As we have discussed the Pinnacle Engineers, Inc. building is located in the Boise City limits,
however, a portion of the parking is located within the Meridian City limits. We have gained
approval from the City of Boise and have included those with this letter for your review and
consideration. In addition, we have included (3) copies of each of the following, Site Plan,
Landscape Plan, Grading and Drainage Plans, Utility Plans and Details for your review. The trash
enclosure is on the Meridian side and we also need to know if Meridian will provide trash service
or if we should contact Boise. We can provide building plans if you need them. Please call if they
will be helpful '
We are assuming the City of Meridian would issue a Zoning Certificate and this would allow
Pinnacle Engineers, Inc. the ability to start work on the parking lot within your jurisdiction.
Please let us know if we should permit this work all with Boise City or if we need split permits
and inspections. We do need something from Meridian stating your position so we can give
correct information to both Cities. Thank you for your time and consideration on this matter and

CONDITIONS OF APPROVAL
1. Construction, use and property development shall be in compliance with plans and
specifications on file with the Boise City Planning and Development Department dated
received on January 11, 2000 except as expressly modified by the Design Review
Committee or Design Review Staff and as outlined by the following conditions:
a) A minimum 10' wide dense landscape. buffer with mature trees is required in
the transitional setback along the north property line. If the applicant is not
able to gain approval to plant within the irrigation easement, the applicant
will be required to move the building forwazd (south) to create the additional
space necessary for landscaping
A revised plan showing the above modifications shall be submitted for review and approval
by the Boise City Planning Department staff. No Building Permit shall be issued until the
revised plans have been submitted and approved.
2. Detailed Conditional Use Approval is granted for Phase 1 of the project only which consists
of the 11,300 sq. ft. office building located on the west side of the site.
3. Approval for Phase II of the development (13,687 sq. ft. building) is conceptual only and
shall proceed directly to ,Design Review for final approval.
4. All conditions of the Ada County Highway District shall be complied with per their memo
dated January 19, 2000.
Standard Conditions of Approval:
5. No change in the terms and conditions of this approval shall be valid unless in writing and
signed by the applicant or his authorized representative, and an authorized representative of
the City of Boise. The burden shall be upon the applicant to obtain the written confirmation
of any change and not upon the City of Boise.
6. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances,
plans, or other regulatory and legal restrictions in force at the time the applicaat or its
successors in interest advises the City of its intent to change the planned use of the property
described herein unless a variance in said requirements or other legal relief is granted
pursuant to the law in effect at the time the change in use is sought. ,
7. An Occupancy Permit will not be issued by the Building Department until all of these
condition(s) have been complied with. In the event a condition(s) cannot be met by desired

date of occupancy, the Planning Director will determine whether the condition(s) is bondable
or should be completed, and if determined to be bondable, a bond will be required in the
amount of 110% of the value of the condition(s) which are incomplete.
8. Construction, use and property development shall be in compliance with plans and.
specifications on file with the Boise City Planning and Development Department dated
received on January 11, 2000.
9. This conditional use shall be valid for a period not to exceed eighteen (18) months from the
date of approval by the Planning and Zoning Commission. Within this period, the holder of
the permit must:
A. Acquire construction permits and commence placement of permanent footings and
structures vn or in the ground. The definition of structures in this context shall include sewer
lines, water lines, or building foundations; or
B. Commence the use permitted by the permits in accordance with the conditions of
approval; or
C. For conceptual conditional use permits, submit an application for detailed approval to
Design Review; or
D. For projects which require platting, the plat must be recorded within this period. The
Commission may also fix the time or period within which the permit shall be completed,
perfected or bonded. If the conditions of approval shall not be completed or bonded within
such period, said permit shall lapse. .
10. Prior to the expiration of this conditional use, the Commission may, upon written request by
the holder, grant aone-yeaz time extension. A maximum of three (3) extensions may be
granted.
11. The Boise Fire Department has reviewed this application and has no objection. Any
deviation from this plan is subject to fire department approval.
12. Fire department vehiculaz access shall be provided to within 150' of all portions of all
buildings. All fire department access roads and fire lanes are to be a nunimum of 20' wide
and shall be capable of supporting 70,000 lbs. Fire department access roads and fire lanes
shall have a minimum outside turning radius of 48' and inside radius of 28'.
13. Fire department required hydrants, access, and street identification shall be installed prior to
construction or storage of combustible materials on site. Provisions may be made far
temporary access and identification measures.

14. Specific building. construction requirements of the Uniform Building and Uniform Fire
Codes will apply. However, these provisions aze best addressed at building permit
application. For further information contact David S. Miller, 384-3$27.
15. Vision Triangles as defined in Section, l 1-01-03 and Section 11-10-04.4G. ofthe Boise City
Zoning Ordinance shall remain cleaz of all sight obstructions.
16. A detailed grading and drainage plan shall be submitted for review and approval by the Ada
County Highway District and Boise City Public Works before a Building Permit is issued.
17. Hook-up to wet line sewers shall be required prior to issuance of an Occupancy Permit.
18. Utility services shall be provided underground.
19. The applicant shall comply with the requirements of the Boise City Public Works
Department (BCPW) for drainage, sewers, street lights and subdivisions per Department
comments. Please contact BCPW at 384-3900. All items required by BCPW shall be
included on the plans/specifications that are submitted for a Building Permit. Please note
that any changes or modifications by the owner to the approved plans, must be submitted to
the Public Works Department for approval.
20. This approval does not include approval of any signage. A separate Sign Permit will be
required from the Community Planning and Development Department prior to installation
of sign(s)..
21. Interior landscaping shall be at least 5% of the total pazking and driveway azea. This is in
addition to the required perimeter landscaping.
22. Existing mature vegetation shall be retained wherever possible.
23. Street trees, as selected from the City Forester's list of approved trees, shall be prQVided.
Each tree will be a minimum 2-inch caliper at time of planting.
24. All landscaping shall be maintained in a healthy and attractive condition.
25. Landscaped areas shall be irrigated by an appropriate underground irrigation system.
26. All parking areas and driveways shall be. paved, marked and provided with approved wheel
restraints, and shall be designed and laid out to conform to the minimum standards required
by the Boise City Zoning Ordinance.
27. Exterior lighting fixtures must be designed and located so as to prevent glaze or direct light
from falling onto adjoining properties or streets.

28. Trash receptacles, on-grade and roof-top mechanical and. electrical equipment shall be
screened from public view by use of an approved sight-obscuring fence and/or hedging.
29. All drainage and irrigation ditches, laterals or canals crossing, intersecting and lying adj acent
or contiguous to the site shall be covered or fenced with a chain link fence at least four feet
(4') high as required by Section 11-06-04.140 of the Boise City Code. (Required for
multiple family dwelling(s), kindergarten, school, nursery or mobile home park uses. May
be waived by the Commission if found the fence will not serve the public interests).
30. This project is in a Design Review District and shall be subject to review and approval by
the Design Review'Committee or Staff.
31. .Any future division of this parcel into individual lots or parcels, for the purpose of selling
the separate lots to individual owners, will be required to comply with all provisions of Boise
City Code, Title 9, Chapter 20, including lot frontage on a public or approved private street,
and all requirements for preliminary and final platting.
32. Construction, use and property development shall be in conformance with all applicable
requirements of the Boise City Code.
33. Failure to abide by any condition of this Conditional Use Permit shall be grounds for
revocation by the Boise City Planning and Zoning Commission.
34. The conditional use application shall be completed within 60 months or the applicant will
be required to submit a new conditional use permit.

This letter is to inform you of the action taken by~ the Boise City Design Review Committee on
your request to construct atwo-story, 11,300 sq. ft. (approx.) office building with accessory
warehouse area in a M-1D (Limited Industrial with Design Review) zone.
The Committee, at their meeting of February 9, 2000 voted to approve your request. Based on the
findings that were included in the staffreport, the Committee concluded that your project
complies with Sections 11-7-3.1 and 11-7-3.2 of the Zoning Ordinance, and the goals and
policies of the Boise City Comprehensive Plan.
Enclosed is a copy of the conditions of approval, as well as the findings included in the staff
report.
May we also take this opportunity to advise you of the following:
a) This approval will not take effect until after the appeal period has lapsed.
b) A Building Permit will be required from the Building Department prior to construction.

CONDITIONS OF APPROVAL
SITE SPECIFIC CONDITIONS OF APPROVAL
1. Compliance with plans and specifications submitted to and on file in the Community
Planning & Development Department dated received December 23, 1999, except as
expressly modified by the following conditions.
a. Comply with alI requirements of CUP99-00159.
b. This. approval is for phase I only. A separate Design Review application shall be
submitted for the phase II building.
c. Provide additional base planting and shrubs neaz the curb-cuts which extend into
the streetscape area. '
d. The transitional yard buffer along the north properly line shall be composed of
evergreen trees spaced at 20-25 ft. (staggered when possible) with. clusters of
upright shrubs and deciduous trees between the evergreens. The evergreen trees
which buffer the structure shall be 10-12 ft. in height at the time of planting.
e. No Building permit shall be issued until evidence has been provided, reviewed,
and approved by the Subdivision Section of the Planning and Development
Services Department showing the site is in conformance with the Boise City
Subdivision Ordinance. Should the site not be in conformance, subdivision
platting will be required.
f. The applicant shall comply with the requirements• of the Boise City. Public Works
Department (BCPV~ for drainage, sewers and street lights. Please contact BCPW
at 384-3900. All items required by BCPW shall be included on the
plans/specifications that aze submitted for a Building Permit. Please note that any
changes or modifications by the owner to the approved Storm Water Plan, must be
resubmitted to the Public Works Department for approval.
g. Compliance with the requirements and recommendations of Community Forestry
per letter dated January 27, 2000. A revised landscape. plan shall be submitted to
the Planning staff and Community Forestry prior to issuance of a building permit.
h. Compliance with requirements as requested by the Ada County Highway District.

Revised plans indicating compliance with the above conditions shall be submitted to the
Design Review Staff for approval prior to application for a building permit.
STANDARD CONDITIONS OF APPROVAL
2. All loading activities and site maintenance (with the exception of snow removal) are
limited to Mondays through Fridays between the hours of 7:00 a.m. and 10:00 p.m., and
Saturdays and Sundays between the hours of 8:00. a.m. and 8:00 p.m.
3. All landscaping areas shall be provided with an underground irrigation system. Land-
scaping shall be maintained according to current accepted industry sandazds to promote
good plant health, and any dead or diseased plants shall be replaced. All landscape areas
with shrubs shall have an approved mulch such as bark or soil aid.
4. All landscape trees shall be pruned in accordance with the American National Standards
Institutes Standard Practices for Tree Care Operations (ANSI A300 -latest edition). No
trees on the site shall be topped,. headed back, rounded over or otherwise disfigured.
r Contact Boise Community Forestry at 384-4083 for information regazding tree care
operations.
5. An approved protective curbing shall enclose all landscape areas where they are adjacent
to parking areas or driveways.
6. Vision Triangles as defined under Section 11=1-3 and Section 11-10-4.4G of the Boise
City Code shall remain clear of sight obstructions.
7. In compliance with Title 9, Chapter 16, Boise City Code, anyone planting, pruning,
removing or:tre~ichinglea€cavating, near any tree(s) an Ada County. Highway District or
State rights-of-way must obtain a permit from Boise Community Forestry at least one
week in advance of such:work (please ca11384-4083). Species shall be selected from
Boise City Tree. Selectuon~~'ruide.
8. Unless noted otherwise, deciduous trees shall be not less than 2 to 2 '/z inch caliper size at
the time of planting, evergreen trees 5'- 6' in height, and shrubs 1-5 gallon as approved by
Staff. All plants to conform to the American Association of Nurseryman Standards in
terms of size and quality.
9. All surface drainage shall be reviewed and approved by Ada County Highway District
and the Boise City Department of Public Works..Perimeter grading shall be designed to
match the existing grade of the adjoining properties.
10. All parking areas and driveways shall be paved and striped. All handicapped spaces and

approved compact spaces shall be clearly marked and signed as required. Bicycle
parking, as required by Section 11-10-1G, shall be provided.
11. Any outside lighting shall be reflected away from adjacent property and streets. Impacts
on residential areas shall not be permitted.
12. Fire Department required.water mains, fire hydrants and temporary Fire Department
access to be~ installed, inspected and approved by the Boise Fire Department.prior to
commencement of combustible construction.
NOTE: Temporary water and temporary access during construction may be
permitted upon request to. and approval by the Boise Fire Department.
13. No obstructions (landscaping, signs, fences or other elements) shall encroach upon any
required fire accesses. or fire facilities.
14. All signs will require approvals from the Community.. Planning & Development Depart-
. ment prior to installation.
15. Trash receptacles, on-grade and roof top mechanical fixtures and equipment shall be
concealed from public view by use of an approved sight-obscuring method. All screen
materials shall be compatible with the building materials/design.
16. Utility services shall be installed underground.
17. No trees within the street rights-of--way shall be removed or pruned without the approval
from Boise Community Forestry in compliance with Title 9, Chapter 16, Boise City
Code. No trees within the property; as Shown an the plans and approved by the Design
Review Committee or Staff, shall be removed without the approval of the Design Review
Committee or Staff and in compliance with Title 9, Chapter 16, Boise City Code.
In the event a tree is removed without prior approval, the tree shall be replaced with a tree
with trunk caliper 1.5 times the one removed, or with a sufficient number of trees, as
approved by the Design Review Committee or Staff with a trunk caliper not less than 4"
and a total cumulative caliper area equal to 1.5 times the caliper area of the tree(s)
removed. Caliper shall be as measured by the American Nurseryman's Association
standards. For example, if a 12" caliper tree is removed, it must be replaced with either
one 18" caliper tree or three 6" caliper trees or five: 4" caliper trees: The replacement
requirement may be modified upon a showing made to the Design Review Committee or
Staff of disease or death of the tree which was not caused by neglect.
18. An Occupancy Permit will not be issued by the Building Department until all of these

conditions have been met. In the event a condition(s) cannot be met by the desired date
of occupancy, the Planning Director will determine whether the condition(s) is bondable,
or should be completed, and if determined to be bondable, a bond or other surety
acceptable to the City will be required in the amount of 110°!0 of the value of the
condition(s) that is incomplete.

Objective -Site Design
A. That the site plan minimizes impact on adjacent streets and that the
pedestrian and bicyclist has been provided for by requiring sidewalks,
paths, landscaping; and safe parking lot design as appropriate.
B. That the proposed site's landscaping screens are adequate to protect
adjacent uses, provide sound and sight buffers and can be adequately
maintained; slope and soil stabilization have been provided for; and,
that unsightly areas are reasonably concealed or screened.
C. That on-site grading and drainage have been designed so as to mini-
mize off-site impact. and provide for erosion. control.
D. That signing for any proposed project provides for business identifi-
cation and. minimizes clutter and confusion on and off the site, and is
in compliance with Boise City Code sign provision.
E. That utility service systems do not detract from building design and
that size and location of all service systems are appropriate and
maintainable.
Structure Design
A. Building Mass -The mass of the building should be reviewed for its
relationship and consistency with ezisting development in the immedi-
ate surrounding area and with the allowed use proposed by the
applicant; and,
B. Proportion of Building Facades -The height to width relationship of
new structures shall be compatible and consistent with the architec-
tural character of the area and the proposed use; and,
C. Relationship of Openings in the Facades -Openings in the facade shall
be consistent with the architectural character of the area (for ezam-

ple, balconies, bays and porches are encouraged with a minimum of

monotonous flat planes), to provide shadow relief; ~ and,
D. Relationship of Exterior Materials - To determine the appropriateness
of materials as it relates to building mass, shadow relief and existing
,.area development; use of color to provide blending of materials with
the surrounding area, shadow relief and building use; the functional
appropriateness of the proposed building design as it relates to the
proposed use.

Facts and Findings:
A. The Ada County Highway District (ACRD) staff has received the above referenced application
requesting conditional use and design review approval to construct two office buildings for a
total of 26,294-square feet. The 2.1-acre site (two parcels) is located on the north side of
Executive Drive, approximately 1,000-feet west of Cloverdale Road. This development is
estimated to generate 320 additional vehicle trips per day based on the Institute of Transportation
Engineers Trip Generation manual.
B. The application and site plan stamped as received by Boise City on December 23, 1999, and
submitted to the District on December 27, 1999, have been reviewed by the ACRD Planning and
Development staff and conforms to applicable District standards/policy, or can be made to
conform with the change(s) to the plan described in the requirements stated below.
This is a staff level approval and will not be heard by the ACRD Commission unless the site plan
is changed in such a manner as to not conform with District standards/policy or an appeal of the
Planning and Development staff decision is submitted as described within the Standard
Requirements outlined below.
C. On January 3, 2000, the District Planning and Development staff inspected this site and
evaluated the transportation system in the vicinity. On January 7, 2000, the staff met as the
District's Technical Review Committee and reviewed the impacts of this proposed development
on the District's transportation system. The results of that analysis constitute the following Facts
and Findings and recommended Site Specific Requirements.
D. There is an existing 5-foot wide concrete sidewalk abutting the entire parcel.

The following requirements are provided as conditions for approval:
Site Specific Requirements:
1. Construct a 24 to 30-foot wide driveway as located proposed, approximately 180-feet west of the
east property line. Pave the driveway its full required width and at least 30-feet beyond the edge
of pavement of Executive Drive and install pavement tapers with 15-foot radii abutting the
existing roadway edge. Install a 30"x30" STOP sign at the driveway exit to Executive Drive.
2. Construct a 24 to 30-foot wide driveway as proposed, approximately 70-feet east of the west
property line. Pave the driveway its full required width and at least 30-feet beyond tlae edge of
pavement of Executive Drive and install pavement tapers with 15-foot radii abutting the existing
roadway edge. Install a 30"x30" STOP sign at the driveway exit to Executive Drive.
3. Provide a recorded cross access easement for the parcel to the east and among the parcels to use
the driveways for access to the public streets prior to issuance of a building permit (or other
required permits).
4. Utility street cuts in pavement less than five years old are not allowed unless approved in writing
by the District. Contact Construction Services at 387-6280 (with file number) for details.
5. Other than the access points specifically approved with this application, direct lot or parcel
access to Executive Drive is prohibited.
Standard Requirements:
1. This decision of the Planning and Development Supervisor may be appealed to the Ada County
Highway District Commission by the applicant or by another party within 15 calendar days from
the date of this report. The request shall specifically identify each requirement to be
reconsidered and include a written explanation of why such a requirement would result in a
substantial hardshi or inequity. The request will be heard by the District Commission. at an
evening meeting within 20 calendar days of the District's receipt of the appeal letter. The
appellant will be notified of the date and time of the Comrission meeting.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two days of the
action and shall include a minimum fee of $ i 10.00. The request for reconsideration shall
specifically identify each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of it's original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified of
the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in accordance
with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance.

4. All design and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACRD Ordinances unless specifically waived herein. An engineer registered in the
State of Idaho shall prepare and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or
other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless awaiver/variance of said requirements or other legal relief is granted pursuant to
the law in effect at the time the change in use is sought. `
8. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
Conclusion of Law:
1. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

On 10/26/00, I inspected the western portion of the above-mentioned site for landscaping and
parking compliance. The site has been built in conformance with the approved Site and
Landscape Plans.
The Certificate of Zoning Compliance for this project was issued on 3/23/00 and gave
approval for the westem-most portion of the parking lot and associated landscaping located
in the City of Meridian. The Pinnacle building and additional parking are located in Boise City.
Brad Watson of the Public Works Department previously stated that Public Works did not
need to review the civil drawings for the portion of the parking lot in Meridian's jurisdiction as
this would be reviewed by Boise City per Conditions #17 and #19 on page 7 of Boise City's
approved Findings for CUP99-00159.
Since no Certificate of Occupancy was issued by the City of Meridian for this project and,
therefore, no card was available for Meridian P&Z Department signature, this memo provides
such review approval for the western portion of the parcel in Meridian's city limits.
