Landscaping: The landscape plan prepared by Brooks Design Group, labeled L-1 & L-2, Project 70-
54, dated 2-28-04, and stamped "approved" on 3-30-04 by the Meridian Planning and Zoning
Department, is approved with the following changes: 1) MCC 12-13-11-3.E requires all interior
planters that serve a single row of parking spaces to be landscaped with at least one tree and to be
covered with low shrubs, lawn, or other vegetative groundcover. There are 4 proposed planters: east
of Building 16, north of Building 62 (2), and north of Building 22, that do not have at least one tree.
Install approved trees within the proposed planters in accordance with MCC 12-13-11-3. Other than

The Nampa & Meridian Irrigation District's Hunter Lateral courses parallel to Sagecrest Subdivision
as well as Resolution subdivision. The developer illegally installed a sidewalk, which they call a
pathway, and which they told the District was required, by the City of Meridian, to do so. They did
manage to miss going over the top of the pipe, which was a good thing.
We have now been told the city requires that the perimeter of the subdivision be fenced. If this is
done, the District will ask that the pathway be removed completely as it will shove us too far ovor to
the west, possibly off of our right-of-way wluch would not allow the District to be able to do
maintenance.
Therefore I yam requesting that the City of Meridian waive this requirement, in this subdivision, as the
lateral is piped and fencing would be a detriment to the District's ability to operate and maintain this
facility.

NOTE: The proposed parking design for the office areas, adjacent to Overland Road and Millennium
Way, meet the City's dimensional standards and may be constructed with this CZC. All future office
buildings_ are required to obtain detailed CUP approval and separate CZC approval prior to
construction. The subject CZC does not approve landscaping, building location or size, or the other
improvements or requirements (except for the parking layout) for the office portion of this
development.
NOTE 2: As a condition of approval for this multi-family development, the City Council prohibited
vinyl siding on the buildings. Construction of all the buildings in this development shall be of stucco
as proposed on the elevations submitted with this CZC.
Irri ag tion: An underground, pressurized irrigation system must be installed to all landscape areas per
the approved specifications and in accordance with MCC 12-13-8 and MCC 9-1-28.
Curbin : Per MCC 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other
vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices.
Curbing may be cut to allow for storm water runoff.
Protection of Existing, Trees: Any existing trees on site must be protected in accordance with the
Tree Preservation section of the City's Landscape Ordinance. Per MCC 12-13-13-4, coordinate with
the Parks Department Arborist (Elroy Huff) for approval of protection measures prior to
construction. Any severely damaged tree must be replaced in compliance with MCC 12-13-13-6.
Parking: The project engineer/architect shall certify that the number and size of handicap-accessible
spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must
have signage in accordance per ADA. The applicant shall be responsible for meeting the
requirements of ACHD as they pertain to this development
Sidewalks: All sidewalks shall be constructed as submitted and in accordance with MCC 12-5-2.K.
Sidewalks shall be constructed prior to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully
vegetated, and shall be designed in compliance with the MCC.
Li htin : Lighting shall not cause glare or impact the traveling public or neighboring development.
Signage: No signs are approved with this CZC. All signs will require a separate sign permit in
compliance with the sign ordinance.
Trash Enclosure: Any dumpster(s) must be screened in accordance with MCC 11-12-1.C. Trash
enclosures must be built in the location and to the size approved by SSC.
Handicap-Accessibility: The structure, site improvements and parking must be in compliance with
all federal handicap-accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit.
If any changes must be made to the site plan to accommodate the ACHD requirements, a new site
plan shall be submitted to the City of Meridian Planning and Zoning staff for approval prior to the
issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing
surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the
remaining improvements. A bid must accompany any request for Temporary Occupancy.
Plan Modifications: The approved Site Plan and Landscape Plan, stamped "approved" on 3-30-04
are not to be altered without prior written approval the Planning and Zoning Department. No
significant field changes to the site or landscape are permitted; prior en approval of all

Also, requiring plans prepared by a landscape professional minimizes the likelihood of trees dying or interfering

All landscape areas regulated by the City Landscape. Ordinance (12-13) shall be served with an
automatic underground irrigation system. Additional requirements affecting pressurized
irrigation systems can be found in City Ordinance 9-1-28.
Irrigation Water Source
Use of non -potable irrigation water is required when determined to be available by the City
Public Works Department as regulated by City Ordinance 9-1-28. If city potable water is used, a
separate water meter is recommended so the owner can avoid paying sewer fees for irrigation
water. Potable water shall not be used as a primary irrigation water source on non-residential
lots with more than '/2 acre of landscaping. Year round water availability is also required by
connecting to city potable water or an on-site well as a secondary source.
