COMMENTS:
Conditions of Approval: The project is subject to all requirements of the Findings of Fact and
Conclusions of Law (FFCL) of the Conditional Use Permit (CUP) for the project. The City's
failure to identify all conditions of the FFCL in this Certificate of Zoning Compliance (CZC)
does not relieve the owner of responsibility for compliance.
Si nape: All signage is subject to design review and requires separate permits. No signage is
permitted in ACHD right-of--way. No portable signs or temporary signage permitted (such
as A-Frames).
Parkin: Dimensions of all parking stalls shall conform to minimum dimensions as per city
ordinance and ADA. City ordinance requires 9 X 19 min. standard stalls (9 X 20 spaces are
provided) and 25-foot-wide min. driveways. ADA requires the handicap-accessible stall(s)
to have a striped aisle separate from the stall and signage. The van-accessible handicap
parking space must have van-accessible signage per ADA standards. Refer to ADA and Fair
Housing Act design guidelines to determine the proper location and number of handicap-
accessible spaces.
Handicap-Accessibility: The structures and site improvements must be in compliance with all
federal handicap-accessibility requirements.
Landscaping: All trees must be planted as per the approved landscape plan. The Landscape Plan is
not to be altered without prior written approval of the Planning & Zoning Department.
Drainage Swales: The stormwater detention areas must be designed with slight slopes and grass to
allow them to function as recreation areas and to count toward the open space requirement.
Irri ag tion: An underground, pressurized irrigation system must be installed to all landscaped areas.
Sidewalks: All sidewalks and pedestrian walkways must have a minimum width of five (5) feet at
all locations.

Li_, ~hting: Lighting shall not cause glare or impact the traveling public or neighboring development.
Drainage: A proposed site drainage plan must be approved by the City Public Works Department
prior to construction.
Trash Enclosures: All dumpsters must be screened from view and not be visible by the public or
from adjacent properties. Coordinate the number, location, and size of the trash enclosures
with Sanitary Services Corp. (SSC).
Certificates of Occupancy: All required improvements must be complete prior to obtaining
Certificate(s) of Occupancy. A Temporary Certificate of Occupancy may be obtained by
providing surety to the City in the form of a Letter of Credit or cash in the amount of 110%
of the cost of the required improvements (including paving, striping, landscaping, and
irrigation). A bid must accompany any request for Temporary Occupancy.
Plan Modifications: The approved Site Plan and Landscape Plan are not to be altered without prior
written approval of the Planning & Zoning Department. No field changes to the site or
landscape plans are permitted; prior written approval of all changes is required.

PLANS ACCEPTANCE
The District has reviewed the plans for the above referenced project, and they are accepted for public street
construction. By stamping and signing the improvement plans, the Registered Engineer ensures the District
that the plans conform to all District policies and standards. Variances or waivers must be specifically and
previously approved by the District in writing. Acceptance of the improvement plans by the District does not
relieve the Registered Engineer of these responsibilities. The District will assess the following impact fee for
this project. The impact fee must be paid prior to issuance of a building permit.
Total Impact Fee due: $31240.00
Standard Requirements:
1. Utility street cuts in new pavement less than five years old are not allowed unless approved in
writing by the District.
2. All irrigation facilities must be located outside the public right-of--way unless otherwise
approved by the District.
3. Replace damaged curb, gutter, and sidewalk with new curb, gutter, and sidewalk to match
existing improvements.
4. All facilities to be constructed with a proposed development, and to be owned and maintained by
the District, must be constructed according to the latest edition of I.S.P.W.C. and the District's
Supplemental Standard Specifications.
5. Any work in the public right-of-way requires a permit from ACRD Construction Services.
6. An engineer registered in the State of Idaho shall prepare and certify all improvement plans.

Thanks for helping me understand the process. I have included the ACRD approval letter,
three copies of the landscape plan, and three copies of the grading plan (for your use as a
site plan). I have also enclosed one copy of the Settlers Canal Tiling Plan, the Street/Water
and Sewer Construction Plan, and the Pressurized Irrigation Plan. You will also find a copy
of the conditions of approval for the conditional use permit and a brief description of how
we have met those conditions. Finally, I have filled out a compliance checklist form. This
has all the area calculations in square feet and as a percentage of the whole site.
I hope I have all the information you need. Joe Canning is still working on legal
descriptions for the water and sewer service easements. From what I could tell, that was not
an item that you would be checking.

existing main in Stonehenge Way. Applicant will be responsible to construct
the water mains to and through this proposed development. Subdivision

anticipated fire flow and domestic water requirements for the proposed site.
Water service to this development is contingent upon positive results from
a hydraulic analysis by our computer model. Flow and pressure from the

If City water is proposed as a secondary source, developer shall be
responsible to pay water assessments for the entire common open area.
Applicant shall submit an irrigation plan for watering all landscaped areas
which plan shall be reviewed by the City's Public Works Department. The
Public Works Department must approve an irrigation plan before any
Building Permits are issued.

of the development plan review process. A draft copy of the pressurized
irrigation system O&M manual must be submitted prior to plan approval.
The City of Meridian requires that pressurized irrigation systems be supplied
by a year-round source of water. If a creek or well source is not available, a
single-point connection to the culinary water system shall be required. If a
single-point connection is utilized, the developer shall be responsible for the
payment of assessments for the common areas prior to signature on the final
plat by the Meridian City Engineer. If City water is proposed as a secondary
source, developer shall be responsible to pay water assessments for the entire
common open area.

13.16 The 10-foot buffer adjacent to Danbury Fair Subdivision is deemed

13.17 The storm drain must be relocated to be fully within the roadway. It must
not cross into the landscape buffer, because it the storm drain would

13.18 The landscape plan is recommended for approval with the following minor
modifications: The Austrian Pines at the entrance must be relocated outside
of a 40' X 40' clear sight triangle, measured from the projected intersection
of Stonehenge Way and the entry road. Add three trees along the pathway
stubbed to the east property line, to give it the same landscape treatment as
the rest of the path. Finally, staff recommends adding one tree behind each
building along the east property line. The applicant is responsible to ensure
that no easements exist that would preclude the proposed landscaping. All
landscaping shown will be required, with the additions mentioned above. ° ~

13.22 Six-foot-high, permanent perimeter fencing shall be required, except where
the City has agreed in writing that such fencing is not necessary. All required

13.23 Design tiling the Flume Canal and leaving the Settlers Canal untiled, with
a pathway along the north side of the property, is approved. The proposed
5, gravel walking path must be concrete or asphalt to match the rest of the
pathway and provide a more useable, lasting surface. The path shall be
extended when the property to the east is developed. Due to the high-
density proposed use, safety may be a concern of the Settlers Irrigation
District and the City of Meridian along the Settlers Canal if no fencing is

13.24 Proposals for Planned Unit Developments must include a minimum often
percent common area. Common open space shall mean land area space
exclusive of street rights-of--way, buildings, parking areas, structures, and
appurtenances except those improvements that are accessible and available
to all occupants of the private units within the PD. No calculations for open
space were submitted with the application. The applicant shall present the
calculations to the Commission at the hearing. Entry landscaping should not
be included in these calculations. Space between buildings, etc. should not
be counted. Only those areas that are provided as common open space for

square feet, of that area 86,859 square feet is landscaped area or open canal of somekind.
For specific open use areas:
The picnic/stormwater area in the south end of the project: 14,750 SF
The open area immediately north of the stormwater area: 3,240 SF
The open area behind the buildings within the internal drive: 8,760 SF

Attached is a Letter of Credit for the parking lot striping, and landscaping at Penn Station
Apartments on Stonehenge Way. I received this LoC from Mr. Leonard Dooms of Centers
Construction, Inc., the general contractor, when I inspected the site two weeks ago. I held the
LoC until all site improvements were completed, which was yesterday, 8/23/01. All outstanding
improvements have been completed and I'm sending the LoC over for you to return to Idaho
Independent Bank.
