COMMENTS:
General: Project is subject to all terms and conditions of the Conditional Use Permit (File CUP-99-
008) approved by City Council on 9-7-99, the Development Agreement (recorded 3-23-
00), and Rezone Ordinance No. 866. This CZC applies only to Phase 2 and does not
approve any use for Phase 3 of the complex. Phase. 3 will require a separate CUP.
Si na e: No project signage was submitted or approved with the CUP. All future signs are subject
to design review by P&Z Department and require separate permits. No signage is permitted
in ACHD right-of--way. No portable signs or temporary signage permitted (such as A-
Frames).
Parking: Standard and handicap accessible parking requirements are met by the plan. Dimensions
of all parking areas shall conform to minimum dimensions as per city ordinance and ADA.
Handicap parking spaces must have signage and striping per ADA standards.
Landscaping: All trees and lawn areas must be planted as per the approved landscape plan (Sheet
L.S-1, dated May 2000, last revised 12-3-99, by Harvest Design). Written approval of any
changes is required; no field changes permitted.
Irri ation: An underground, pressurized irrigation system must be installed to all landscape areas_
Construction Timing: Note the Fire Department special conditions in the CUP Decision & Order
(#2.8 and 2.9, pg. 19) regarding the main access driveway and loop drive must be constructed
before building begins.
Undeveloped Property: The undeveloped portion of the property designated for Phase 3 must be
kept mowed and free from weeds over 8" in height. No parking, outdoor storage or other
use is permitted on the undeveloped portion of the lot.

NMID Ap royal: This CZC is issued based on the 5-31-00 approval letter from Bill Henson,
NMID. However, the City must still receive a copy of the final License Agreement to
verify their approval for the building, fencing and landscape encroachments into the
Fivemile easement as part of the Public Works review and approval process.
Securi Gate: As stated in the CUP conditions, the security gate between Sterling Creek Subdivision
and Creekside Arbour on the sidewalk must be kept open at all times except after dark.
Trash Enclosures: As stated in the 5-4-00 letter from Sanitary Service Company, the trash enclosure
pad and area must be expanded to a minimum of 11 feet wide.
Plan Modifications: The Site Plan, Sheet Al, is not to be altered without prior written
approval of the Planning & Zoning Department. No field changes to the site plan are
permitted; prior written approval of all changes is required.
The Site Plan stamped on 6/8/2000 is approved with the comments noted above
