Comments:
Conditions of Approval: Project is subject to all current City Ordinances and conditions of approval
for Messina Village No. 2. The issuance of this permit does not release the applicant from
any requirements of the approved Preliminary Plat or Final Plat of Messina Village No. 2,
issued for this development.
Non-buildable designation of Lot: The Final Plat of Messina. Village No. 2 states that "Lot 6, Block
2 and Lot 4, Block 7 are non-buildable lots to be owned and maintained by the Messina
Village Homeowners Association, or its assigns, and shall be used as open-space/drainage
lots". The Administrator has determined that the intent of the term "non-buildable" on the
plat was to maintain the lot as open space and prevent residential structures, not to prevent
subdivision amenities such as the one proposed. Therefore, stafffinds that the proposed use
is allowed under MCC and the conditions approval for Messina Village No. 2 Subdivision.
ACRD drainage easement: Per the Messina Village No. 2 Final Plat, Lot 4, Block 7 is subject to a
"blanket storm drainage easement in favor of the Ada County Highway District (ACRD) for
heavy maintenance of drainage facilities. Said easement shall remain free of all encroachments
and obstructions (including fences and trees) which may adversely affect drainage or
operation and maintenance of storm- water drainage facilities." The ACRD has stated in
writing that they have no objections to this project and it will not impact operation or
maintenance of their drainage facility.
Si~nage: No signs. are approved with this CZC. All signs will require a separate sign permit in
compliance with the sign ordinance.
Site Plan: The Site Plan is approved per Sheets 2.21 and 2.25 (dated 10/27/04, by The Land Group
Inc.), stamped approved on 12/3/04, and per the 8 ih x 11" site plan.
Landscape Plan: The Landscape Plan is approved per Sheets 2.51 and 2.61 (dated 10/27/04, by The
Land. Crroup, Inc.), stamped approved on 12/3/04, and per the 8 lh x 11" landscape plan.
Parkin: The parking area shall be paved and striped in accordance with MCC 11-13-4. Project
engineer/architect shall certify that the number and size of handicap-accessible spaces
conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have
signage in accordance per ADA.
Irri ag tion: An underground, pressurized irrigation system must be installed to all landscape areas per
the specifications provided.
Protection of Existing Trees: Any, existing trees on -site must be protected in accordance with the
Tree Preservation section of the City's Landscape Ordinance. Per Ordinance 12-13-13-4,
coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of
protection measures prior to construction. Any severely damaged tree must be replaced in
compliance with Ordinance 12-13-13-6.
Curbing: Per Ordinance 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other
vehicle use areas, must be protected by curbing, wheel stops, or other approved protective
devices. Curbing may be cut to allow for storm water runoff.
Li htin :Lighting shall not cause glare or impact the traveling public or neighboring development.
Trash Removal: The trash removal plan has' been discussed and approved by SSC. A 95-gallon
upgraded waste removal trashcan will be used at the site, and will be taken to the street
weekly through the direction of the homeowners association. This is an acceptable solution
to trash removal which does not require additional written approval.
ACHD Acceptance: Applicant shall be responsible for meeting the requirements of ACHD as they
pertain to this development. All impact fees, if any, shall be paid prior to the issuance of a
building permit. If any changes must be made to the site plan to accommodate the ACHD
requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning
staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by
providing surety to the City in the form of a Letter of Credit or cash in the amount of 110%
of the cost of the remaining ,improvements. A bid must accompany any request for
Temporary Occupancy. No occupancy will be granted until the final plat for the property is
recorded.
Plan Modifications: The approved Site Plan and Landscape Plan, stamped 12/3/04, are not to be
altered without prior written approval of the Planning & Zoning Department. No significant
field changes to the site or landscape plan is permitted; prior written approval of all changes is
required.

Public Works Department as regulated by City Ordinance 9-1-28. If city potable water is used, a

lots with more than lh acre of landscaping. Year round water availability is also required by

Tuscany Development Inc. is submitting this application for the approval of a community
pool in the Tuscany Subdivision. The pool will be constructed in a common lot area and
will be an amenity for the homeowners in the community. The community pool will also
benefit the City of Meridian alleviating some traffic that would travel to the public pools
This letter is to inform the Planning and Zoning department at Meridian City about the

city's minimum parking requirements. A Clubhouse and other pool structures are
planned throughout the remainder of the development as well.
The trash removal plan has been discussed and approved by SSC the waste management

Tuscany Development Inc will be directing and supervising the installation of all the pool
structures. The construction will be done in accordance with all the building provisions
set forth by the Building Department when approved by the Planning and Zoning
Department.
