This letter is sent to memorialize the agreement reached at the prt-trial conference in
front of Judge Bieter today. Mr. Huntting has agrrtd to, within 24 hours, have all
carnpcr shells placed behind the lattice fend of his lot in Meridian and to vacate tiom
the temporary job shack any equipment not related to construction of the building. In
addition, Mr. Huntting has committed that he will not sell any camper shells from his
Future business location. Jn exchange for this, it is our understanding that Mr. Nichols
will recommend to Daunt LVhitman, thz building inspector, and Shari Stiles, the
planntng administrator, that they issue a building; prrrrtit to Mr. Huntting for his new
structure. Once Mr. Huntting has received the building permit, he has agreed to have
the camper shells completely moved off site. Finally, the two criminal charges will
be disposed of through a bond forfeiture in the amount of 5225.

I have reviewed your letter of August 25, 2000, and discussed this case with
Dave Swartley from our office who is prosecuting this particular case. I have also had
a chance to visit with Shari Stiles.
The fundamental problem with this case is the divergence of stated facts
on whether your client is operating a business from the "temporary job shack" he has
placed on the premises. I have personally driven by this location several times and it
clearly appears to be a sales office. Additionally, I am informed that when Mr. Daunt
Whitman went to the premises, the inside of the shack was clearly a sales office, and not
a construction trailer merely waiting for a construction job to begin. Additionally, the
telephone number rings to that office, is listed in the phone directory at that address,
and is the phone number listed for the business as posted on the business's website.
The City may be amenable to a creative arrangement with regard to the
pending criminal charge, but apre-condition to that would be for the violation of the
zoning code to cease. In order for that violation to stop, the canopies need to be
removed from the location and the trailer abandoned in favor of the contractor that will

be doing the work. When that is done, I am prepared to recommend that the building
permit be issued for this new structure that your client intends to put up.
When this propertywas first identified as the "future home for Snake River
Truck" there was a sign on the property, and one truck cap on the back of a detached
truck bed. Now, there is a sales office, canopies for display, and as recently as last
Friday, a used canopy which apparently was for sale. It certainly was not a new model.
I urge you to get your client to stop the zoning code violation, and then we
can proceed both with construction of the new facility and resolution of the pending
criminal case.

We write you this letter and are submitting it to you through our attorneys, as Dennis Huntting is
represented by the firm of Moffatt, Thomas, Barrett, Rock & Fields, Chartered in his two
misdemeanor zoning violation charges. Shari Stiles recently communicated to us that if we were
to move and screen the camper shells at the property located at 601 S. Meridian and move the job
shack to a different location on the property, she would be willing to reissue the certificate of
zoning compliance and issue us a building permit.
We would be happy to move the camper shells to the corner of our L-shaped lot where there is a
chain-link fence with privacy lattice. If we put the camper shells behind that fence they will be
screened from view and out of the way of construction. Additionally we are willing to move the
contractor's job shack to any location on the lot that will not obstruct construction of the
building. The job shack is currently in a location where it will not obstruct construction, but
since it is a temporary job shack and is on wheels, it can easily be moved.
There seems to have been a misconception that sales have been taking place at the 601 S.
Meridian location. Please be assured that that is not the case, nor was it the case on June 7, 2000
when we were cited. The job shack was put in place only for the purpose of allowing the
contractor to have a place to work from. The job shack-does not have electricity or running
water, and only recently has been equipped with a telephone line. All of our office equipment is
stored in a railroad car in back of the property. The job shack went on the premises in April and
over the course of the last several months from April until now, our business had had a loss of
over $21,982.78. We have not been operating a business or a sales lot from this location. Once
we have a building permit, the job shack will be used only for our contractor's purposes.

We also understand that until we have an occupancy permit for the building, sales operations are
not allowed from the site. We have no intentions of operating a business until we are fully
permitted to do so. Our financing is being provided by the Olmstead Family Trust, private
financing, and the trustees can assure that we have every intention of moving forward on this
building project and indeed have begun to order materials so that we may begin building once
our building permit has been issued.
For two years we have been trying to work with the City of Meridian, the only goal of which has
been to follow the appropriate procedures so that we may build a building to be owned by the
Olmstead Family Trust and occupied by Snake River Truck.

and continues to be willing to do whatever is necessary to obtain a building permit
horn the City.
Please be advised that this letter and the letter written by Mr. Huntting and his
investors are submitted pursuant to Idaho Rule of Evidence 408 and the contents
and information contained in them have been prepared solely for settlement
purposes and as an effort to compromise the criminal matter. All the statements
contained are made without prejudice, and are not to be construed as admissions
and shall not be admissible for any purpose at any stage of the criminal proceedings
should the parties be unable to reach a compromise.
It is my hope that if we can come to an agreement that, as Ms. Stiles suggested, by
screening the camper shells and moving the temporary job shack, we can reach an
appropriate resolution to the underlying misdemeanor charges. I would suggest that

the charges be held in abeyance through a prosecutor's probation for a short period
of time with a dismissal upon Mr. Huntting's compliance, or that they be dismissed
upon an agreement of the parties at this time, or that we are able to resolve them in
some other manner short of criminal convictions. Mr. Huntting has been trying to
work with the City of Meridian for two years to build a business. It has been a
long, drawn out process and after reading the two zoning code sections that he has
been cited with, it appears to me that the temporary job shack is not considered a
structure and, as you will see from his letter, he was not occupying the job shack. It
had been placed on the property for his contractor, but the contractor could not
begin building because Mr. Huntting has been unable to obtain a building permit.
Please let me know as soon as possible how we can resolve this matter. I can be

building permit. It is my understanding that Mr. Huntting has moved all of the
camper shells behind the fence and vacated the temporary job shack. As you know,
the next court date in this matter is September 28, 2000, and since that date is
quickly approaching, it is my hope that you will contact both Shari Stiles and Mr.
Whitman to convey that he may prcx:ess the building permit application in
accordance with ow plea agreement.

Tim Bevers of the Enterprise Rent-a-Caron Meridian Road came in today. Over the weekend, the construction contractor
for the Snake River Truck Caps building leveled his fence and took a back hoe to the trees on the back side of his
building, tearing up all of his landscaping. He was pretty livid. I sent him downstairs to talk with Daunt. Later, the Snake
River contractor came in and said they would be repairing Enterprise's fence and landscaping. However, in order for
them to pour the metal building footings and not encroach onto Enterprise's lot, they have to move the building about 2
feet to the north. In order for them to still meet minimum drive aisle width on the north side, they came into request a
reduction in their planter width along the future Corporate drive from 6 feet (what was approved) to 4 feet. I asked Daunt
and he said that was pretty much the only viable option he could see. So, I approved the 2-foot reduction. They will still
have all the required trees and grass and sprinklers.

For the Ada County Highway District to accept the plans for the above referenced project, please complete the
following requirements:
1 • Please deposit $10,040.00 to the Public Rights-of--Way Trust Fund to construct approximately
265 if of curb, gutter and 5-foot wide concrete sidewalk abutting the parcel on Corporate Drive.
Deposit also includes a strip of pavement 265 if by six-feet wide abutting the parcel on
Corporate Drive.
Standard Requirements:
1 • Utility street cuts in new pavement less than five years old are not allowed unless approved in
writing by the District.
2• Relocate all above ground utilities and other obstructions from the curb
street areas unless ecificall a ,gutter, sidewalk and

induce the District to prepaze new contracts. incorporating these items. The property owners
warrant that they will, immediately upon receiving revised Contracts, sign the Contracts,
Warranty Deeds, and Easements necessary to complete these transactions.
