Conditional Use Permit• Project is subject to all conditions of the Conditional Use Permit (CUP),
approved October 15, 1996. The City's failure to specifically identify all requirements of the
CUP in this Certificate of Zoning Compliance does not relieve the owner of responsibility
for compliance.
Si na e: All signage is subject to design review and requires separate permits. No signage is
permitted in ACHD right-of--way. No portable signs or temporary signage permitted (such
as A-Frames).
Pazkin~ Standard and handicap accessible pazking requirements are met by the plan. Dimensions
of all parking areas shall conform to minimum dimensions as per city ordinance and ADA.
Handicap parking spaces must have signage per ADA standards.
Landscaping: All trees, shrubs, and lawn areas must be planted as per the approved landscape plan.
The 42 trees shown on the plan must be planted with sizes as shown on the plan. Written
approval of any changes is required; no field changes permitted.
Irri ation: An underground, pressurized irrigation system must be installed to all landscaped azeas.

Undeveloped Property: The undeveloped portion of the property must be kept mowed and free from
weeds over 8" in height until such time it is built out. No pazking, storage or other use is
permitted on the undeveloped portion of the lot.
Master Plan: A new Conditional Use Permit and/or Plat will be required for the future phases of the
property prior to approval. Future phases of the master plan are not approved by this CZC.

NOTES
1. The CUP for Louies Restaurant approved a maximum seating capacity of 250. 284 seats are
shown on the site plan. However, only 168 seats aze permanent interior seating. 116 seats are
shown as seasonal seating on the patios. The overall total is less than a 20% increase. Therefore
the proposed seating has been determined not to be a significant modification of the existing
CUP and will be allowed.
2. The outdoor seating is designed as an integral part of the building structure, with azchitectural
pillazs and landscaping to separate it from adjacent roads and sidewalks. No outdoor seating
encroaches onto any public right-of--way. Therefore, it is determined that the outdoor seating is
in compliance with the existing CUP and will not require a new CUP.
3. As per Daunt Whitman, Building inspector for the City of Meridian, the tower structure is limited
to 35 feet height as measured from the ground to the center of the roofline.
Sheet S-1 dated 2/9/00 and Sheet L-1 dated 2/9/00 area roved with the comments noted above.

We have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant during the hearing process:
GENERAL_ COMMENTS
1. Any existing irrigation/drainage ditches crossing the property to be included in this
project, shall be tiled per City Ordinance 11-9-b05.M. Plans will need to be approved
by the appropriate irrigation/drainage district, or lateral users association, with written
confuYnation of said approval submitted to the Public Works Department.
2.. Determine the seasonal high groundwater elevation, and profile the subsurface soil
conditions.
3. Submit copy of proposed restrictive covenants and/or deed restrictions.
4. Submit a letter from the Ada County Street Name Committee, approving the subdivision
name.

of the Professional Engineer.
Three (3) 250 watt high pressure sodium street lights still. need to be installed,
along N. Hickory Way, by the developer. of the Dove Meadows Subdivision.
d. Sewer and water service to this development will be via existing main lines in N.
Hickory Way. Assessment fees for sewer and water service will be determined
during the building plan review process.
e. Acceleration/deceleration lanes shall be constructed, in accordance with ACHD
standards, as a part of this project to keep consistent with the constructed
improvements on the south side of this intersection. We also feel it is appropriate
to request curb and gutter be built along the Fairview Avenue frontage of this
pr~jec~t. The City of Meridian and the Ada County Highway District need to
come to an agreement on this issue and will inform the Applicant of the final
decision on curb and gutter.

The proposed changes to the landscape plan to include a stormwater detention basin in the
southwest corner of the lot are approved with the following comments:
1. The stormwater basin is within the required 35' landscape setback and must be sodded, just
as all other grass areas within the 35' landscape setback. It is recommended that the sod
source be from anon-clay soil to facilitate stormwater infiltration.
Exposed cobble is restricted in required landscape areas. It is recommended that all cobble
remain sub-surface (see attached infiltration swale diagram). However, a small rock sump
may incorporated into the vegetated swale, if necessary, to facilitate drainage. The exposed
surface of the rock sump may not exceed more than 5 feet in any horizontal dimension.
Grates of sand/grease interceptors may also be incorporated, but the inlet structures may not
exceed 2 feet in any horizontal dimension.
3. Be sure that the Serbian Spruces are planted high enough on the slope so that they will
withstand the expected changes in soil moisture, but will not interfere with the sidewalk or
parking areas at mature size. Or, you may submit a change order to a species that is more
tolerant of soil moisture changes if you expect any problems.
4. Slopes must not be steeper than 3:1, as shown.
