COMMENTS:
Conditions of Approval: Pad is subject to all terms and conditions of existing C.U.P. for The Family
Center (as approved on 10-20-98) for the site. City's failure to specifically identify all
requirements of the C.U.P. in this Certificate of Zoning Compliance does not relieve owner
of responsibility for compliance.
Use of Structure: The structure is approved for two restaurants (Mackenzie River Pizza & Panda
Express) and associated outdoor seating as shown on the approved site plan. No outdoor
seating shall extend into the required 20-foot landscape buffer, beyond Eagle right-of--way,
nor into the required five-foot wide sidewalks.
Si na e: All signage is subject to design review and requires separate permits. No signage is
permitted in ACHD right-of--way. No portable signs or temporary signage permitted (such
as A-Frames).
Parkin :Minimum parking requirements are met by the plan. Dimensions of all parking stalls shall
conform to minimum dimensions as per city ordinance and ADA. City ordinance requires
9 X 19 min. standard stalls. Refer to ADA requirements to determine if the location of
handicapped spaces meet federal standards in relation to the orientation of the proposed
structure. A grade break exists in the planting area south of the van-accessible stall; the curb
cut and ramp must be designed to ADA standards.
Handicap-Accessibility: The structure and site improvements must be in compliance with all federal
handicap-accessibility requirements.
Existing Landscaping: All landscaped areas surrounding the buildings are regulated by the revised
landscape plans dated 8/25/99 and must be protected; any existing trees relocated to
accommodate the proposed new sidewalk must remain on site and be approved by the
Planning & Zoning Department. The trees cannot be placed in the ACHD right-of--way.
New Landscaping: The eight (8) new trees proposed on site shall be planted as per the approved
landscape plan. The southern-most tree in the parking area planter does not have acall-out,
but must be planted as one of the tree species shown on the plan. All tree sizes are to be 3"
caliper as per the plan, unless substitutions are approved in writing by the Planning and
Zoning Department. All mulch is to be 3" deep bark chips as per note 6 on the plan. Gravel,
rock, or "permabazk" will not be accepted.
Sidewalks: No portion of the existing sidewalk connecting from Eagle Road shall be removed. All
sidewalks must be 5 feet wide minimum at all locations. This will require widening the
sidewalks along the north and east sides of the building and west of the trash enclosure.
(Note, on the north side of the building, if the ewalk must be ahleast fbve feet wide) ewalk

Inip,ation: An underground, pressurized irrigation system must be installed to all landscaped areas
as per notes 12-16 on the approved landscape plan.
Li htin :Lighting shall not cause glaze or impact the traveling public or neighboring development.
Drainage: A proposed site drainage plan must be approved by the City Public Works Department
prior to construction.
Trash Enclosure: All dumpsters must be screened from view and not be visible by the public or from
adjacent properties. Coordinate the location and size of the trash enclosure with Sanitary
Services Corp. (SSC). Parking spaces shall not encroach in front of the enclosure gates.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by
providing surety to the City in the form of a Letter of Credit or cash in the amount of 110%
of the cost of the remaining improvements (in tl for Temavorary O ccupancYdscaping, and/or
irrigation). A bid must accompany any reques p
Plan Modifications: The approved Site Plan and Landscape Plan are not to be altered without prior
written approval of the Planning & Zoning Department. No field changes to the site or
landscape plans are permitted; prior written approval of all changes is required.

PGABcW Architects, we have ascertained that the aforementioned landscape plan is
correct, and the four trees in question will be placed in the patio area. Mr.l3elka has also
ensured us that the developer and the contractor have been made aware of this
