development is
estimated to generate 92 additional vehicle trips per day (0 existing) based on the Institute of
Transportation Engineers Trip Generation Manual.
B. The application and site plan stamped and received by the City of Meridian on September 14,
2001, and submitted to the District on September 21, 2001, has been reviewed _by the ACHD
Planning and Development staff and conforms to applicable District standards/policy, or can be
made to conform with the change(s) to the plan described in the requirements stated below.
C. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan
is changed in such a manner as to not conform to District standards/policy or an appeal of the
Planning and Development staff decision is submitted as described within the Standard
Requirements outlined below.
D. On September 24, 2001, the District Planning and Development staff inspected this site and
evaluated the transportation system in the vicinity. On September 29, 2001, the staff met as the
District's Technical Review Committee and reviewed the impacts of this proposed development
on the District's transportation system. The results of that analysis constitute the following Facts
and Findings and recommended Site Specific Requirements.

E. For the purposes of estimating daily trip generation and assessing impact fees for this project, the
proposed use of this development has been classified as-City Park. (Per the ITE Manual) The
impact fee rate from the fee tables for this use is $323 per acre, based on the impact fee ordinance
in effect at this time. Note: This rate is provided for informational purposes only and shall
not be construed as an impact fee rate certification. The impact fee will be assessed at the
time of plans acceptance by District staff, and shall be based on the fee tables and provisions
of the District's Impact Fee Ordinance in effect at that time.
F. Staff has recently been receiving large amounts of inquiries from developers in this northwest
____Meridian__area._Many developers_.are_Prepared to plat entire_section-miles, and have site plans
developed. The preliminary plans generally include 700 to 900 residential lots, schools,
office/commercial lots, and city and neighborhood parks
Due to the large number of inquiries in this area, staff and the development community realized
...that the potential for development in this area is_extreme; and that the traffic. impact. studies that.
each individual developer was submitting, did not include the major surrounding developments that

are "iri the works"~f we examine each c~deve~op"merit individually;-the roadway system is
adequate, but when we begin to add in a second or third large-scale development, the traffic
capacities of these roadways (Ustick Road, McMillan Road, Ten Mile Road, Linder Road) reach
their 2020 planning thresholds.
Based on development patterns in this area, and the concern surrounding the abutting roadways,
- staff.hired aconsultant-#~r-o-m the "on-call" -list to conduct a traffic impact study of the northwestern
Meridian area from Ustick, Road to Chinden Boulevard, and from Eagle Road to McDermott Road.
That study has been completed. An economic study is underway to determine the costs of
widening-the- roadways-,right-of-way, and- signal. costs; based on the recommendations of the traffic
study.
It is possible that ACHD may have to fund a portion of these improvements with extraordinary

G. Cedar Springs Subdivision is currently in the application process with the City of Meridian and the

Meridian~ark the Meridian Park should be responsible for their portion of the roadway. If the
Meridian Park should develop before Cedar Springs Subdivision, the Meridian Park should
construct one=half of a 36-foot street section plus 12=feet- ofadditional-pavemerit~vithirr 42-feet of
right-of--way. If Cedar Springs Subdivision should develop before the Meridian Park, the Meridian
Park should complete the roadway making it a full 36-foot street section with curb, gutter and
sidewalk within 50-feet of right-of--way. If the Meridian Park would like a detached or meandering
sidewalk, they will be required to provide and easement to the District. .
H. The applicant is proposing to construct the main entrance to the park on Meridian Road, located
700-feet north of the south property line. The proposed main driveway should be designed with

2 l -foot street sections on either side of a center median. The median should be constructed a
minimum of 4-feet wide (maximum 12-feet wide) to total a minimum of a 100-square foot area.
I. There is an existing well on Meridian Road that will be located within the new right-of--way. The
applicant (City of Meridian) has indicated that they will move the well at their expense in the future
when the roadway is widened. The applicant should provide a signed affidavit to the District
stating that agreement.
The following requirements are provided as conditions for approval:
Site Specific Requirements:
1. Dedicate 48-feet of right-of--way from the centerline of Meridian Road abutting the parcel by
means of recordation of a final subdivision plat or execution of a warranty deed prior to
issuance of a building permit (or other required permits), whichever occurs first. Allow up to
30 business days to process the right-of--way dedication after receipt of all requested material.
The owner will be compensated for all right-of--way dedicated as an addition to existing right-
of-way from available impact fee revenues in this benefit zone, if the owner submits a letter of
application to the impact fee administrator prior to breaking ground, in accordance with ACHD
Ordinance #193. The right-of--way purchase agreement must be completed and signed by the
applicant prior to issuance of a building permit (or other required permits), whichever occurs
first.

elevation of the sidewalk with District staff. If the sidewalk meanders outside of the right-of-
way, provide an easement for the sidewalk.
4. The applicant should be required to construct a 5-foot wide detached concrete sidewalk on

5. Locate the main driveway on Meridian Road approximately 700-feet north of the intersection of
Ustick Road and Meridian Road as proposed. This driveway location meets District policy and .
is approved with this application.
6. Pave the driveway to its full-required width of 30 to 35-feet and to a point 30-feet beyond the
edge of pavement of Meridian Road with 15-foot radii pavement tapers abutiing the existing
roadway edge. Applicant shall be required to construct an acceleration lane and deceleration
lane with a minimum of 100-feet of storage with shadow tapers for both the approach and
departure directions
7. If Cedar Springs Subdivision has a public roadway abutting the north property line of the
Meridian Park, the Meridian Park will be responsible for their portion of the roadway. If the
Meridian Park should develop before Cedar Springs Subdivision, the Meridian Park will be
required to construct one-half of a 36-foot-street section -plus--l2-feet -of additional pavement
within 42-feet of right-of--way. If Cedar Springs Subdivision should develop before the
Meridian Park, the Meridian Park will be required to complete the roadway making it a fu1136-
foot street section with curb, gutter and sidewalk within 50-feet of right-of--way. If the
Meridian Park would like a detached or meandering sidewalk, they will be required to provide
and easement to the District.
8. Provide a signed affidavit to-the District stating that the City will move the existing well on
Meridian Road at the City's expense, when the roadway is widened.
9. If during construction any improvements are damaged the applicant is required to replace any
damaged curb, gutter, and/or sidewalk on Meridian Road and Ustick Road to match existing
improvements. Segments to be replaced shall be determined by ACHD Construction Services

10. Utility street cuts in pavement less than five years old are not allowed unless approved in
writing by the District. Contact ACHD's Utility Coordinator at 387-2516 or 378-6258 (with

Standard Requirements:
1. This decision of the Planning and Development Supervisor may be appealed to the Ada County
Highway District Commission by the applicant or by another party within 15 calendar days

evening meeting within 20 calendar days of the District's receipt of the appeal letter. The
appellant will be notified of the date and time of the Commission meeting.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two days of the

for reconsideration will be heard by the District Commission at the next regular meeting. of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #193, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACRD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other-required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all piles, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless awaiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.
8. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative. and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.

Conclusion of Law:
1. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.
